<a href="https://www.nature.com/articles/s41598-024-60857-2">تظهر</a> بحوث استطلاعات على العاملين في القطاع الصحي في 13 محافظة ارتفاع معدلات العنف ضد الأطباء في مصر، حيث <a href="https://www.nature.com/articles/s41598-024-60857-2">تعرض</a> 88% منهم للعنف اللفظي، و42% للاعتداء الجسدي، و13.2% للتحرش الجنسي.

وبغض النظر عن حجم العقوبة، فإن امتثال الأطباء للتحقيق الجنائي سواء كانوا المدعين أو المدعى عليهم من شأنه أن <a href="https://mdujournal.themdu.com/issue-archive/issue-5/avoiding-the-clinical-becoming-criminal">يقوض</a> نظام الصحة العامة ويضر بقدرتهم على توفير الرعاية اللازمة للمرضى. ففي حين <a href="https://www.ems.org.eg/ar/news/2/2915">تطالب</a> نقابة الأطباء بتغليظ عقوبة الاعتداء على المنشآت الصحية والفريق الصحي في المستشفيات العامة والخاصة، فإن المشكلة تكمن في <a href="https://www.hegazylaw.com/in-depth-tortious-error-and-the-draft-medical-liability-law-in-egypt/#:~:text=Currently%2C%20medical%20professionals%20who%20commit,58%2F1937">خضوع</a> جميع النزاعات بين المريض والطبيب للتحقيق الجنائي وفقًا لقانون العقوبات رقم 58 لسنة لسنة 1937 (والمعدل بالقانون رقم 95 عام 2003)، في حين أنه ينبغي أن يقتصر اللجوء إليه عند حالات الإهمال الجسيم المتعمد.

و<a href="https://www.thelancet.com/journals/langlo/article/PIIS2214-109X(24)00310-3/fulltext">تواجه</a> مصر أزمة نقص في أعداد الأطقم الطبية في المستشفيات العامة وفي أقسام الطوارئ خاصةً بسبب تردي أوضاع العمل التي تؤدي إلى الاستقالة والهجرة. <a href="https://www.ems.org.eg/ar/news/Committees/2430">أعلنت</a> النقابة أن معدل الأطباء في مصر لعام 2021 كان 9.2 طبيب لكل 10 آلاف مواطن، بعيدًا جدًّا عن المتوسط العالمي وهو 23 طبيبًا لكل 10 آلاف مواطن.

فبجانب <a href="https://journals.ekb.eg/article_314689_8987bd31dcd51ab19087fc6e7d3907da.pdf">ظروف العمل</a> القاسية في المستشفيات العامة، <a href="https://iris.who.int/rest/bitstreams/1239786/retrieve">يعد</a> تدني أجور الأطباء من أهم أسباب أزمة النظام الصحي، وخاصة أطباء الامتياز وهم <a href="https://daaarb.com/%D9%85%D8%B5%D9%8A%D8%B1%D9%86%D8%A7-%D9%88%D8%A7%D8%AD%D8%AF-%D8%AA%D8%B7%D8%A7%D9%84%D8%A8-%D8%B1%D8%A6%D9%8A%D8%B3-%D8%A7%D9%84%D8%AC%D9%85%D9%87%D9%88%D8%B1%D9%8A%D8%A9-%D8%A8%D8%AA%D8%B7%D8%A8/">حائط</a> المواجهة الأول في أقسام الاستقبال والطوارئ، حيث <a href="https://www.ems.org.eg/ar/news/1/2910">تبلغ</a> مرتباتهم 2800 جنيه شهريًّا في حين <a href="https://www.ems.org.eg/ar/news/1/2910">يتقاضى</a> الطبيب المقيم 7 آلاف جنيه بعد ارتفاع الحد الأدنى للأجور إلى 6 آلاف في مارس 2024. ومع<a href="https://journals.ekb.eg/article_314689_8987bd31dcd51ab19087fc6e7d3907da.pdf"> تزايد</a> الضغوط على الأطباء فى المستشفيات الحكومية، <a href="https://asharq.com/reports/84848/%D9%85%D8%B5%D8%B1-%D9%87%D8%AC%D8%B1%D8%A9-%D8%A7%D9%84%D8%A3%D8%B7%D8%A8%D8%A7%D8%A1-%D8%AA%D8%AA%D8%B5%D8%A7%D8%B9%D8%AF-%D9%88%D8%AC%D9%87%D9%88%D8%AF-%D8%AD%D9%83%D9%88%D9%85%D9%8A%D8%A9-%D9%84%D8%B3%D8%AF-%D8%A7%D9%84%D8%B9%D8%AC%D8%B2/">شهد</a> عام 2022 استقالة أكثر من 4300 طبيب مصري.
ترتبط أزمة الأطباء كذلك بتراجع الدولة عن الإنفاق الكافي على النظام الصحي، ففي حين <a href="https://manshurat.org/node/4256">ألزمت</a> المادة رقم (18) من الدستور المصرى الدولة بتخصيص نسبة 3% من الناتج المحلي الإجمالي للإنفاق الحكومي على الصحة، فإن الحكومة لم تلتزم بذلك حيث بلغ <a href="https://mof.gov.eg/ar/posts/stateGeneralBudget/63a95e67da80a50008d14783/%D9%85%D9%88%D8%A7%D8%B2%D9%86%D8%A9%20%D8%B9%D8%A7%D9%85%D8%A9%202023%2024">نصيب</a> قطاع الصحة فى موازنة العام المالى 2024/2023 نحو 1.2% من الناتج المحلي الإجمالي.

<h3 dir="rtl">تحسين مناخ العمل الصحي يقلل الاحتقان: كوبا مثالًا</h3>
<a href="https://immattersacp.org/archives/2010/09/cuba.htm">يتميز</a> القطاع الصحي الكوبي بقرب العلاقة بين الأطباء والمرضى، حيث <a href="https://pubmed.ncbi.nlm.nih.gov/17707542/">يتعامل</a> كل مريض مع طبيب أسرة مختص للأمور الاعتيادية وفي حالات الطوارئ يتم توجيه المرضى لوحدات صحية بأطباء متخصصين، الأمر الذي يجعل من غير المرجح وصول المريض لغرفة الطوارئ إلا في الحالات الحرجة جدًّا.
<a href="https://www.sciencedirect.com/science/article/abs/pii/S0168851007001480">ساعد</a> ذلك النظام في تقليل الضغط على أقسام الاستقبال بالمستشفيات عبر تطوير نظام "خط الطوارئ الأول" والذي يتم من خلاله فحص وإحالة المرضى إلى طبيب الأسرة الخاص بهم قبل تقديم مستويات أعلى من الرعاية في المستشفيات لمن يحتاجها. كما <a href="http://medicc.org/ns/cuba-has-one-of-the-most-efficient-healthcare-systems-in-the-world-great-com/">يعتمد</a> النظام الكوبي على الزيارات الدورية للأطباء والمتابعات المجانية من أجل تجنب تردي صحة المواطنين وبالتالي زيادة احتمالية احتياجهم لتدخلات مكلفة وطارئة.

<h3 dir="rtl">تفعيل تشريعات الرعاية الصحية للأسرة</h3>
<a href="https://www.thelancet.com/journals/langlo/article/PIIS2214-109X(24)00310-3/fulltext">أخذت</a> مصر بالفعل خطوات أولية لتطوير <a href="https://iris.who.int/rest/bitstreams/1239786/retrieve">نظام الوحدة الصحية</a> الذي يقترب قليلًا من نموذج طبيب الأسرة الذي يخفف الحمل عن غرف الطواريء، لكن تتركز المشكلة في عدم استقرار الأطباء في <a href="https://aps.aucegypt.edu/ar/articles/1317/sustainability-of-health-insurance-and-the-challenges-of-agricultural-greenhouses">الوحدات الصحية</a> التابعة للقطاع العام بسبب ظروف العمل. لذا يجب تحسين مستويات الدخول وظروف الشغل للعاملين في قطاع الرعاية الصحية للحد من ظاهرة هجرة العقول، بالإضافة إلى ضرورة زيادة الإنفاق الحكومي على الصحة من أجل زيادة أعداد المستشفيات والوحدات الصحية العامة المجهزة.
كما يساعد قانون <a href="https://aps.aucegypt.edu/ar/articles/1317/sustainability-of-health-insurance-and-the-challenges-of-agricultural-greenhouses">التأمين الصحى الشامل</a> الذي يتبع نهج صحة الأسرة على تحسين العلاقة بين الطبيب والمريض، وتسهيل الوصول إلى الرعاية الجيدة وتخفيف الضغط عن غرف الطوارئ، لذا يجب على الدولة الإسراع بتطبيقه على المحافظات كافة.

The alarming frequency of <a href="https://www.ems.org.eg/ar/news/2/2926">attacks</a> on medical staff in emergency rooms in Egypt underscores the pressing need to address the structural problems in the health care system. The heightened tension is a result of ill-equipped hospitals, a deteriorating work environment, and low wages that worsen the shortage of healthcare professionals and contribute to medical brain drain. The <a href="https://www.ems.org.eg/ar/news/2/2915">absence</a> of a law on medical liability that regulates the doctor-patient relationship is at the heart of this crisis, demanding immediate attention.

<h3 dir="ltr">A hostile relationship between doctor and patient</h3>
The World Health Organization <a href="https://bmchealthservres.biomedcentral.com/articles/10.1186/s12913-022-08867-6#:~:text=The%20incidence%20of%20violence%20in,pandemic%20%5B9%2C%2010%5D.">defines</a> workplace violence against medical staff as the deliberate use or threat of violence. In Egypt, the rates of violence against healthcare workers are the <a href="https://bmchealthservres.biomedcentral.com/articles/10.1186/s12913-022-08867-6#:~:text=The%20incidence%20of%20violence%20in,pandemic%20%5B9%2C%2010%5D.">highest</a> in Africa, with most altercations occurring in emergency rooms due to the lack of a specific legal framework to protect doctors from attacks. This violence not only endangers the lives of medical staff but also severely disrupts the healthcare system, hindering the delivery of essential care to patients.
Surveys of health workers in 13 governorates <a href="https://www.nature.com/articles/s41598-024-60857-2">found</a> high rates of violence against doctors in Egypt: 88% of them <a href="https://www.nature.com/articles/s41598-024-60857-2">experienced</a> verbal abuse, 42% confronted physical assault, and 13.2% faced sexual harassment.
While 30.5% of the respondents experienced violence more than five times in a year, only 14.3% of the doctors surveyed took <a href="https://www.nature.com/articles/s41598-024-60857-2">legal action</a>. Legal action is often <a href="https://www.independentarabia.com/node/403581/%D8%A7%D9%84%D8%A3%D8%AE%D8%A8%D8%A7%D8%B1/%D8%A7%D9%84%D8%B9%D8%A7%D9%84%D9%85-%D8%A7%D9%84%D8%B9%D8%B1%D8%A8%D9%8A/%D8%A7%D9%84%D9%85%D8%B3%D8%A4%D9%88%D9%84%D9%8A%D8%A9-%D8%A7%D9%84%D8%B7%D8%A8%D9%8A%D8%A9-%D9%85%D8%B5%D8%B1-%D8%AA%D9%88%D8%A7%D8%AC%D9%87-%D8%A7%D9%84%D8%A7%D8%B9%D8%AA%D8%AF%D8%A7%D8%A1%D8%A7%D8%AA-%D8%A8%D8%B9%D9%82%D9%88%D8%A8%D8%A7%D8%AA-%D9%85%D8%BA%D9%84%D8%B8%D8%A9">ineffective</a> because the judicial system considers assaults on doctors a regular altercation under the Egyptian Penal Code without regard for the particularity of the profession and the circumstances of the incidents.
Regardless of the penalties, involving doctors in a criminal investigation, whether as plaintiffs or defendants, <a href="https://mdujournal.themdu.com/issue-archive/issue-5/avoiding-the-clinical-becoming-criminal">undermines</a> the public health system and harms their ability to provide patient care. Although the Doctors Syndicate <a href="https://www.ems.org.eg/ar/news/2/2915">advocates</a> stiffer penalties for assaults on health facilities and staff in public and private hospitals, the crux of the problem is that all disputes between patient and doctor are <a href="https://www.hegazylaw.com/in-depth-tortious-error-and-the-draft-medical-liability-law-in-egypt/#:~:text=Currently%2C%20medical%20professionals%20who%20commit,58%2F1937">subject to</a> criminal investigation by the Penal Code (Law 58/1937 and amendments up to Law 95/2003). Resorting to the criminal proceedings should be limited to the most severe cases of intentional gross negligence.&nbsp;

The overuse of criminal law in all medical disputes, from assaults to malpractice, <a href="https://www.avma.org.uk/policy-campaigns/the-avma-blog/is-criminal-prosecution-of-doctors-harming-patient-safety/">infringes</a> on doctors' rights, sense of security, and ability to care for patients. This crisis emanates from the lack of medical legislation and policies that take into account the working conditions and circumstances in which doctors operate, which can be a catalyst for both incidents of violence and professional errors.
<h3 dir="ltr" style="text-align: justify;">Not a regular altercation! Reasons behind hospital violence&nbsp;</h3>
Some 76.6% of incidents of violence against medical workers <a href="https://www.nature.com/articles/s41598-024-60857-2">occur</a> during <a href="https://www.almasryalyoum.com/news/details/3048462">night shifts</a>. A survey of emergency rooms in Egypt <a href="https://bmchealthservres.biomedcentral.com/articles/10.1186/s12913-022-08867-6#:~:text=The%20incidence%20of%20violence%20in,pandemic%20%5B9%2C%2010%5D.">found</a> that the primary cause of <a href="https://eipr.org/publications/%D9%82%D8%A8%D9%84-%D9%83%D9%88%D8%B1%D9%88%D9%86%D8%A7-%D9%88%D8%A8%D8%B9%D8%AF%D9%87-%D9%85%D8%AD%D9%86%D8%A9-%D8%A7%D9%84%D8%A3%D8%B7%D8%A8%D8%A7%D8%A1-%D8%A7%D9%84%D9%85%D8%B5%D8%B1%D9%8A%D9%8A%D9%86">violence</a> is inadequate medical equipment available to diagnose and treat patients. The <a href="https://bmchealthservres.biomedcentral.com/articles/10.1186/s12913-022-08867-6#:~:text=The%20incidence%20of%20violence%20in,pandemic%20%5B9%2C%2010%5D.">second cause</a> is the <a href="https://journals.ekb.eg/article_314689_8987bd31dcd51ab19087fc6e7d3907da.pdf">overcrowding</a> in emergency departments.

Egypt <a href="https://www.thelancet.com/journals/langlo/article/PIIS2214-109X(24)00310-3/fulltext">faces</a> a shortage of doctors in public hospitals and emergency rooms, mainly due to poor working conditions, which pushes them to resign and emigrate, exacerbating the problem of hospital overcrowding. <a href="https://www.ems.org.eg/ar/news/Committees/2430">According to the Doctors Syndicate</a>, there were 9.2 doctors per 10,000 individuals in 2021&mdash;far below the global average of 23 physicians per 10,000 population.

In addition to harsh <a href="https://journals.ekb.eg/article_314689_8987bd31dcd51ab19087fc6e7d3907da.pdf">working conditions</a> in public hospitals, physicians&rsquo; <a href="https://iris.who.int/rest/bitstreams/1239786/retrieve">low wages</a> &mdash;especially interns or trainees, who are on the <a href="https://daaarb.com/%D9%85%D8%B5%D9%8A%D8%B1%D9%86%D8%A7-%D9%88%D8%A7%D8%AD%D8%AF-%D8%AA%D8%B7%D8%A7%D9%84%D8%A8-%D8%B1%D8%A6%D9%8A%D8%B3-%D8%A7%D9%84%D8%AC%D9%85%D9%87%D9%88%D8%B1%D9%8A%D8%A9-%D8%A8%D8%AA%D8%B7%D8%A8/">frontlines</a> in intake and emergency departments&mdash;are among the most significant causes of the health system crisis. Medical trainees in Egypt make <a href="https://www.ems.org.eg/ar/news/1/2910">EGP2,800</a> a month, while resident doctors' earnings reached <a href="https://www.ems.org.eg/ar/news/1/2910">EGP7,000</a> following last March's minimum wage increase. Amid <a href="https://journals.ekb.eg/article_314689_8987bd31dcd51ab19087fc6e7d3907da.pdf">growing pressure</a> due to poor working conditions and low earnings, more than 4,300 Egyptian doctors <a href="https://asharq.com/reports/84848/%D9%85%D8%B5%D8%B1-%D9%87%D8%AC%D8%B1%D8%A9-%D8%A7%D9%84%D8%A3%D8%B7%D8%A8%D8%A7%D8%A1-%D8%AA%D8%AA%D8%B5%D8%A7%D8%B9%D8%AF-%D9%88%D8%AC%D9%87%D9%88%D8%AF-%D8%AD%D9%83%D9%88%D9%85%D9%8A%D8%A9-%D9%84%D8%B3%D8%AF-%D8%A7%D9%84%D8%B9%D8%AC%D8%B2/">resigned</a> from government hospitals in 2022.
The violence against doctors is part of a bigger problem resulting from the state&rsquo;s retreat from adequate spending on the health system. Article 18 of the Egyptian constitution <a href="https://manshurat.org/node/4256">requires</a> the state to allocate 3% of GDP to health expenditure, but the government has not met this threshold. The health sector's 2023/24 budget share came to about 1.2% of GDP.&nbsp;

<h3 dir="ltr">Improving health work conditions: The example of Cuba</h3>
The Cuban health sector <a href="https://immattersacp.org/archives/2010/09/cuba.htm">stands out</a> for the close relationship between doctors and patients. Each patient <a href="https://pubmed.ncbi.nlm.nih.gov/17707542/">deals with</a> a family doctor for regular care issues. In emergency or unusual cases, primary care doctors refer patients to specialists at health units. This means patients are unlikely to end up at the emergency room except in highly critical cases.
This referral method has <a href="https://www.sciencedirect.com/science/article/abs/pii/S0168851007001480">helped</a> alleviate the pressure on hospitals by developing a first-line emergency system, preserving hospital beds for only those in critical need. The Cuban system also <a href="https://medicc.org/ns/cuba-has-one-of-the-most-efficient-healthcare-systems-in-the-world-great-com/">relies</a> on regular doctors&rsquo; visits and free follow-ups to maintain citizens&rsquo; health and decrease their likelihood of needing costly emergency interventions.

<h3 dir="ltr">Enacting family health care legislation</h3>
Egypt has already <a href="https://www.thelancet.com/journals/langlo/article/PIIS2214-109X(24)00310-3/fulltext">taken</a> initial steps to develop the <a href="https://iris.who.int/rest/bitstreams/1239786/retrieve">family health unit system</a>. Still, the problem is the rapid doctor turnover in public sector <a href="https://aps.aucegypt.edu/en/articles/1317/sustainability-of-health-insurance-and-the-challenges-of-agricultural-greenhouses">health units</a> due to working conditions and meager wages. Therefore, the government must improve earnings and working conditions in the healthcare sector to retain medical professionals. The government should also raise its spending on health care to increase the number of hospitals and family health units and equip them properly.
In addition, the state should accelerate the rollout of its comprehensive <a href="https://aps.aucegypt.edu/en/articles/1317/sustainability-of-health-insurance-and-the-challenges-of-agricultural-greenhouses">health insurance</a> system to all governorates. This system aligns with the family health model and will help to improve the relationship between doctors and patients, facilitate access to quality care, and relieve pressure on emergency rooms.
Finally, the government must <a href="https://bmchealthservres.biomedcentral.com/articles/10.1186/s12913-022-08867-6#:~:text=The%20incidence%20of%20violence%20in,pandemic%20%5B9%2C%2010%5D.">improve</a> doctors&rsquo; work environment and employment conditions by enacting the <a href="https://www.ems.org.eg/ar/news/Committees/2430">medical liability law</a>, which is essential in mitigating disputes and determining their legal liabilities. This special law must consider the unique circumstances of the profession and the special physician-patient relationship.
