<h3>مقدمة</h3>
تلعب النساء دورًا محوريًّا في قطاع الخدمات المصري بنسبة 57% (UNESCWA, 2020)، وبشكل عام في المهن التي يتم فيها التعامل مباشرة مع الجمهور وسط ظروف عمل خاصة وخلال أوقات مختلفة من اليوم، ومنها على سبيل المثال قطاع التمريض، حيث تشكل النساء 91.4% من إجمالي هيئة التمريض في القطاع الحكومي، وتصل النسبة إلى 71% في تمريض القطاع الخاص، وفي ظل غياب آليات وسياسات الحماية من العنف تتعرض النساء من مقدمي الخدمات للعديد من الانتهاكات التي تمر بلا محاسبة تحت دعوى أن التعامل مع الجمهور لا بد وأن تكون له عواقب، أو أن هذه "طبيعة المهنة"، بينما تتطلب هذه الانتهاكات التصدي لها من خلال آليات وسياسات بعينها.
<h3 dir="rtl">ماذا يعني العنف في مجال العمل؟</h3>
لا شك أن تدقيق وفهم المصطلحات ينعكس بالضرورة على تقدير حجم الظاهرة، وهنا تكمن الخطورة حيث ارتبط العنف في أذهان كثير من المواطنين بأنه الضرب المبرِّح أو الاغتصاب، وبالتالي لا يفهم الأفراد أشكال التعدي والمضايقات الأخرى، باعتبارها صورًا من صور العنف التي تتطلب اتخاذ إجراءات وآليات وقائية أو عقابية.&nbsp;
وهنا تجدر الإشارة إلى أنه وفقًا لاتفاقية منظمة العمل رقم 190 بشأن العنف والتحرش في عالم العمل، يشير مصطلح العنف والتحرش إلى "مجموعة من السلوكيات والممارسات غير المقبولة أو التهديدات المرتبطة بها، سواء حدثت مرة واحدة أو تكررت، تهدف أو تؤدي أو يحتمل أن تؤدي إلى إلحاق ضرر جسدي أو نفسي أو جنسي أو اقتصادي"، ويمكن تصور هذه السلوكيات، مثل: (التنمر والتهديد، والإهانة اللفظية، وإساءة المعاملة، والمطاردة والملاحقة، وعدم وجود وقت للراحة، وعدم وجود دورات مياه أو تقييد استخدامها، كذلك الفصل من العمل على خلفية الزواج أو الحمل والإنجاب، والتحرش والاستغلال والابتزاز الجنسي)، وتتدرج الممارسات السابقة حتى أنها تصل أحيانًا إلى حد الاتجار بالبشر.
تعرَّض أكثر من واحد من كل خمسة موظفين عالميًّا (أي ما يقترب من 23%) للعنف والتحرش في مكان العمل، سواء كان جسديًّا أو نفسيًّا أو جنسيًّا، وعلى الصعيد العالمي، قال 17.9% من الرجال والنساء العاملين إنهم تعرضوا لعنف وتحرش نفسي في مرحلةٍ ما من حياتهم المهنية، و8.5% تعرضوا لعنف وتحرش جسدي (ILO, 2022).
<h3 dir="rtl">لماذا يعتبر العنف في عالم العمل قضية مربِكة ومركَّبة؟&nbsp;</h3>
يعتبر العنف المبني على النوع الاجتماعي بشكل عام من القضايا ذات الحساسية في المجتمع، ولكن يظل العنف في عالم العمل له حيثية خاصة لعدد من الأسباب، منها:&nbsp;
<ul>
<li dir="rtl" aria-level="1">
وقوع النساء بين السلطة الذكورية لصاحب العمل وبين السلطة الأبوية للأب والأخ والزوج والابن أحيانًا، الذين قد يجبرونها على ترك العمل إذا اشتكت من التحرش تحديدًا.
</li>
<li dir="rtl" style="text-align: justify;" aria-level="1">
احتياج النساء إلى العمل والدخل المادي يجبرهن في بعض الأحيان على تحمل أشكال عديدة من العنف والتحرش خوفًا من فقدان فرصة عملهن، كذلك تتحكم السلطة الوظيفية في العمل في صعوبة التضامن مع الناجيات من العنف، خاصة إذا اُرتكب العنف من رئيس العمل أو صاحب العمل فإن مواقف الزملاء والشؤون القانونية لن تكون محايدة، وسوف تنحاز في أغلب الأحيان إلى صاحب العمل.

<li dir="rtl" style="text-align: justify;" aria-level="1">
يميل المجتمع إلى لوم الضحايا من النساء، وتاريخيًّا وبحكم علاقات القوى، غالبًا ما يتم اتهام المرأة بأنها مَن تشجع صاحب العمل طمعًا في ترقية أو مكافأة وهو ما يجعل العاملات يتراجعن عن الإفصاح عند تعرضهن للتحرش خوفًا من التعرض إلى الوصم والاتهام.

<li dir="rtl" style="text-align: justify;" aria-level="1">
العديد من النساء العاملات يعملن في القطاع غير المنظم في ظروف عمل هشة وغير لائقة ولا تتوفر بها أية ضمانات للحماية، وبالتالي يكون من الصعب إثبات واقعة العنف والتحرش حيث يكون من الصعب أصلًا إثبات علاقة العمل.

تتزايد فرص حوادث العنف بوضوح كلما كان مكان العمل غير ملائم، لا يتضمن سياسات حماية أو مدونات سلوك وظيفي، أو إدارة للشكاوى والتحقيقات أو أنه لا يتضمن أدوات الحماية والوقاية، مثل: الإضاءة الكافية والكاميرات والمكاتب الزجاجية وغيرها. (Saleh, 2023)

<li dir="rtl" style="text-align: justify;" aria-level="1">
تتزايد معدلات العنف والتحرش حيث تتواجد النساء بكثافة في عدد من المهن المحددة، مثل: التمريض والضيافة الجوية والسكرتارية والزراعة والصحافة والفن والإعلام والخدمة المنزلية وفي المطاعم والكافيهات وفي مجال الاتصالات والمنصات الرقمية، حيث يتعامل المجتمع مع هذه الحوادث على أنها جزء من مخاطر أو طبيعة المهنة.

</ul>
<h3 dir="rtl">وضعٌ معقد في القطاع الخاص</h3>
وإذا وضعنا في الاعتبار أن الإطار الهيكلي والإداري في القطاع العام قد يقلل من صور العنف التي تتعرض لها النساء نسبيًّا، فالأمر يصبح أكثر تعقيدًا في القطاع الخاص، الذي تتحكم فيه عدة عوامل، أولُها على سبيل المثال: الصورة الذهنية النمطية عن النساء العاملات في بعض مهن قطاع الخدمات العامة، مثل: التمريض والضيافة وخدمة العملاء، وثانيها: النظرة المجتمعية للجمهور أو المواطنين التي يغذيها أصحاب العمل بأن الزبون دائمًا على حق، وثالثها: علاقات العمل الهشة وغير المتكافئة، التي تجعل العمال والعاملات في مهب الريح في أية لحظة، إذا أعربوا عن غضبهن أو استيائهن من صور العنف والتمييز، ما يؤثر بشكل واضح في نسب الإفصاح والإبلاغ عن وقائع العنف والتحرش. (Etisalat, 2024)
وقد أَوْلَت منظمة العمل الدولية في التوصية 206 الملحقة والمكملة للاتفاقية 190، بشأن العنف والتحرش في عالم العمل، اهتمامًا خاصًّا بعملية تقييم المخاطر في مكان العمل والعنف الواقع من أو على الطرف الثالث (الزبون، العميل، أو متلقي الخدمة بشكل عام)، كما أكدت على ضرورة أن تعتمد الدول الأعضاء في المنظمة تدابير ملائمة من أجل القطاعات أو المهن وترتيبات العمل، التي يكون فيها التعرض للعنف والتحرش أكثر احتمالًا، مثل: العمل الليلي والعمل في أماكن معزولة والخدمات الصحية والضيافة والخدمات الاجتماعية وخدمات الطوارئ والعمل المنزلي والنقل والتعليم والترفيه.
<h3 dir="rtl">الحماية من العنف في القوانين المصرية&nbsp;</h3>
أولًا: قانون العقوبات
تضمَّن القانون تشديد عقوبة التحرش إذا كان الجاني له سلطة وظيفية أو أُسرية أو دراسية على المجني عليهم، بحيث يعاقَب بالسَّجن مدة لا تقل عن سبع سنوات.&nbsp;&nbsp;
ثانيًا: قانون الخدمة المدنية
لم يتضمن قانون الخدمة المدنية نصًّا صريحًا حول الحماية من العنف في بيئة العمل، ولكنه تطرق إلى ذلك بشكل سريع من خلال بند الاحترام واللباقة في علاقات العمل بمدونة السلوك الوظيفي للعاملين بالدولة حيث جاء فيها:&nbsp;
ا- التعامل باحترام ولباقة مع الزملاء والمحافظة على علاقات سليمة وودية معهم دون تمييز، والحرص على احترام خصوصياتهم والامتناع عن استغلال أية معلومات تتعلق بحياتهم الخاصة بقصد الإساءة.
2- الامتناع عن أية تصرفات لا أخلاقية تنتهك الآداب العامة والقوانين والأعراف.&nbsp;
3- الامتناع عن كافة صور التحرش الجنسي من أقوال وأفعال أو إيماءات خادشة للحياء سواء بشكل سافر أو مستتر.
ثالثًا: قانون العمل الموحد
لم يتطرق قانون العمل الموحد رقم 12 لسنة 2003 في نسخته الحالية إلى أية مواد تتعلق بالحماية من العنف، حتى أن المقترحات الجديدة لمشروع القانون التي تمت مناقشتها خلال الأعوام الماضية أيضًا قد تجاهلت مطالب عديد من النقابات والمؤسسات الحقوقية والنسوية بضرورة النص على آليات الحماية من العنف في عالم العمل، باعتباره أحد عناصر الصحة والسلامة المهنية.
<h3 dir="rtl">&nbsp;خطوات على طريق الحماية</h3>
خلال العقود الماضية تراجعت نسبة مشاركة النساء في سوق العمل في المنطقة العربية بشكل عام، حيث بلغت حوالي 19% من قوة العمل (Annd, 2021) وفي مصر وصلت إلى 17% بحسب تقديرات الجهاز المركزي للتعبئة العامة والإحصاء لعام 2022، الأمر الذى دفع الحكومة المصرية ممثلةً في وزارة العمل والمجلس القومي للمرأة إلى إطلاق عدد من الخطط والاستراتيجيات الوطنية، لدعم تمكين النساء في العمل، كان من أبرزها: الاستراتيجة الوطنية لتمكين المرأة 2030، ومحفز سد الفجوة بين الجنسين الصادرة عن المجلس القومي للمرأة (وحدة المساواة بين الجنسين والتمكين الاقتصادي للمرأة بوزارة العمل)، والخطة الوطنية لتعزيز المساواة بين الجنسين في مجال العمل، وبالرغم من أهمية هذه الخطط فإنها قد ركزت في مجالات عمل محددة أغلبها في القطاع الخاص، بينما تجاهلت الإشكاليات الإجرائية في التشريع المصري، التي من أهمها:&nbsp;

غياب آليات وضمانات الحماية للشهود والمبلِّغين من الأعمال الانتقامية، خاصة إذا حدثت واقعة العنف في مكان العمل.&nbsp;
</li>
<li dir="rtl" style="text-align: justify;" aria-level="1">
عدم تفعيل دور مفتشي الصحة والسلامة المهنية في رصد صور العنف والتصدي لها.&nbsp;
</li>
<li dir="rtl" style="text-align: justify;" aria-level="1">
غياب آليات التعامل مع الطرف الثالث أو متلقي الخدمة الذي هو طرف أصيل في قطاع الخدمات.

<h3>توصيات</h3>
ضرورة تصديق مصر على الاتفاقية 190 بشأن العنف والتحرش في عالم العمل وتعديل قانون العمل الموحد وفقًا لإطار الحماية الوارد بالاتفاقية والتوصية 206 الملحقة بها.

اعتماد سياسة عدم التسامح مطلقًا مع العنف في لوائح العمل ومدونات السلوك الوظيفي، والتأكيد على أن التصدي للعنف هو معيار أساسي من معايير الصحة والسلامة المهنية.

<h3>Introduction</h3>
Women play a pivotal role in the Egyptian service sector, shaping 57% of the workforce (UNESCWA, 2020). In general, women take on roles where they deal directly with the public, this could entail special working conditions and non-traditional working hours. Women working as nurses in the healthcare sector are a prime example; women constitute 91.4% of the total nursing staff in the public sector. Meanwhile, the percentage reaches 71% in the private sector. However, in the absence of mechanisms and policies to protect women from violence, female employees face harassment that is disregarded under the pretext that dealing with the public is difficult or that it is simply the &ldquo;nature of the profession.&rdquo; When these violations must be addressed through specific mechanisms and policies.
<h3 dir="ltr">What does violence at work mean?</h3>
There is no doubt that examining and understanding the terminology is necessary in order to assess the magnitude of the phenomenon, and here lies the danger, as violence is associated in the minds of many with severe bodily harm or rape. Therefore, many individuals do not understand that other actions are considered forms of assault and harassment. Yet, these forms of violence require taking punitive or preventive measures and mechanisms.
Here it is worth noting that according to the Labor Organization Convention No. 190 on Violence and Harassment in the World of Work, the term violence and harassment refers to &ldquo;a range of unacceptable behaviors and practices, or threats thereof, whether a single occurrence or repeated, that aim at, result in, or are likely to result in physical, psychological, sexual or economic harm, and includes gender-based violence and harassment,&rdquo; and these behaviors can include things like bullying and threatening, verbal insults, ill-treatment, stalking, and persecution, being denied time to rest or bathroom breaks, as well as dismissal from work due to change in marital status, pregnancy and childbirth. Other forms of violence women may be subjected to in the world of work include sexual harassment, exploitation and blackmail, and in some extreme cases this can reach the point of human trafficking.
More than one in five employees globally, 23% of employees to be exact, have been exposed to violence and harassment in the workplace, whether physical, psychological, or sexual. Globally, 17.9% of working men and women said they had been exposed to psychological abuse at some point in their professional lives, while 8.5% were exposed to physical violence and harassment (ILO, 2022).
<h3 dir="ltr">Why is violence in the workplace such a confusing and complex issue?</h3>
Gender-based violence is generally considered a sensitive issue in society, but violence in the workplace remains of particular importance for several reasons, including:
<ul>
<li dir="ltr" style="text-align: justify;">Women are caught between the male authority of the employer and the patriarchal authority of the father, brother, husband, and sometimes the son, who may force her to leave work if she specifically complains of harassment.</li>
<li dir="ltr" style="text-align: justify;">Women's need for work and financial income sometimes forces them to endure many forms of violence and harassment for fear of losing their jobs. The power dynamics at the workplace also isolate the victim and make it so that other employees cannot stand in solidarity with survivors of violence. This is especially true if the violence is committed by the boss or employer. Furthermore, if the woman reports the violence to legal affairs or human resources they will not be impartial and will often side with the employer.</li>
<li dir="ltr" style="text-align: justify;">Society tends to blame female victims. Due to the power dynamic, women are often accused of &ldquo;encouraging&rdquo; their employers in the hopes of a promotion or reward. This forces female workers to refrain from speaking up when they are subjected to harassment, fearing the blame and the stigma.</li>
<li dir="ltr" style="text-align: justify;">Many women work in the unorganized sector and face imperfect work conditions, that do not provide any guarantees of protection. Due to the nature of these work conditions, it is difficult to prove the employment of these women, let alone prove incidents of violence and harassment.</li>
<li dir="ltr" style="text-align: justify;">The chances of violent incidents increase whenever the workplace environment and culture don&rsquo;t include protection policies. The absence of other measures like codes of job conduct, as well as a human resources department geared toward managing complaints and investigations also increases the incident rate. Finally, the lack of prevention tools like adequate lighting, cameras, glass offices, etc. also increases the chances for violent incidents (Saleh, 2023).</li>
<li dir="ltr" style="text-align: justify;">The odds of women facing violence and harassment are higher within certain sectors, like agriculture, journalism, art, media, communications, and the food services sector. In addition, jobs like nursing, cabin crew, secretarial workers, and domestic workers also see a high incident rate. However, society deals with these incidents as part of the risks or nature of the profession.&nbsp;</li>
</ul>
<h3 dir="ltr">A complex situation in the private sector</h3>
If we consider that the structural and administrative framework of the public sector may reduce the forms of violence to which women are exposed &ndash; then we must concede that the matter becomes more complicated in the private sector. Several factors come into play, the first of which is the harmful and stereotypical view of women working in certain professions in the services sector like nursing, hospitality, and customer service. Second, the widely adopted view of the public &ndash; which is often encouraged by the employer - that the customer is always right. Third, fragility and unequal labor relations, that leave male and female workers at risk of various forms of violence and discrimination, if they express anger or dissatisfaction with forms of violence and discrimination. A fact that affects disclosure rates and the reporting of incidents of violence and harassment. (Etisalat, 2024)
Recommendation 206 of the International Labor Organization&rsquo;s Convention 190, hones in on violence and harassment in the world of work, assessing risks in the workplace and violence occurring from or against a third party (customer, client, or service recipient in general). The UN agency also emphasized the need for Member States to adopt appropriate measures for sectors or professions where exposure to violence and harassment is more likely, like night work, healthcare, hospitality, social services, emergency services, domestic work, transport, education, and more.
<h3 dir="ltr">Protection from violence in Egyptian laws</h3>
First: The Penal Code
The Egyptian Penal law increases the penalty for harassment if the perpetrator has job, family, or educational authority over the victim, with a minimum imprisonment sentence of seven years.
Second: Civil Service Law
The Civil Service Law does not include an explicit text about protection from violence in the work environment. However, the legal text does introduce a clause on respect and courtesy in work relations where it states:
1. One must be respectful and courteous with colleagues. Individuals must maintain healthy and friendly relations with others without discrimination. Employees should respect other&rsquo;s privacy and refrain from exploiting any information related to their private lives with the intention of causing harm.
2. Refrain from any immoral actions that violate public morals, laws, and customs.
3. Refrain from all forms of sexual harassment, including indecent words, actions, or gestures, whether blatantly or covertly.
Third: The Unified Labor Law
The current Egyptian Labor Law No. 12 of 2003 does not include any articles related to protection from violence. New proposals for the draft law, which were discussed in the past years, ignored the demands of many unions, human rights organizations, and feminist institutions to include a mechanism to protect individuals from violence in the workplace deeming the issue as an occupational health and safety measure.
<h3 dir="ltr" style="text-align: justify;">Steps on the path to protection</h3>
Over the past decades, the percentage of women&rsquo;s participation in the labor market has declined in the Arab region in general, reaching about 19% of the workforce (Annd, 2021). In 2022, women shaped 17% of the workforce, according to the estimates of Egypt&rsquo;s Central Agency for Public Mobilization and Statistics. The figure prompted the Egyptian Ministry of Labor and the National Council for Women, to launch a number of national plans and strategies aimed at empowering women at work. The most prominent of these strategies is the National Strategy for Women&rsquo;s Empowerment 2030, and the National Council for Women&rsquo;s plan for closing the gender gap and promoting equality through a combined effort with the Ministry of Labor. Despite the importance of these plans, they focused on specific segments of the labor market, most of which are in the private sector. However, these plans ignore the procedural problems in Egyptian legislation, the most important of which are:

<li dir="ltr">The absence of mechanisms and guarantees to protect witnesses and whistleblowers from reprisals, especially if an incident of violence occurs in the workplace.</li>
<li dir="ltr">Failure to activate the role of occupational health and safety inspectors in monitoring and responding to workplace violence.</li>
<li dir="ltr">The absence of mechanisms for dealing with the service recipient or third party who is a key player in these situations.&nbsp;</li>
</ul>
<h3 dir="ltr">Recommendations</h3>
Egypt needs to ratify Convention 190 on Violence and Harassment in the World of Work and amend the Labor Law in accordance with the protection framework contained in the Convention and Recommendation 206.
<ul>
<li dir="ltr">Adopting a zero-tolerance policy for violence in regulations and codes of conduct as well as normalizing the confrontation of violence as a basic standard of occupational health and safety.</li>
<li dir="ltr">Strengthening the role of unions and federations in confronting violence and adopting the measures stipulated in Convention 190 by dialoguing with business owners and emphasizing that the economic and social cost of protecting women from violence is much lower than the economic cost of treating the effects of violence. (Adly, 2022).</li>
