تعتبر العمالة غير المنتظمة من أكثر القطاعات الاقتصادية التي تأثرت سلبًا بفيروس كورونا المستجد (كوفيد-19)، وتعددت الآثار السلبية ما بين تخفيض العمالة وعدم توافر الموارد المالية من أجل شراء المنتجات، وصولًا إلى فقد فرص العمل، ويرجع ذلك إلى هشاشة هذا قطاع العمالة غير الرسمية. كما كشفت أزمة كورونا عن غياب قاعدة البيانات عن هذا القطاع؛ فعندما قدمت الحكومة منحة للعمالة غير المنتظمة بلغت 500 جنيه مصري، كإجراء وقائي لمواجهة الآثار الاقتصادية للوباء، نشرت وزارة القوى العاملة&nbsp; استمارة إلكترونية وخصصت رقم على تطبيق واتساب لوضع قاعدة بيانات حول العمالة غير المنتظمة. وتلقى هذه المنحة&nbsp; مليون و600 ألف و216 عامل وعاملة، 60% منهم من الرجال و40% من النساء.&nbsp; ورغم صغر المبلغ&nbsp; الذي تم منحه للعمال على ثلاث دفعات بإجمالي 1500 جنيه إلا أنه مثل دعمًا مهمًا&nbsp; للعاملات والعاملين بهذا القطاع لأن أغلبهم ليس لديهم مدخرات أو موارد مالية يمكن الاعتماد عليها وقت الأزمات، حيث يعمل أغلبهم باليومية أو كعمالة موسمية. ولم تستطع&nbsp; الكثير من النساء الأكثر احتياجًا الاستفادة من هذا الدعم بسبب عمل كثير من النساء في الريف&nbsp; داخل المنزل في مجالات الخياطة أو صناعة المأكولات أو بيع الملابس والمشغولات اليدوية بالتقسيط، ومنهن أميات بلا قدرة على استخدام شبكات الإنترنت وتطبيقات الهواتف الذكية. كما أنهن لا تستطعن التحرك أو اتخاذ قرار إلا بعد استئذان "رجل البيت"، الذي قد يكون الزوج أو الأب وأحيانا الأخ.
لن تتحقق الاستدامة في منظومة الحماية الاجتماعية للقطاع غير المنتظم دون تبني الحكومة لسياسات تستهدف الاستدامة في فرص العمل وتوفر مصدر دخل يلبي احتياجات الأساسية للأسر المعيشية، وهذا يتطلب تخطيط على المستوى الوطني للمنتجات ومجالات النشاط لهذا القطاع ودراسات تسويقية، ويتطلب كذلك تقنين أوضاع هؤلاء العاملين بشكل يوازن بين الحقوق والواجبات.&nbsp;
<h3 dir="rtl">&nbsp;خصائص العمالة غير المنتظمة:&nbsp;</h3>
رغم ارتفاع نسبة مساهمة القطاع غير المنتظم&nbsp; في الناتج المحلي الإجمالي ما بين 30 ٪ و40%، إلا أنه لا تتوفر بيانات دقيقة عن هذا القطاع. فآخر إحصائيات&nbsp; متاحة عن هذا القطاع صدرت عن الجهاز المركزي للتعبئة العامة والإحصاء عام2017 وتشير إلى نسب توزيع الرجال والنساء في هذا القطاع على النحو التالي (CAPMAS, 2017):&nbsp;

<li style="font-weight: 400; text-align: justify;">&nbsp;نسبة المشتغلين بالقطاع غير المنتظم:&nbsp;44.7% من النساء و47.3% من الرجال.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">&nbsp;العاملون&nbsp; بدون أجر لدى الأسرة:&nbsp;84.2% من النساء و 9.9% من الرجال.&nbsp;&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">صاحب عمل ويقوم بتوظيف آخرين: 2.2% من النساء و 19.6% من الرجال.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">العاملون لحسابهم الخاص ولا يقومون بتوظيف أحد:&nbsp;8.9% من النساء و22.8% من الرجال.&nbsp;</li>
</ul>
يتبين من الإحصائيات السابقة ارتفاع نسبة النساء اللاتي يعملن بدون أجر، لتصل نسبتهن إلى 84.2% (CAPMAS, 2017). وتعتبر الكثير من النساء أن ما يقومون به من عمل يندرج تحت المهام المنزلية، فمنهن من تساعدن أزواجهن أو آبائهن في جمع المحصول أو إنتاج المواد الغذائية في المنزل وبيعها في السوق، وغيرهن ممن يعملن من داخل المنزل في الخياطة أو المشغولات اليدوية أو المنظفات أو عاملات المنازل، في حين أنهن&nbsp; تقمن بجهد مضاعف يتمثل في العمل المنزلي غير مدفوع الأجر والعمل المنتِج للسوق، الذي يدر دخل أو عائد مادي تستفيد منه الأسرة.
لا يزال هذا القطاع شديد الهشاشة، تنتقل فيه العمالة&nbsp; من مجال نشاط إلى آخر بسبب عدم توافر مقومات استمرار المشروع الناجح، وذلك يرجع إلى عدة أسباب منها ضعف رأس المال وعدم التدريب الجيد على جودة المنتج وغياب استراتيجيات التسويق. فلا تزال عمليات التسويق للمشروعات تتم من خلال مبادرات أصحاب المشروعات أو تنظيم جهات حكومية للمعارض الموسمية، كما تتشابه مجالات الأنشطة، وتحديدًا التي تقوم بها النساء، لتنحصر في المهن التقليدية، وهى نفس الأدوار التي تقوم بها النساء داخل المنزل ومنها الخياطة وبيع الخضراوات والبقالة والمنظفات والملابس وتربية الطيور والماشية. هذا يكرس الأنماط التقليدية لأدوار الأنواع الاجتماعية ويحصر النساء في مجالات عمل ضيقة. وكذلك تزداد المنافسة بسبب تشابه الأنشطة، مما يؤثر سلبًا على استدامة المشروع أو تحقيق عائد مناسب يحسن من مستوى المعيشة.&nbsp;
وتتعرض النساء للعنف في مجال عمال. وتظل العمالة المنزلية الأكثر تعرضًا لجرائم العنف النفسي والبدني والجنسي، بدايةً من تكتمهن على طبيعة عملهن خوفًا من الوصم الاجتماعي، مرورا بتعرضهن للإهانة والاعتداء البدني والجنسي أثناء قيامهن بأعمالهن.
وهكذا يجب تقنين هذه المهنة وتوفير الحماية القانونية لها واعتبار ما تتعرض له العاملات&nbsp; من إصابات أو أضرار صحية نتيجة لطبيعة عملهن، مثل أمراض العمود الفقري والحروق، من أمراض المهنة ويتم التعامل معها على أنها إصابة عمل .&nbsp;
<h3 dir="rtl">قوانين الحماية الاجتماعية:&nbsp;</h3>
ينص دستور الحالي الصادر عام 2014 على مد مظلة الحماية الاجتماعية إلى العمالة غير المنتظمة وذلك في المواد (8) و(11) و( 17) و(18). وتنفيذًا لأحكام الدستور، صدر قانون التأمين الصحي الشامل رقم 2 لسنة 2018، و قانون التأمينات الاجتماعية رقم 148 لسنة 2019 ، ونص القانونان على أن تمتد الحماية الاجتماعية إلى العمالة غير المنتظمة، على أن تتحمل الخزانة العامة حصة صاحب العمل. ويتطرق قانون التأمينات الاجتماعية إلى التأمين ضد مخاطر الشيخوخة والعجز والوفاة، والتأمين الصحي، على أن يسدد المنتفع ( العامل/ة غير المنتظم ) اشتراك يعادل 9 % من دخله وتتحمل الخزانة العامة 12% لتغطية التأمين د مخاطر الشيخوخة والعجز والوفاة، وأن يسدد المنتفع ( العامل/ة غير المنتظم ) 4% وذلك للتأمين ضد المرض .وبذلك يكون ما يتحمله المنتفع ( العامل/ة غير المنتظم ) هو 9% + 4%=13% ، وما تتحمله الخزانة العامة 12% .
أما بالنسبة لاستفادة العمالة غير المنتظمة من مشروع التأمين الصحي الشامل فالقانون إلزامي وأسري، يستهدف الأسرة كوحدة أساسية وليس الفرد،&nbsp; ويقوم على دمج الأسرة أيا كان وضعها في المجتمع وتسجيلها في وحدات صحة الأسرة حسب مكان الإقامة بالبطاقة الشخصية لرب الأسرة، حيث يتم حصر وتسجيل هذه الأسر و البدء في تصنيفها إلى قادرين على دفع الاشتراكات وغير قادرين وفق معايير استهداف تحددها وزارات التضامن والمالية والقوى العاملة.&nbsp; ومن مؤشرات الإعفاء من الاشتراكات الحد الادنى للأجر، واستهلاك الأسرة من الخدمات مثل الكهرباء والماء، ومؤشرات أخرى تراجع دوريًا لتحديد غير القادرين على دفع&nbsp; الاشتراكات في النظام الجديد.&nbsp; ويضمن القانون تقديم الرعاية الصحية لجميع المواطنين دون تمييز، بمجرد انخراطهم في النظام بالبطاقة الشخصية لرب الأسرة.
&nbsp;&nbsp;لاتزال هذه القوانين في مرحلة التنفيذ ولم يتم تطبيقها بشكل كامل، ولا يزال الطريق للوصول للعمالة غير المنتظمة غير ممهد. فثمة تحديات أمام دمج العمالة غير المنتظمة في منظومة الحماية الاجتماعية.&nbsp;
<h3 dir="rtl">التوصيات:&nbsp;</h3>
&nbsp;يحتاج استدامة منظومة الحماية الاجتماعية للعمالة غير المنتظمة إلى استراتيجية عمل&nbsp; تتعاون فيها الجهات الحكومية المعنية مع المجتمع المدني (منظمات أهلية ونقابات) من أجل:&nbsp;
<ul dir="rtl">
<li style="font-weight: 400; text-align: justify;">&nbsp;توفير قاعدة بيانات تشمل جميع مجالات النشاط في كل المحافظات وتقسم على أساس النوع.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">توعية وتعريف بالقوانين من خلال برامج توعية للجمعيات والمؤسسات الأهلية بهذه القوانين، على أن تقوم الأخيرة بدور التوعية للعمالة غير المنتظمة، حيث تتواجد هذه الجمعيات والمؤسسات في القرى والأحياء ولديها صلات مباشرة مع قطاع واسع من العمالة غير المنتظمة كما يستطيعوا الوصول للنساء في منازلهن بجميع القرى والأحياء بالمحافظات، وبذلك نضمن دمج النساء في منظومة الحماية الاجتماعية.&nbsp;&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">قيام الجمعيات والمؤسسات الأهلية بمراقبة تنفيذ القوانين والتأكد من دمج القطاع غير المنتظم من الرجال والنساء في منظومة الحماية الاجتماعية.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">&nbsp;&nbsp;توجه الاتحاد العام لنقابات عمال مصر للعمالة غير المنتظمة من النساء والرجال،&nbsp; وتحفيزهم على الانخراط في العمل النقابي وتأسيس نقابات، بما يسهم في تنظيم هذا القطاع. و تعزيز قدراته وبناء قيادات نقابية من النساء والرجال تبلور مطالب هذا القطاع وتساهم في طرحها على أجندة العمل النقابي.</li>

As a group, informal workers have been the most adversely affected by the novel coronavirus pandemic due to their precarious circumstances. Some have seen demand for their labor or products decline while others have lost their jobs altogether. The pandemic has also highlighted the paucity of data about informal labor. When the government offered monthly payments of EGP500 to informal workers, the Ministry of Manpower released an electronic form on social media and set up a dedicated WhatsApp number to collect information about these workers. Some 1.6 million workers, 60% of them men and 40% of them women, claimed the benefit. Despite the relatively small sum in assistance&mdash;three payments totaling EGP1,500 (Ministry of Manpower,&nbsp; 2020)&mdash;it provided significant support for these workers, most of whom do not have savings or other reliable financial resources, working largely as day laborers or seasonal workers. Many women in dire need were unable to take advantage of the assistance for various reasons. In rural areas, informal female workers may work out of their homes as seamstresses, making food, selling clothing on layaway plans, or in handiwork. Illiterate women are unable to use the internet and mobile phone applications, and often cannot act or make a decision without consulting &ldquo;the man of the house,&rdquo; be it their husband, father, or brother.&nbsp;
Social protection for the informal sector is not sustainable without specific policies to maintain jobs that can provide an income sufficient to meet families&rsquo; basic needs. This requires planning on the national level for the products and economic activity of this sector, marketing research, and the regularization of their labor status in a way that balances rights and duties.&nbsp;
<h3 dir="ltr">Features of informal labor</h3>
Although the informal sector contributes 30&ndash;40% of GDP (Government of Egypt, 2018), there is a dearth of data about the sector. The most recent statistics issued by the Central Agency for Public Mobilization and Statistics in 2017 show that the gender composition of the informal sector is as follows (CAPMAS, 2017):&nbsp;

As shown by these statistics, a high percentage of women (84.2%) work without wages. Women consider their work to be part of the household tasks. Some help husbands and brothers gather crops or produce food at home and sell it at the market. Others work at home sewing or other handicrafts or as cleaners and domestic workers. They often do double duty, being responsible for unpaid household labor while also producing goods for the market that brings in supplementary income.&nbsp;
The sector remains highly precarious, with workers moving from one activity to another because they lack elements necessary to successfully sustain a business due to meager capital, poor training in quality control, and the lack of marketing public policies. Marketing for businesses continue to be carried out at the initiative of the business owner or at seasonal exhibits organized by government bodies. Labor activity, especially for women, is limited to traditional fields, essentially the same roles filled by women in the household, such as seamstress work, selling products like vegetables, dry goods, cleaners, and clothing, and raising poultry and livestock. In this way, women come to fill fixed roles in the home and at work; with a narrow set of fields in which to work, competition increases, which undermines the sustainability of enterprises and makes it difficult to earn enough profit to improve the standard of living (al-Antari, in press).
Women may also face violence at work; domestic workers in particular are most vulnerable to crimes of physical, psychological, and sexual violence. According to the Shehab Foundation, which works with domestic workers, such workers may not disclose their job in fear of questions about their behavior or being looked down on, and they are vulnerable to insults and physical and sexual assault while on the job. This occupation must therefore be legally formalized and workers given legal protection. Injuries or health problems sustained while on the job, such as spinal problems or burns, must be considered work-related illnesses and treated as labor injuries.&nbsp;
<h3 dir="ltr">Social protection laws</h3>
The 2014 constitution provides for the extension of the social safety net to informal workers in Articles 8, 11, 17, and 18. To fulfill this constitutional obligation, Law 2/2018 on universal health insurance and Law 148/2019 on social insurance were issued. Under both laws, the treasury assumes the share normally paid by employers for informal workers. Under the social insurance law, the beneficiary (the informal worker) will pay 9% of their wages to cover the risks of old age, incapacitation, and death, while the treasury will pay in 12%; to insure against illness, the beneficiary will pay in 4%. In total, then, the beneficiary will pay in 13% while the treasury covers 12% (N. Mustafa, personal communication, n.d.).
The universal health insurance law is compulsory and operates based on the family unit, whatever its social status. The family is registered at the family health unit located in the place of residence listed on the head of the household&rsquo;s identification card. Once families are registered, they are categorized as able or unable to pay premiums based on target criteria established by the Ministry of Social Solidarity, the Finance Ministry, and the Ministry of Manpower. Exemptions are based on a minimum wage ceiling or consumption indicators (the family&rsquo;s consumption of electricity and water, for example), along with other indicators that are periodically reviewed to identify families unable to pay in to the new system. The law provides for the provision of quality health services without discrimination as soon as the head of the household is enrolled in the system (A. Ghanem, personal communication, n.d.).
These laws are still in the implementation phase and have not been fully operationalized. It is still unclear how informal workers will be reached, and there are challenges to incorporating informal labor into the social protection system.&nbsp;
<h3 dir="ltr">Recommendations</h3>
A sustainable social protection system for the informal sector requires a working strategy involving the competent government bodies and civil society (civic associations and trade unions), in order to:&nbsp;
<ul dir="ltr">
<li style="font-weight: 400; text-align: justify;">Complete a database of all fields of economic activity in all governorates, disaggregated by gender.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">Introduce and publicize the new laws through awareness programs carried out by civic associations and NGOs, especially in order to reach informal workers. Such associations are headquartered in villages and neighborhoods where they have direct contacts with a broad spectrum of informal workers. They can also reach women in their homes in villages and neighborhoods, thus ensuring that women will be covered by the social protection system.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">Monitor the implementation of the new laws. Civic associations and NGOs can ensure that informal workers, both women and men, are included in the social protection system.&nbsp;</li>
<li style="font-weight: 400; text-align: justify;">Reach out to informal workers, both women and men. The Egyptian Trade Union Federation in particular can encourage these workers to become involved in syndicate activity and form unions, which will help to organize the sector, build its capacities, nurture union leaders (women and men), crystallize the demands of this sector, and put these demands on the labor agenda.&nbsp;</li>
