<p dir="rtl" style="text-align: justify;">صدق رئيس الجمهورية على قانون عمل جديد ليستبدل القانون رقم 12 لسنة 2003. وقد صنَّف <a href="https://labourrightsindex.org/lri-2024-documents/egypt.pdf">مؤشر حقوق العمال لعام 2024</a> مصرَ كدولةٍ تتيح "فرصًا محدودة <a href="https://labourrightsindex.org/lri-2024-documents/egypt.pdf">للعمل اللائق</a>"، في إشارة إلى غياب فرص العمل الإنتاجي التي توفِّر دخلًا عادلًا وأمانًا وظيفيًّا وحماية اجتماعية. فهل يعالج قانون العمل الجديد هذا القصور ويعزز مفهوم العمل اللائق؟&nbsp;</p>

<h3 dir="rtl"><strong>أجور العمال: غير كافية وإقصائية</strong></h3>
<p dir="rtl" style="text-align: justify;">لم يضمن القانون الجديد زيادات سنوية لتعويض تآكل القيمة الحقيقية للأجور نتيجة التضخم وارتفاع تكاليف المعيشة، حيث <a href="https://www.labour.gov.eg/media/0iedik3q/%D8%A7%D9%84%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%B1%D9%82%D9%85-14-%D9%84%D8%B3%D9%86%D8%A9-2025-%D8%A8%D8%A5%D8%B5%D8%AF%D8%A7%D8%B1-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf">خفض المُشرِّع</a> الحد الأدنى للزيادة السنوية الإلزامية من <a href="https://www.manpower.gov.eg/PDF/WorkLow/law2003.pdf">7% من الأجر الأساسي</a> إلى 3% من الأجر التأميني، وهو الحد المستخدم لأغراض التأمين الاجتماعي، ولا يشمل الحوافز والبدلات والمزايا العينية. وبهذا قد قلّص القانون الجديد الزيادة السنوية، بل وجعلها تُحتَسب على جزء محدود من الدخل الحقيقي للعامل.</p>

<p dir="rtl" style="text-align: justify;">يُقصي القانون أيضًا شريحة واسعة من القوى العاملة عن الاستفادة من الزيادات السنوية، حيث رَبَطَ الزيادات بالأجر التأميني وبالتالي استبعد <a href="https://www.capmas.gov.eg/Pages/Publications.aspx?page_id=5106&amp;Year=16603">نحو 60.5%</a> من العمال غير المسجلين في التأمينات الاجتماعية من أي تحسن فعلي في دخلهم. ويمنح القانون أصحاب العمل حق طلب <a href="https://www.labour.gov.eg/media/0iedik3q/%D8%A7%D9%84%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%B1%D9%82%D9%85-14-%D9%84%D8%B3%D9%86%D8%A9-2025-%D8%A8%D8%A5%D8%B5%D8%AF%D8%A7%D8%B1-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf">إعفاءات</a> تمكِّنهم من تعليق الزيادة السنوية نتيجة "لظروف اقتصادية يتعذَّر معها صرف العلاوة"، دون أن يحدد معايير واضحة للأهلية أو ضوابط للتحقق من صحة الادعاء، ما يفتح الباب أمام إساءة استخدام هذه الإعفاءات ويُفرغ هذه الضمانات من مضمونها.</p>

<h3 dir="rtl"><strong>العقود محددة المدة: مرونة قانونية أم هشاشة وظيفية؟</strong></h3>
<p dir="rtl" style="text-align: justify;">يفشل <a href="https://www.labour.gov.eg/media/0iedik3q/%D8%A7%D9%84%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%B1%D9%82%D9%85-14-%D9%84%D8%B3%D9%86%D8%A9-2025-%D8%A8%D8%A5%D8%B5%D8%AF%D8%A7%D8%B1-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf">القانون الجديد</a> في تنظيم عقود العمل محددة المدة، ما يؤدي إلى تآكل الأمان الوظيفي. <a href="https://www.ctuws.com/file/4918/download?token=dMyPZk-r">منح</a> القانون <a href="https://www.ctuws.com/file/4918/download?token=dMyPZk-r">أصحاب العمل</a> حرية استخدام العقود محددة المدة في جميع أنواع الوظائف، بما فيها الوظائف المستقرة وغير المؤقتة. كما يُمَكِّن أصحاب العمل من الامتناع عن تجديد العقد دون تقديم مبرر أو التعرض لأي مساءلة قانونية، إلا في حال تجاوز العامل خمس سنوات من الخدمة، ما يُلزِم صاحب العمل بدفع تعويضًا قدره أجر شهر عن كل سنة عمل. <a href="https://aps.aucegypt.edu/en/events/154/aps-hosts-a-public-event-on-egypts-new-labor-law">يُحذر الخبراء</a> من أن هذه البنية القانونية تتيح الفصل التعسفي دون تعويض كافٍ، تحت غطاء "انتهاء مدة العقد".</p>

The <a href="https://labourrightsindex.org/lri-2024-documents/egypt.pdf">2024 Labour Rights Index</a> classifies Egypt as offering only &ldquo;limited access to <a href="https://www.ilo.org/topics/decent-work">decent work</a>,&rdquo; meaning that productive employment opportunities providing fair income, workplace security, and social protection are lacking. Does the new labor law address these shortcomings and promote decent work?</p>

<h3 dir="ltr"><strong>Workers&rsquo; wages: Insufficient, exclusionary support</strong></h3>
<p style="text-align: justify;">The new labor law fails to guarantee annual raises that cushion workers&rsquo; wages against sustained inflation and rising living costs. The <a href="https://www.labour.gov.eg/media/0iedik3q/%D8%A7%D9%84%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%B1%D9%82%D9%85-14-%D9%84%D8%B3%D9%86%D8%A9-2025-%D8%A8%D8%A5%D8%B5%D8%AF%D8%A7%D8%B1-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf">law</a> lowers mandatory annual raises from a minimum <a href="https://www.manpower.gov.eg/PDF/WorkLow/law2003.pdf">7% increase of the basic wage</a> to at least 3% of the insurance wage, or the salary reported for social insurance purposes, which excludes bonuses, commissions, and in-kind benefits. This means workers now receive smaller guaranteed annual raises, calculated on a narrower slice of their actual earnings.</p>

<p dir="ltr" style="text-align: justify;">Egypt&rsquo;s labor law also fails to guarantee wage increases for a majority of workers. The law excludes <a href="https://www.capmas.gov.eg/Pages/Publications.aspx?page_id=5106&amp;Year=16603">60.5% of workers</a> because it ties salary increases to the insurance wage, thereby denying raises to those not covered by social security. Employers can also request <a href="https://www.labour.gov.eg/media/0iedik3q/%D8%A7%D9%84%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%B1%D9%82%D9%85-14-%D9%84%D8%B3%D9%86%D8%A9-2025-%D8%A8%D8%A5%D8%B5%D8%AF%D8%A7%D8%B1-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf">waivers</a> allowing them to suspend wage increases during periods of &ldquo;economic difficulty,&rdquo; even though the law does not specify eligibility criteria or verification standards.&nbsp;</p>

<h3 dir="ltr"><strong>Fixed-term contracts: Legal flexibility or worker exploitation?</strong></h3>
<p dir="ltr" style="text-align: justify;">The <a href="https://www.labour.gov.eg/media/0iedik3q/%D8%A7%D9%84%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%B1%D9%82%D9%85-14-%D9%84%D8%B3%D9%86%D8%A9-2025-%D8%A8%D8%A5%D8%B5%D8%AF%D8%A7%D8%B1-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%B9%D9%85%D9%84.pdf">new law</a> also fails to regulate fixed-term employment contracts, eroding job security. The law <a href="https://www.ctuws.com/file/4918/download?token=dMyPZk-r">allows employers</a> to use these types of contracts at will, and even for work that is not short-term or temporary. Employers may further refrain from renewing the contract without justification or consequence, unless the worker has completed five years on the job, which triggers one month of severance pay for each year. <a href="https://aps.aucegypt.edu/en/events/154/aps-hosts-a-public-event-on-egypts-new-labor-law">Experts warn</a> that this structure permits arbitrary dismissal without adequate compensation under the guise of contract expiration.&nbsp;</p>

<h3 dir="ltr" style="text-align: left;"><strong>Who is left out?</strong></h3>
<p dir="ltr" style="text-align: justify;">The labor law does little for irregular workers and does not address challenges around registration and inclusion in social protection. The law does not impose enforceable obligations on private contractors or employers to disclose employment data relating to irregular workers or provide <a href="https://aps.aucegypt.edu/en/articles/993/irregular-employment-in-egypt-multiple-initiatives-meager-results">proper incentives</a> for workers to enroll in social insurance programs. Additionally, the new law explicitly excludes domestic workers from its scope, classifying their labor as <a href="https://alahalygate.com/archives/257139#:~:text=%D9%88%D8%A7%D9%84%D9%85%D9%84%D8%A7%D8%AD%D8%B8%D8%A9%20%D8%A7%D9%84%D8%B1%D8%A7%D8%A8%D8%B9%D8%A9%20%D8%AA%D8%B6%D9%85%D9%86%D8%AA,%D8%A7%D9%84%D8%AF%D9%88%D9%84%D9%8A%D8%A9%D8%8C%20%D9%88%D9%83%D8%B0%D9%84%D9%83%20%D8%A7%D9%84%D8%AF%D8%B3%D8%AA%D9%88%D8%B1.">personal service</a> beyond regulatory reach. <h3 dir="ltr"><strong>Toward real labor protections and decent work</strong></h3>
<p dir="ltr" style="text-align: justify;">Advancing real labor protections and realizing decent work in Egypt requires closing enforcement gaps and expanding legal coverage to all workers. This in turn entails an inclusive consultation process in which workers&rsquo; representatives take part in parliamentary hearings and voice their concerns. Unfortunately, this process was <a href="https://aps.aucegypt.edu/en/events/154/aps-hosts-a-public-event-on-egypts-new-labor-law">truncated</a> in the run-up to the adoption of this law. Moving forward, policymakers should enact binding requirements on employers to better integrate informal workers into social insurance mechanisms. They must also define and restrict fixed-term contract criteria to safeguard long-term employment continuity. Regulators should enhance labor inspection protocols to enforce mandated wage adjustments while tying annual raises to inflation indices.</p>
