نظم مشروع حلول للسياسات البديلة بالجامعة الأمريكية بالقاهرة، ندوة بعنوان "قانون العمل الجديد: ضمان لحقوق العمل أم امتياز لأصحاب الأعمال"، وذلك بمشاركة المهندس إيهاب منصور، عضو مجلس النواب ووكيل لجنة القوى العاملة بالمجلس، والدكتورة أمل عبد الحميد مديرة برنامج المرأة بمنظمة دار الخدمات النقابية والعمالية. أدار اللقاء الأستاذ محمد بصل، مدير تحرير جريدة الشروق.

وناقش المشاركون في اللقاء مدى تحقيق قانون العمل الجديد للتوازن المطلوب بين حقوق العمال ومصالح أصحاب الأعمال، حيث يتجدد الجدل حول طبيعة العلاقة بين طرفي العملية الإنتاجية، وحدود الحماية التي يوفرها القانون لكل طرف، خاصةً في ظل التغيرات الاقتصادية والاجتماعية التي يشهدها سوق العمل المصري.
ومن جانبها قالت الدكتورة أمل عبد الحميد، مديرة برنامج المرأة بمنظمة الخدمات النقابية والعمالية، خلال كلمتها باللقاء أن المنظمة قدمت اقتراحات بشأن قانون العمل الجديد قبل إقراره منها ما تم الاستجابة له ومنها ما لم تستجب له الحكومة.

وأوضحت عبد الحميد، أن القانون الجديد كان يجب أن يشهد حوار مجتمعي قبل إقراره لكن ذلك لم يحدث فعليًا إذ سبق أن طالبنا بلجان استماع داخل البرلمان يشارك بها العمال وأصحاب المصالح الحقيقيين ولم يتم الاستجابة لذلك.
وشددت عبد الحميد، على أن قانون العمل الجديد كان يجب أن ينص على الحد الأدنى للأجور مع ربطه بزيادة معدلات التضخم، مشيرة إلى أن المنظمة قد اقترحت أن تكون العلاوة الدورية 7% من الأجر التأميني، لكن الحكومة خفضتها إلى 3% من الأجر التأميني، لافتة إلى أن القانون الجديد تسيطر عليه فلسفة القانون القديم.
وانتقدت عبد الحميد، استثناء العاملين بالمنازل من قانون العمل الجديد مطالبة بعدم استثنائهم من الحماية القانونية، معتبرة ذلك تمييز صارخ ضدهم.

وأوضحت عبد الحميد، أن القانون الجديد وضع قيودًا تعجيزية على حق الإضراب من خلال الاشتراط بتقديم مستند رسمي مسجل في الشهر العقاري لتفويض المفوض العمالي، لافتة إلى أن أبرز مزايا القانون أنه ألغى استمارة 6 التي تنهي علاقة العمل بين طرفي العملية الإنتاجية العامل وصاحب العمل. كما ألغى القانون الجديد التمييز بين العاملين في القطاع العام والقطاع الخاص فيما يتعلق بإجازة الوضع للمرأة.
وطالبت عبد الحميد، في ختام كلمتها بحوار مجتمعي يشارك فيه جميع المخاطبين بالقانون لمناقشة ومتابعة اللائحة التنفيذية لقانون العمل الجديد التي لم تصدر بعد، مشددة على ضرورة مناقشة مشروع قانون العمالة المنزلية مع تعديل المواد الخاصة بعقد العمل المؤقت بين العامل وصاحب العمل، فضلا عن تعديل المواد المتعلقة بالفصل التعسفي، وحق الإضراب والمفوض العمالي.&nbsp;&nbsp;
بينما قال المهندس إيهاب منصور، عضو مجلس النواب، ووكيل لجنة القوى العاملة بالمجلس، إنه طرح تعديل نحو 50 مادة تم قبولها مشيرًا إلى أنه رغم ذلك فالقانون الجديد لم يلبي طموحاته، وإن كان هناك نقاط إيجابية في القانون.

وطالب منصور، بضرورة دعم الأجهزة المختصة مثل الجهاز المركزي للتعبئة والإحصاء لحصر العمالة غير المنتظمة لافتًا إلى أنه طالب بضم هذه العمالة لقانون العمل الجديد لكن تم رفض هذا الطلب.
ولفت وكيل لجنة القوى العاملة بمجلس النواب، إلى أن القانون الجديد تضمن تعريفات جديدة مثل التنمر في العمل والتحرش داخل بيئة العمل وهو أمر جيد.
وأشار منصور، إلى المادة 167، والتي اعتبرها من مكتسبات القانون الجديد، وهي المتعلقة بالاستقالة والتي تشترط الاعتماد من الجهة الإدارية حتى تكون مقبولة، لكنه شدد على أنه كان يجب أن يضاف لهذه المادة أن "تعتمد الاستقالة من الجهة المختصة بمعرفة العامل"، وألا تترك هكذا.
وأوضح منصور، أن عقد العمل بالقانون الجديد، والمتعلق بتحديد مدة العقد لا يحقق الأمان الوظيفي للعامل. كما أن المادة المتعلقة بحق الإضراب عن العمل في القانون الجديد لا يمكن أن تتحقق عمليا ووضع عليها قيود رغم أن المادة 15 من الدستور تعطي حق الإضراب السلمي.
على الجانب الآخر قال المستشار إيهاب عبد العاطي، المستشار القانوني لوزير العمل، إن القانون الجديد يحقق التوازن بين مصلحة صاحب العمل والعامل، وهناك قناعة لدى الحكومة بأن هذا القانون جيد لطرفي العملية الإنتاجية العامل وصاحب العمل في آن واحد، وأن هذا القانون تمت الموافقة عليه تزامنًا مع عيد العمال ليكون هدية لهم، وأن هناك حوار مجتمعي دار بالفعل حول القانون قبل إقراره مع الاتحاد العام للنقابات العمالية، وعدد من النقابات واللجان النقابية مشيرًا إلى أن مرحلة ما بعد القانون، وهى مرحلة القرارات التنفيذية واللائحة التنفيذية ستتطلب حوار مجتمعي يشارك فيه جميع الأطراف والنقابات العمالية.

وأضاف عبد العاطي، أن القانون الجديد له مزايا ومكتسبات لأصحاب العمل، كما يضمن حقوق العمال، مشيرًا إلى أن سببب صدور قانون جديد للعمل هو وجود نحو 242 طعن بعدم الدستورية لقانون العمل القديم.

وأشار المستشار القانوني لوزير العمل، إلى أن هناك حوالي 40 مادة في القانون الجديد لم يتم المساس بها حيث تعد من الثوابت، ولم يتم الاقتراب منها بالتعديل لتوافقها مع أحكام محكمة النقض والقوانين الدولية، منوهًا بأن قانون العمل القديم كان به قيود حيث كان ينص على أن مخالفة قواعد الإضراب يترتب عليه فصل العامل، وهذا غير موجود في القانون الجديد.

The Alternative Policy Solutions Project at The American University in Cairo organized a public event titled &ldquo;The New Labor Law: Safeguarding Workers&rsquo; Rights or Empowering Employers?&rdquo; The event featured Engineer Ehab Mansour, Member of Parliament and Deputy Chairman of the Manpower Committee; Dr. Amal Abdel Hamid, &nbsp;Director of the Women's Program at the Center for Trade Union and Workers' Services; and was moderated by Mohamed Basal, Managing Editor of Al-Shorouk newspaper.

The event explored whether Egypt&rsquo;s newly issued labor law effectively balances the protection of workers&rsquo; rights with the interests of employers. It reignited public debate about the evolving dynamic between the two parties, especially in light of current economic and social changes affecting the Egyptian labor market.
Dr. Amal Abdel Hamid noted that while her organization had submitted recommendations during the drafting stage, many of them were either only partially addressed or ignored entirely. She criticized the lack of inclusive community dialogue prior to the law&rsquo;s passage, highlighting that their repeated requests for parliamentary hearings with worker representation went unanswered.

She also expressed disappointment that the law does not establish a minimum wage or link bonuses to inflation. Her organization had proposed a 7% annual bonus based on the insurance wage, which was reduced by the government to 3%. Abdel Hamid asserted that, despite its updated structure, the new legislation retains the same underlying philosophy as the previous law.
Among her other concerns was the law&rsquo;s provision allowing employers to renew fixed-term contracts indefinitely, a shift from the previous practice where such contracts were deemed permanent after five years. She also criticized the exclusion of domestic workers from legal protections, calling this a clear act of discrimination. Abdel Hamid raised additional objections to the restrictions placed on the right to strike and on labor commissioners, the latter now requiring official documentation from the real estate registry to perform their duties. Nonetheless, she welcomed the abolition of Form 6, which had previously allowed employers to unilaterally terminate employment relationships, and noted that unifying maternity leave benefits for women in both the public and private sectors is a positive step.
In concluding her remarks, Abdel Hamid called for a broad community dialogue on the law&rsquo;s forthcoming executive regulations. She urged the inclusion of all stakeholders in discussions about the implementation process and also advocated for the revision of articles concerning temporary contracts, unjust dismissals, the right to strike, and labor commissioners. She emphasized the importance of drafting legislation to protect domestic workers and ensuring a participatory approach moving forward.

Engineer Ehab Mansour shared that he had proposed amendments to approximately 50 articles during the drafting process, many of which were accepted. Despite this, he stated that the final law still does not meet his aspirations, although he acknowledged that it contains some progressive elements. He underscored the importance of engaging institutions such as the Central Agency for Public Mobilization and Statistics in identifying and integrating irregular workers into the labor system, a recommendation that was ultimately not adopted.

Mansour praised the introduction of legal definitions for workplace bullying and harassment, which he described as welcome additions. He also highlighted Article 167, which requires administrative approval for employee resignations. However, he argued that the article should specify that resignations must be approved with the knowledge and consent of the worker, in order to prevent potential exploitation by employers. He also criticized the structure of the employment contracts outlined in the new law, arguing that they fail to guarantee job security. Furthermore, while the constitution guarantees the right to strike, he pointed out that the law imposes practical limitations that render the exercise of this right nearly impossible.
From the government&rsquo;s perspective, Counselor Ihab Abdel Aaty, Legal Advisor to the Minister of Labor, defended the law as a balanced framework that serves the interests of both workers and employers. He stated that the government considers the law a fair and timely development, one that was deliberately announced on Labor Day as a symbolic gift to the workforce. Abdel Aaty affirmed that consultations did take place prior to the law&rsquo;s enactment, particularly with the General Federation of Trade Unions and several labor committees, though he acknowledged that additional dialogue would be essential during the implementation phase, especially concerning executive regulations.

He emphasized that the law provides new advantages for employers while also protecting workers&rsquo; rights. One of the motivations for issuing a new law, he explained, was the large number of constitutional appeals&mdash;around 242&mdash;filed against the previous labor law. Abdel Aati added that approximately 40 articles in the new legislation were retained from the old law due to their consistency with rulings from the Court of Cassation and international labor standards. He noted that a controversial provision in the old law, which allowed dismissal for violating strike rules, had been removed in the new version.
