تتحمّل النساء المُهاجرات عبء العمل المنزلي مدفوع الأجر وغير مدفوع الأجر بشكلٍ غير مُتناسبٍ في دول الخليج وبعض بلدان الشّرق الأوسط، إذ قدّرت مُنظّمة العمل الدوليّة (2015) سنة 2013، أنّ 82.7% مِن مجموع عاملات وعمال المنازل في المنطقة العربيّة هم مِن المُهاجرات، وأن المهاجرات تحديدا يمثّلن 73.1% مِن مجموع عاملات المنازل. في بعض هذه البلدان، تعمل عاملات المنازل المهاجرات في إطار نظام الكفالة، وهو إطار قانوني يربط عملية التّوظيف والوضع القانوني وسبيل العيش للعاملات المُهاجرات بصاحب العمل في الأردن ولبنان وجميع دول الخليج العربي باستثناء العراق. يَعفي هذا النّظام الدولة مِن توفير الحماية الوظيفيّة لهؤلاء العاملات لأنّ عملهن ليس محميّا في إطار قانون العمل الوطني أو الدّولي. نستكشف في هذا التّعقيب الظّروف التي تُواجهها عاملات المنازل المُهاجرات لتقييم تدابير السياسة اللازمة لحمايتهنّ.
إنّ كدح عاملات المنازل المُهاجرات مضنٍ وغير مرئي، ذلك أنّهنّ يعملن في بيئةٍ خاليةٍ مِن آليات الإشراف والتعويض. كما يَعني ضعف التنفيذ والاستثناء في معايير العمل أنّ العديد مِن عاملات المنازل والعاملات في مجال الرّعاية لا يحصلن على تأمين اجتماعي. نظرا لعدم الاعتراف بعملهنّ على أنّه عمل منتج وعدم&nbsp; ترسيمه فإنّ هاته العاملات غالبًا ما يخرجن مِن تعريفات "المُوظّفات" ولا يُمكنهنّ الحصول على إعانات البطالة. ودون رعاية مُؤسّسية قويّة، لا يتوفّر لديهنّ سوى دخل بسيط لإنفاقه على صحتهنّ وتعليمهنّ وصحّة وتعليم عائلاتهنّ، كما أنّهنّ يلعبن دور أيضًا حلّ مُؤقّت لتوفير هذه الخدمات للعائلات والعملاء الأكثر ثراءً، ممّا يُضيف عدم الاستقرار الوظيفي وخضوع غير مُتناسبٍ لسوء المُعاملة ومزيد مِن الفقر في قطاع الرّعاية والعمل المنزلي، كما أنّ هذا يعيق وصولهنّ لفرص العمل اللائق والمُشاركة السياسيّة أو حتّى الترفيه.
بالإضافة إلى مُواجهة التنميط العنصري المُتزايد في أثناء الجائحة والتهديدات بالتّجريم والتّرحيل، غالبًا ما تُعاني عاملات المنازل المُهاجرات مِن عبوديّة الدّيون والخصم غير القانوني مِن الأجور والعمل القسري، على سبيل المثال لا الحصر. وقد يعملن بموجب تأشيراتٍ مقيّدةٍ مِن صاحب العمل، في ظروفٍ تتداخَل فيها ترتيبات المعيشة والعمل. وتُعاني هؤلاء النساء بالفعل مِن أوجه عدم المُساواة القائمة بين الجنسين، ومِن تقييدٍ للحركة أكبر مِن نظرائهنّ مِن الرّجال وخيارات أقلّ فيما يتعلّق بالعمل القانوني وفرص العمل اللائقة.
<h3>التمويل المُناسب والاستثمار في الرعاية</h3>
تتضمّن أهداف التنمية المُستدامة لعام 2030 المُساواة بين الجنسين للنساء والفتيات، مع الاعتراف بأنهنّ يقعن تحت أعباء غير مُتناسبةٍ تتمثّل في توفير رعايةٍ دون أجر داخل الأسرة ممّا يعيق فرص تعليمهنّ وعملهنّ بشكل عام. ومع تفشّي جائحة كوفيد-19، شهدنا زيادة العمل المنزلي مع إغلاق المدارس والمُستشفيات التي تعمل بما يفوق طاقتها، في نظام مُصمّم بالفعل للحفاظ على الحدّ الأدنى مِن مستوى المعيشة، وهذا يتطلّب وضع ميزانيّة مراعية للمنظور الجنساني، ممّا يستلزم تقييم الآثار الجنسانية للسّياسة المالية، ويتضمّن استثمارًا خاصًّا في الرّعاية، بناءً على الاعتراف بالعمل المنزلي باعتباره أساسيًّا لجميع الأعمال: فهو العمل الذي يجعل جميع الأعمال ممكنة.
للاستثمار الكافي في الرّعاية، يجب على الحكومات تطبيق نظام ضرائب تصاعديّة لتخفيف التفاوتات داخل القطاعات. على المُؤسّسات المالية الدولية الالتزام بإطار عمل لحقوق الإنسان يوجّه سياستها المالية، بما في ذلك المتعلّقة بحقوق العمل. إذ دون هذا الالتزام، يُؤدّي التعديل الهيكلي المُقترح والقروض المُقدّمة لعمليات الإنقاذ الحكوميّة إلى انخفاض خدمات الرعاية معقولة التكلفة. وغالبًا ما أسفرت برامج الإصلاح الهيكلي في إطار ترتيبات القروض مع المؤسّسات المالية الدولية عن تدابير تقشّف -مثل إلغاء الإعانات الماليّة وانخفاض الاستثمار في الصّحّة والتعليم- الأمر الذي يُؤثّر بشكلٍ غير مُتناسبٍ على الفئات الأكثر ضعفًا. وقد شهدت مصر هذا الأمر في برنامج الإصلاح الاقتصادي لعام 2016، والذي أدّى إلى انخفاض حادّ في الإنفاق على الصّحة وزيادة ضرائب الاستهلاك التنازلية (Diab &amp; Hindy, 2021). كما لُوحظ في اجتماع منتدى سياسات المجتمع المدني حول اقتصاد الرّعاية ودور المُؤسّسات المالية الدولية أنّ مشورة صندوق النقد الدولي المُتعلّقة بالسياسة الضريبيّة في اتفاقيات الإقراض تركّز بشكل أساسي على ضريبة القيمة المُضافة وضرائب الاستهلاك الأخرى، مما يُؤثّر على النّساء والنساء اللاتي يُعانين مِن الفقر وخاصّة مَن يُنفقن نصيبًا أكبر مِن دخلهنّ على السّلع الأساسيّة (IMF, 2021).
دعت العديد مِن المُنظّمات النسوية إلى إعادة التفكير في هذه السياسات المالية، وزيادة الاستثمار في الرعاية الصّحيّة والتعليم وزيادة الحماية الاجتماعية؛ علاوةً على تمديد إطار اتفاقية القضاء على جميع أشكال التمييز ضد المرأة لتحقيق تغييرٍ يُؤدّي إلى تحوّل جذري شامل (IMF, 2021). والأكثر صلة هو التوصية العامّة رقم 26 بشأن العاملات المُهاجرات لاتفاقيّة القضاء على جميع أشكال التمييز ضد المرأة، والتي تُشدّد على الحاجة إلى الحماية القانونية لحقوقهنّ، وأنظمة الأجور وساعات العمل، وقوانين الصّحة والسّلامة وأنظمة الإجازات، مِن بين أمور أخرى (CEDAW, 2008). يتطلّب تصحيح حالات عدم المساواة المتأصّلة في اقتصاد الرعاية إصلاحًا شاملًا لأولويّات الاستثمار ونظام العمل القانوني.
<h3>الحدّ الأدنى الشّامل للأجور على المستوى الوطني</h3>
إنّ تغطية الحدّ الأدنى للأجور منخفضة في دول الخليج والشرق الأوسط، وفي أغلب الأحيان، تستثني قطاعات كبيرة مِن السّكان، ليس فقط حسب القطاع، لكن أيضًا حسب حالة الهجرة. فعلى سبيل المثال، لا يوجد حدّ أدنى للأجور في الإمارات العربية المتحدة والمملكة العربية السعودية، بينما يوجد حد أدنى مُختلف للأجور للمهاجرين والمواطنين في الأردن، ويوجد حدّ أدنى للأجور فقط للقطاع العام في البحرين، وباستثناء الكويت، فإنّ عُمّال المنازل في الخليج مُستثنون مِن الحدّ الأدنى للأجور حيثما وجدوا (ILO, 2019). كجزءٍ مِن الحركة العُمّالية العالميّة، تزداد قناعتنا بأنّ الحدّ الأدنى للأجور الشّامل هو الخطوة الأولى لإصلاح حالات عدم المُساواة التي لا يُعانيها القطاع المحلي فحسب لكن يعاني منه الاقتصاد ككل. وشهد مؤتمر العمل الدولي هذا العام تسليط مجموعات العُمّال الضّوء بشكلٍ مُتكرّرٍ على الحاجة إلى حدّ أدنى شامل للأجور (ILC, 2021).
ثمّة مثال إيجابي في جنوب إفريقيا يُحدّد الأسبقيّة لقطاع العمل المنزلي: تُشارك الحكومة وقادة الأعمال والنقابات العُمّالية في حوارٍ مِن خلال هيئة شبه قانونيّة ذات هيكل ثلاثي، وقد تفاوضوا على وضع حدّ أدنى للأجور مِن خلال توتّرات وضغوط مُختلفة، ففي حين ادّعى المُعارضون أنّ الحدّ الأدنى الشّامل للأجور والامتثال القسري مِن شأنهما أن يُؤدّيا إلى فقدان الوظائف لأنّ أصحاب العمل لن يكونوا قادرين على تحمّل المدفوعات، فقد أظهرت الأدلّة أنّ الامتثال للحدّ الأدنى للأجور وزيادة الأجور قد أدّيا إلى مزيدٍ مِن التداول والتحفيز الاقتصادي في السوق، وذلك حسب ما جاء في تقريرٍ قدّمته إحدى عضوات نقابات عمّال جنوب إفريقيا "جين باريت" في مؤتمر نقابات عُمّال جنوب إفريقيا (COSATU). وخلال مفاوضات جنوب إفريقيا، كانت النقابات الأكبر تخشى أن يتم الحطّ مِن شأن المُفاوضات الجماعيّة على الأجور في بعض الصّناعات مثل الزراعة: خوف لم يتحقّق أيضًا، كما ذَكَرَت "باريت" (Barrett, personal interview, April 15, 2021).
حقيقة الأمر هي أنّ الحدّ الأدنى للأجور، حيثما وجد، يسير جنبًا إلى جنبٍ مع المفاوضات الجماعيّة. وفي إطار نظام الكفالة؛ حيث يُحرم العُمّال مِن حقوقهم النقابيّة مِن ضمن حقوق أخرى، فإنّ الأمر متروكٌ للعُمّال والنقابات مِن الصّناعات الأخرى لتصوّر اقتصاد عادل؛ إذ يُمكن للاتفاق الجماعي أن يضع معيارًا قانونيًّا للحدّ الأدنى الشّامل للأجور، أي حد أدنى يشمل العُمّال الذين لديهم صفة مهاجر ويُمكن مراقبته وتنفيذه. ويضع هذا الحدّ الأدنى للأجور أساسًا وليس سقفًا لأجور العمال، وهذا مِن شأنه أن يمكّن عُمّال المنازل، مِن النّاحية النظريّة، مِن الحصول على أجور أكثر ثباتًا. ومع ذلك، فاختلال موازين القوى التي يفرضها نظام الكفالة وعدم الانتظام الذي يدفع بعض العمال إليه، مِن شأنه أن يعيق بعض العُمّال عن المطالبة بهذه الأجور والحصول عليها خوفًا مِن الانتقام، ويجب أن يسير الحدّ الأدنى الشّامل للأجور جنبًا إلى جنبٍ مع قانون العمل الذي يضمن حماية العمال الضّعفاء المُعرّضين للخطر.
صادف اليوم العالمي للعمالة المنزليّة الذي احتفل به في 16 يونيو 2021 الذّكرى السنويّة العاشرة لاتفاقيّة العمل اللائق للعُمّال المنزليين رقم 189 الخاصّة بمُنظّمة العمل الدولية، كما مثّل أيضًا فوزًا كبيرًا للعُمّال المنزليين في الأرجنتين، وقد أدّت مفاوضاتهم على الأجور إلى زيادة رواتبهم بنسبة 42%، بالإضافة إلى 2% إضافيّة للمناطق غير المواتية والحقّ في الحصول على أجر إضافي بنسبة 1% للأقدمية سنويًّا، على أن يتم تطبيق ذلك بَدءًا مِن سبتمبر 2021 (Argentina.gob.ar, 2021). وقد حدث هذا الفوز نتيجة لضغط الاتّحاد الأرجنتيني للعُمّال المُساعدين بالمنازل الخاصة (UPACP)، التابع للاتحاد الدولي للعمالة المنزليّة. ويُوضّح ذلك أنّ الزيادات الهائلة على ما يبدو في أجور عُمّال المنازل وعُمّال الرعاية ممكنة عندما تكون الإرادة السياسية مواتية، كما أنّ الاستثمار في الرعاية والتمويل المراعي للمنظور الجنساني وإلغاء نظام الكفالة أو فرض حدّ أدنى شامل للأجور شروطٌ مِن شأنها أن تدعم الوضع الاقتصادي العام ونوعيّة الحياة في البلدان المعنيّة، بشرط أن تلتزم قياداتها التزامًا نشطًا تجاه التعافي مِن جائحة كوفيد-19 الذي يُركّز على الإنسان، وشريطة أن تتفاوض النقابات العُمّالية بشكل جماعي عبر القطاعات وأن تشمل مطالب وأصوات القطاعات التي تفتقر للتمثيل.&nbsp;

Across the Gulf States and some countries of the Middle East, it is migrant women who bear the disproportionate burden of both unpaid and paid domestic work. The International Labor Organization (2015) estimated that in 2013, 82.7% of domestic workers in the Arab region were migrants, including 73.1% of all female domestic workers. In some countries, these domestic migrant workers operate under the Kafala system, a legal framework that ties the employment, legal status, and livelihood of a migrant worker to their employer in Jordan, Lebanon, and all Arab Gulf states but Iraq. It exempts the state from providing job protection for these workers, as they do not operate within the framework of national or international labor law. This commentary explores the conditions migrant domestic workers face to assess the policy measures necessary to safeguard them.&nbsp;
The time-consuming and invisible labor of migrant domestic workers means they work in an environment devoid of supervisory and redress mechanisms. Poor enforcement of and exclusion in labor standards means that many domestic and care workers lack social insurance. Without the recognition of their labor as productive and the formalization of their employment, they often fall out of the definitions of &ldquo;employees&rdquo; and cannot access unemployment benefits. And without robust institutional care, not only do they have little disposable income to spend on health and education for themselves and their families, but they also become the band-aid solution for providing these services for wealthier families and clients. This adds up to labor precarity, disproportionate subjugation to abuse and more poverty in the care and domestic work sector. Their access to decent work opportunities, political participation or even leisure, is impeded.&nbsp;
In addition to facing increased racial stereotyping during the pandemic and threats of criminalization and deportation, migrant domestic workers often experience debt bondage, illegal wage deduction and forced labor, to name but a few. They may work under employer-tied visas, in conditions where living and working arrangements overlap. These women already navigate existing gender inequalities, experiencing more restricted mobility than their male counterparts and fewer legal and decent job options.&nbsp;
<h3>Adequate financing and investment in care</h3>
The Sustainable Development Goals (SDGs) of 2030 include gender equality for women and girls, recognizing that they fall under disproportionate burdens of provision of unpaid care within the household which hinders their education and employment opportunities at large. With the COVID-19 pandemic, we have seen domestic work increase with the closure of schools and hospitals functioning beyond their capacity, in a system that is already designed to sustain a minimal level of life. This requires gender-responsive budgeting, which entails assessing the gendered impacts of fiscal policy, and implies a particular investment in care, based on the recognition of domestic work as the mother of all labor: the work that makes all work possible.&nbsp;
For adequate investment in care, governments must implement progressive taxation to mitigate disparities within sectors. Together with International Finance Institutions (IFIs), they must commit to a human rights framework guiding their fiscal policy, including labor rights. Without such commitment, proposed structural adjustment and loans provided for government bailouts result in the decrease of affordable care services. Structural reform programs under loan arrangements with IFIs have often led to austerity measures &ndash; such as the removal of subsidies and declining investment in health and education &ndash; that disproportionately impact the most vulnerable. Egypt witnessed this in its 2016 economic reform program, which resulted in an acute drop in health expenditure and increase in regressive consumption taxes (Diab &amp; Hindy, 2021). As noted in the Civil Society Policy Forum&rsquo;s panel on the care economy and the role of IFIs, the International Monetary Fund&rsquo;s (IMF) tax policy advice in lending agreements predominantly focuses on VAT and other consumption taxes, which affects women and women in poverty particularly who spend a higher share of their income on basic goods (IMF, 2021).&nbsp;
Multiple feminist organizations have called for a rethinking of these fiscal policies; increased investment in healthcare and education and increased social protection; as well as the extension of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) framework for transformative change (IMF, 2021). Most relevant is the CEDAW&rsquo;s Recommendation No. 26 on women&rsquo;s migrant workers, which stresses the need for the legal protection for their rights, wage and hour regulations, health and safety codes and leave regulations, among others (CEDAW, 2008). Rectifying the inequalities embedded in the care economy calls for an overhaul of both investment priorities and the legal labor system.
<h3>Inclusive national minimum wage</h3>
The coverage of minimum wages in the Gulf States and the Middle East is low, and most often than not, it excludes large portions of populations, not only by sector, but also by migration status. For example, there is no minimum wage in the United Arab Emirates and Saudi Arabia, a different minimum wage for migrants and nationals in Jordan, a minimum wage only for the public sector in Bahrain, and except for Kuwait, domestic workers in the Gulf are excluded from minimum wages where they exist (ILO, 2019). As part of the global labor movement, we are growing more convinced that a universal minimum wage is the first step to mending the inequalities experienced not only by the domestic sector, but within the economy at large. This year&rsquo;s International Labor Conference (ILC) saw workers&rsquo; groups repeatedly highlighting the need for a universal minimum wage (ILC, 2021).
In South Africa, a positive example sets a precedence for the domestic work sector: government, business leaders and labor unions engaged in dialogue through a quasi-statutory body of a tripartite structure. They negotiated the introduction of a minimum wage through various tensions. While opponents claimed that a universal minimum wage and forced compliance would induce job losses as employers will not be able to afford payments, the evidence showed that compliance to a minimum wage and wage increase has introduced more circulation and more economic stimulus into the market, according to South African Trade Unionist Jane Barrett&rsquo;s report to the Congress of South African Trade Unions (COSATU). During the South African negotiations, bigger unions feared that collectively bargained wages in some industries such as agriculture would be dragged down: a fear that also did not materialize, as Barrett reports (Barrett, personal interview, April 15, 2021).&nbsp;
The fact of the matter is that minimum wages, where they exist, go hand in hand with collective bargaining. Under the Kafala system, where workers are denied their unionizing rights among other rights, it is up to workers and unions from other industries to envision a just economy, where the collective agreement can set a statutory standard for a universal minimum wage, meaning one encompassing workers with a migrant status and that can be monitored and enforced. Such wage sets a base but not a ceiling to worker&rsquo;s compensation. This would enable, in theory, domestic workers accessing more stable pay. However, the power imbalances imposed by the Kafala system and the irregularity that it pushes some workers towards would impede some workers from demanding and accessing such wages in fear of retaliation. A universal minimum wage must go hand in hand with a labor act that ensures the protection of workers with vulnerable status.&nbsp;
International Domestic Workers Day on June 16, 2021 marked both the tenth anniversary of the International Labor Organization&rsquo;s Domestic Workers Convention 189 and a massive win for domestic workers in Argentina, whose wage bargaining led to a 42% salary increase, with an additional 2% for unfavorable areas and the right to 1% additional compensation for seniority per year, to be applicable starting in September 2021 (Argentina.gob.ar, 2021). The win was lobbied for by the Argentinian Union Auxiliary Staff of Private Houses (UPACP), affiliated to the International Domestic Workers Federation (IDWF). This goes to show that seemingly dramatic increases in wages for domestic and care workers are possible where the political will is favorable. Investment in care, gender-responsive financing, abolishment of the Kafala system or the enforcing of a universal minimal wage are conditions that would favor the overall economic status and quality of life in the countries concerned, provided that their leadership makes an active commitment to a human-centric recovery from the COVID-19 crisis, and provided that labor and trade unions bargain collectively across sectors and include the demands and voices of sectors that lack representation.&nbsp;
