في 13 أكتوبر،<a href="https://shorturl.at/WFM9k"> تم تخفيف الحكم</a> الصادر بالإعدام على زوج مصري قتل زوجته، إلى السجن سبع سنوات فقط. ولا تُعد هذه الحالة الأولى من نوعها: فقد سمحت الثغرات القانونية بصدور <a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=3506&amp;context=etds">أحكام مخففة</a> في قضايا مشابهة في الماضي أيضًا. بالإضافة إلى سنّ قانون يُجرّم العنف الأسري، ما هي الإجراءات التي ينبغي أن تقوم بها الحكومة للتصدي لعنف الأزواج ووضع حدّ له؟

<h3 dir="rtl">لا يزال العنف الأسري سائدًا خلف الأبواب المغلقة</h3>
تكشف الإحصاءات الوطنية عن مؤشرات مُقلقة فيما يتعلق بمعدلات العنف الأسري. فوفقًا لأحدث الأرقام المنشورة (2021)، لا تُبلغ معظم الناجيات عن تعرضهنّ للعنف؛ وعلى الرغم من أن حوالي ثلث الناجيات طلبن المساعدة، فلم تتجاوز نسبة من أبلغن الشرطة 1.6% فقط، بينما التزم الصمت أكثر من نصفهن (64%) بسبب الخوف والوصم الاجتماعي وانعدام الثقة بالنظام. كما أصبح العنف الأسري أمرًا مقبولًا اجتماعيًّا إلى درجة أن ما يقرب من ربع النساء المصريات <a href="https://censusinfo.capmas.gov.eg/metadata-ar-v4.2/index.php/catalog/1843">(22%)</a> يعتقدن أن ضرب الزوج زوجتَه له ما يبرره في ظروفٍ مُعيَّنة. وبالإضافة إلى ذلك، تتعرض <a href="https://censusinfo.capmas.gov.eg/metadata-ar-v4.2/index.php/catalog/1843">النساء الأصغر سنًّا</a> (20-29 عامًا) والأقل تعليمًا والأكثر فقرًا للعنف الأسري <a href="https://link.springer.com/article/10.1007/s11199-010-9793-3">بمعدلات</a> أكثر من غيرهن.

<h3 dir="rtl">حين يخفق القانون في حماية الناجيات</h3>
يُقدِّم الإطار <a href="https://aps.aucegypt.edu/ar/articles/120/criminalizing-gender-based-domestic-violence-in-egypt">القانوني المصري&nbsp;</a> حماية محدودة للناجيات&nbsp;من العنف الأسري. إذ لا يعترف قانون العقوبات بالعنف الأسري بوصفه جريمة قائمة بذاتها. والأسوأ من ذلك أنّ بعض&nbsp;<a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=3506&amp;context=etds">مواد قانون العقوبات</a> - مثل المادة (17)، التي تُجيز للقضاة تخفيف الحكم "بدافع الرأفة"، أو المادة (60)، التي تُبرر الأفعال المُرتكبة "بحسن نية"- غالبًا ما تُستَخدم لتبرير التساهل فيما يُسمى بـ"جرائم الشرف" أو "النزاعات الأسرية". ففي قانون الأسرة، تُجبر <a href="https://academic.oup.com/cairo-scholarship-online/book/18266/chapter-abstract/176241624?redirectedFrom=fulltext">&nbsp;أحكام الطاعة والنفقة</a> عديدًا من النساء على البقاء في زيجات يتعرضن فيها للعنف حفاظًا على حقوقهنّ المالية، بينما تجعل قوانين الطلاق والحضانة الانفصال عن الزوج المسيء <a href="https://www.hrw.org/reports/2004/egypt1204/egypt1204ar.pdf">أمرًا بالغ الصعوبة</a>. ولا يوجد حتى الآن قانون شامل يُعرّف العنف الأسري أو يتصدى له، ولا يوجد نصّ واضح لأوامر التقييد والمنع، كما لا توجد وحدات شرطية متخصصة للتعامل مع هذا النوع من الحالات.
<h3 dir="rtl">قضية الإصلاح متعدد الأبعاد</h3>
يُعدّ <a href="https://opendocs.ids.ac.uk/articles/report/What_Makes_Domestic_Violence_Legislation_More_Effective_/26455066">الإصلاح القانوني</a> خطوة أساسية على طريق التغيير، وإن لم يكن كافيًا في حد ذاته. ويجب أن يتضمن أي قانون جديد تعريفًا واضحًا للعنف الأُسري، يشمل العنف الجسدي والنفسي والجنسي والاقتصادي، وأن يُجرّم الاغتصاب الزوجي، ويُغلق الثغرات القانونية التي تُتيح التساهل مع الجناة، ويُقر أوامر التقييد والحماية لضمان السلامة الفورية للناجيات.

<a href="https://opendocs.ids.ac.uk/articles/report/What_Makes_Domestic_Violence_Legislation_More_Effective_/26455066">ويجب أن يشمل</a> الإصلاح القانوني أيضًا آليات تضمن التنفيذ الفعلي. إذ ينبغي على السلطات المصرية&nbsp;<a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=3506&amp;context=etds">تأسيس</a> وحدات شرطة ونيابات ومحاكم متخصصة وخاضعة للمساءلة ومُدربة خصيصًا للتعامل مع حالات العنف الأسري بحساسية وكفاءة. كما يجب أن تقدم الدولة خدمات دعم ممولة <a href="https://www.hrw.org/ar/report/2004/11/30/255542">دون أي تمييز</a>، تشمل المأوى والرعاية الصحية والمساعدة القانونية لحماية الناجيات. ويُفترض كذلك أن تضمن الحكومة الإعلان الكافي عن <a href="https://fount.aucegypt.edu/faculty_journal_articles/502/">مراكز الإيواء</a> وتوفر التمويل اللازم لها، مع تعيين كوادر مؤهلة لإدارة برامج <a href="https://egypt.unwomen.org/en/news-and-events/stories/2021/12/shelter-story#:~:text=As%20one%20of%20the%20services,cope%20with%20the%20trauma%20and">إعادة الإدماج</a> بالتعاون مع <a href="https://diamondopen.com/journals/index.php/jarws/article/view/413/190">المنظمات غير الحكومية</a> ومنظمات المجتمع المدني.

On October 13, an Egyptian man who murdered his wife had <a href="https://www.youm7.com/story/2025/10/13/%D8%AA%D8%AE%D9%81%D9%8A%D9%81-%D8%A7%D9%84%D8%AD%D9%83%D9%85-%D8%B9%D9%84%D9%89-%D8%A7%D9%84%D9%85%D8%AA%D9%87%D9%85-%D8%A8%D9%82%D8%AA%D9%84-%D8%B2%D9%88%D8%AC%D8%AA%D9%87-%D8%A8%D8%B3%D8%A8%D8%A8-%D8%B7%D8%A8%D9%82-%D9%85%D9%83%D8%B1%D9%88%D9%86%D8%A9-%D9%85%D9%86/7155635">his sentence reduced</a> from the death penalty to just seven years in prison. This case is not the first of its kind: legal loopholes have allowed for this kind of <a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=3506&amp;context=etds">leniency</a> in the past as well. In addition to enacting a law that criminalizes domestic violence, what else should the government do to address and put an end to intimate partner violence?

<h3 dir="ltr">Violence behind closed doors remains pervasive</h3>
National statistics reveal disturbing trends in domestic violence. Most survivors never report their abuse; according to the most recent published numbers (2021), even though around one-third of survivors sought help, only 1.6% of them reported the incident to the police, and more than half (64%) never told anyone and remained silent due to fear, social stigma, and lack of trust in the system. Violence within the home is so normalized that almost one-quarter (<a href="https://censusinfo.capmas.gov.eg/metadata-en-v4.2/index.php/catalog/665">22%)</a> of Egyptian women believe a husband is justified in hitting his wife under certain circumstances.

<h3 dir="ltr">Where the law fails survivors</h3>
Egypt&rsquo;s <a href="https://aps.aucegypt.edu/en/articles/120/criminalizing-gender-based-domestic-violence-in-egypt">legal framework</a> offers minimal protection for survivors. The penal code does not recognize domestic violence as a distinct offense. Worse still, provisions in&nbsp;<a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=3506&amp;context=etds">the penal code</a>&mdash;such as Article 17, which allows judges to reduce sentences &ldquo;out of compassion,&rdquo; or Article 60, which excuses acts committed in &ldquo;good faith&rdquo;&mdash;are frequently invoked to justify leniency in so-called honor or domestic crimes. In family law, provisions on&nbsp;<a href="https://academic.oup.com/cairo-scholarship-online/book/18266/chapter-abstract/176241624?redirectedFrom=fulltext">obedience and maintenance</a> force women to remain in abusive marriages to retain their financial rights, while divorce and custody rules make leaving abusive relationships <a href="https://books.google.com.eg/books?id=opgFl0RI64EC&amp;printsec=frontcover#v=onepage&amp;q&amp;f=false">extremely difficult.</a> There is no comprehensive law defining or addressing violence within the family, no clear provision for restraining orders, and no specialized police units to handle such cases.&nbsp;
<h3 dir="ltr">The case for multidimensional reform</h3>
Legal reform is <a href="https://opendocs.ids.ac.uk/articles/report/What_Makes_Domestic_Violence_Legislation_More_Effective_/26455066">an important stepping stone</a>, even if not sufficient on its own. A new law should define domestic violence, including physical, psychological, sexual, and economic abuse, criminalize marital rape, and eliminate loopholes that allow leniency for perpetrators, as well as introduce restraining and protection orders to give survivors immediate safety.&nbsp;

Legal reform <a href="https://opendocs.ids.ac.uk/articles/report/What_Makes_Domestic_Violence_Legislation_More_Effective_/26455066">must also include</a> measures to ensure enforcement. Egypt <a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=3506&amp;context=etds">should establish</a> specialized and accountable police units, prosecutors, and courts trained to handle domestic violence cases with sensitivity and efficiency. It should also provide state-funded support services without <a href="https://www.hrw.org/reports/2004/egypt1204/6.htm#:~:text=In%20order%20to%20be%20eligible,be%20experiencing%20some%20familial%20difficulties.">discrimination</a>&mdash;including shelters, medical care, and legal aid&mdash;to protect survivors. The government should also ensure that <a href="https://fount.aucegypt.edu/cgi/viewcontent.cgi?article=1502&amp;context=faculty_journal_articles">shelters</a> are adequately advertised and funded, with trained staff that also run <a href="https://egypt.unwomen.org/en/news-and-events/stories/2021/12/shelter-story#:~:text=As%20one%20of%20the%20services,cope%20with%20the%20trauma%20and">reintegration programs</a> in collaboration with <a href="https://diamondopen.com/journals/index.php/jarws/article/view/413/190">NGOs and civil society</a>.&nbsp;

The obstacle to greater protection, however, is <a href="https://www.jstor.org/stable/10.1525/nclr.2001.4.2.801?casa_token=IpsNl57tt74AAAAA%3AEryEl2xOaKagz9BwM2YoSUzCTttpw05DQi0BFotH5a7NcQTlkthbrTWJBUu0wV2_LkASAZvsHa8grgwQ0keBKjuYAHxt_bOPv1jHrwh3lbGL7lRPyA&amp;seq=1">not purely legal.</a> Government policies must also prioritize prevention measures, such as expanding women&rsquo;s access to education, employment, and social protection, which <a href="https://journals.sagepub.com/doi/epub/10.1177/0886260519888196">reduces</a> their economic dependence on marriage and vulnerability to violence. The government must also prioritize <a href="https://pmc.ncbi.nlm.nih.gov/articles/PMC10588291/">community-based </a>mobilization and <a href="https://psycnet.apa.org/record/2018-06804-001">interventions</a>, particularly those that <a href="https://www.svri.org/sites/default/files/attachments/2016-03-21/menandboys.pdf">work with and target men</a>, and <a href="https://www.tandfonline.com/doi/full/10.1080/13552070601179144">engage</a> religious and community leaders to <a href="https://pmc.ncbi.nlm.nih.gov/articles/PMC6647388/">challenge norms</a> that justify abuse. Finally, ending practices such as female genital mutilation and the corporal punishment of girls <a href="https://link.springer.com/article/10.1007/s11199-010-9793-3">is essential to counter</a> the normalization of control over women and to break intergenerational cycles of abuse.&nbsp;
<h3 dir="ltr">Conclusion&nbsp;</h3>
Domestic violence in Egypt remains widespread, fueled by legal gaps, patriarchal norms, and weak enforcement. To put an end to it, the government should adopt a multidimensional policy combining clear legal reforms with effective implementation measures, as well as community-based efforts to change perceptions and the acceptance of domestic abuse. Based on other countries&rsquo; experiences, these measures can help protect survivors, hold perpetrators accountable, and begin to challenge the social acceptance of domestic violence.
