لطالما تعاملت المجتمعات العربية مع المرضى النفسيين، تقليدياً، بمهابة واحترام. حيث كانت الأسر ترعى المرضى النفسيين وفقاً للتقاليد الإسلامية. ويُعرف الشخص المختل عقلياً بأنه "مجنون"، أي الشخص الذي تتقمصه الجن، ومن هنا تأتي المكانة الروحية للمريض النفسي في مجتمعات الشرق الأوسط. وظل المرضى طوال قرون يتلقون الرعاية في مجتمعاتهم المحلية؛ وعند وجود حاجة إلى دخول المستشفى، كان يتم تقديم هذه الرعاية في أقسام متخصصة بالصحة النفسية داخل المستشفيات العامة.
وفي مصر، ظهر مفهوم عزل المرضى النفسيين في مصحّات في ثمانينيات القرن التاسع عشر وذلك في أعقاب الاحتلال البريطاني في 1882. وكان يُنظر إلى ممارسة تقديم الرعاية للمرضى النفسيين داخل المجتمع المحلي على أنه علامة على التخلف. وتم توجيه الدعوة إلى الدكتور البريطاني جون وارنوك، مسؤول مصحات العلاج النفسي، لزيارة مصر بهدف بناء منظومة نموذجية للمصحات، حيث بدأ ذلك بمستشفى العباسية في سبعينيات القرن التاسع عشر ولاحقاً بمستشفى الخانكة في ثلاثينيات القرن العشرين. وفي بادئ الأمر كان لدى هذه المؤسسات سياسات داخلية رسمية تنظم ممارسة إدخال وخروج المرضى (Nour, 2014).&nbsp;
قانون الصحة النفسية لسنة 1944
عندما تأسست وزارة الصحة العامة في سنة 1936 أضحى الوزير مسؤولاً عن إصدار السياسات العامة المتعلقة بحماية المرضى النفسيين. وتم التصديق على أول قانون مصري لحماية المرضى النفسيين في البرلمان في سنة 1944. وقد تم وضعه على غرار قانون الصحة النفسية الإنجليزي لسنة 1936، وكان قانوناً ليبيرالياً في وقته حيث إنه أقر بإمكانية الأفراد إدخال أنفسهم طوعاً إلى مستشفى الأمراض النفسية. ولكنه لم يضع معاييراً لإعادة التقييم في حالة المرضى خروجهم، حيث لم يكن هناك سوى عدد قليل من العلاجات الناجحة للأمراض النفسية في ذلك الوقت، وكان يفترض عند إدخال الفرد أنه سيظل هناك على الأرجح لعدة سنوات أو لمدى الحياة.
واستمر قانون الصحة النفسية لسنة 1944 في وضع معايير الرعاية النفسية في مصر حتى سنة 2006، عندما بدأت وزارة الصحة في مصر العمل على مشروع قانون جديد من شأنه حماية حقوق الأشخاص المصابين بأمراض نفسية ووضع مبادئ توجيهية للعاملين في الممارسة السريرية. واستغرقت عملية الصياغة ثلاث سنوات بدعم كبير من منظمة الصحة العالمية والكلية الملكية للأطباء النفسيين وكيانات أخرى تعمل في مجال حقوق الإنسان. وقد ساهم تمويل قدمته وزارة الخارجية في فنلندا على تنظيم العمل والحصول على الدعم الدولي.
قانون الصحة النفسية لسنة 2009
وفي 23 سبتمبر 2009، صدّق البرلمان المصري على قانون رقم 71 لسنة 2009، المعروف بقانون الصحة النفسية. وتم الانتهاء من وضع اللائحة التنفيذية في 2010. وقد ساعد القانون على تطوير مفهوم الرعاية في مستشفيات الصحة النفسية المصرية؛ حيث تراجعت الوصمة المرتبطة بمؤسسات العلاج وأصبح هناك صوت مسموع لمستخدمي الخدمة. وساعدت حملة التوعية بالصحة النفسية التي تم إطلاقها للترويج للقانون الجديد على تشجيع المجتمعات المصرية على قبول الاضطرابات النفسية على أنها واقع اجتماعي ينبغي التعامل معه بأسلوب إنساني ومحترم. وأضحى لدى المرضى الحق في اختيار خطة العلاج الخاصة بهم، بينما تم وضع ضوابط وموازين للحالات التي تستلزم العلاج الإلزامي لضمان إلمام المرضى بحقوقهم، بما في ذلك الحق في الطعن في خطة علاجهم والحق في رفض العلاج. وتمت إتاحة وثيقة حقوق المرضى النفسيين التي يتوجب على جميع المستشفيات توفيرها لجميع مستخدمي الخدمات. وتم إنشاء هيئة إشراف مستقلة؛ حيث يقدم المجلس القومي للصحة النفسية، بصفته طرفاً ثالثاً، توازناً تعسفياً لحقوق المرضى في العلاج في بيئة تتسم بأقل قدر من القيود من خلال الرصد وتقديم الرأي الثاني لحالات الإدخال الإلزامي.&nbsp;
تطور التشريعات في أعقاب الثورة
في مارس 2011 قررت الحكومة المصرية إعادة النظر في حقوق المرضى النفسيين التي يحميها القانون، وأقرت تعديلات ألغت العديد من ضمانات حقوق المرضى الواردة في القانون. وتم تعديل اللائحة التنفيذية بالقرار الوزاري رقم 210 لسنة 2011؛ وتضمنت التغييرات استبدال الموافقة المُوقعة على العلاج بالموافقة الشفهية التي تتم كتابتها في خانة الملاحظات الخاصة بالمريض. وقام القرار أيضاً بفتح الباب أمام ممارسة العلاج بالصدمات الكهربائية إلزاميا. وحل مصطلح "علاج تنظيم إيقاع المخ" محل العلاج بالصدمات الكهربائية وهو مصطلح مضلل ينكر حق الفرد في فهم العلاج، وهو تسمية مصرية فريدة من نوعها ذات نبرة استعلائية واضحة تجاه المرضى (Loza &amp; El Nawawi, 2012).
وفي ممارسة قضائية نادرة، قامت منظمات المجتمع المدني في مصر برفع المسألة أمام المحاكم وتمكنت من إلغاء القرار الوزاري الصادر في مارس 2011. وظل مستخدمو خدمات الصحة النفسية في مصر ينعمون بحماية تشريع 2009 طوال سنوات عديدة حتى 2021.
وفي 2020، طُرحت المسألة للمناقشة مرة أخرى في البرلمان المصري. وللمرة الثانية تم التطرق إلى الروح الليبيرالية لقانون الصحة النفسية لسنة 2009. وتم اقتراح تغييرات جديدة في القانون تحرم المرضى من الحق في الموافقة على العلاج من خلال إفساح المجال بشكل أكبر أمام العلاج بالصدمات الكهربائية الإلزامي وإعادة إدراج تسمية "علاج تنظيم إيقاع المخ" المضللة. وتناولت التغييرات المقترحة قانون العلاج النفسي، حيث اقترحت وجوب قيام الأطباء النفسيين بفحص جميع عملاء المعالجين النفسيين الغير أطباء قبل تقديم الخدمة، وهي ممارسة لم يسمع بها من قبل في أي بلد آخر.&nbsp;
وقد تدخلت العديد من المنظمات الدولية المعنية بحقوق الإنسان الخاصة بالمرضى النفسيين في مصر. وتم إرسال عرائض إلى وزارة الصحة المصرية ولجنة الصحة في البرلمان من منظمة الصحة العالمية والرابطة العالمية للطب النفسي والاتحاد العالمي للصحة النفسية والكلية الملكية للأطباء النفسيين وغيرها من الجمعيات العالمية القلقة بشأن هذه الخطوة للوراء. ومع ذلك، لم يكن لهذه الجهود تأثير يذكر. وفي 2021 صدّق البرلمان على التغييرات في تحد للرأي العام الدولي.
مستقبل حقوق مستخدمي الخدمات في مصر
يتعين على الحركة الرامية إلى تحسين خدمات الصحة النفسية أن تحارب على عدة جبهات، حيث إن التشريع وحده لن يغير الممارسات. فالمواقف والتوجهات الثقافية هي العوامل الأكثر أهمية في تحديد الممارسات الصحية على الصعيد العالمي. وبالتالي، ينبغي أن تكون قيادة حملات التوعية التي تدافع عن حقوق الأشخاص المصابين بإضطرابات نفسية من أولويات منظمات المجتمع المدني والمؤسسات التعليمية وقادة المجتمعات المحلية. ومن التطورات المبشرة بالخير تأسيس جمعية دعم حقوق المريض النفسي، وهي منظمة غير حكومية تدافع عن مكانة المرضى النفسيين في مجتمعاتنا المحلية، وتم تسجيلها رسمياً في 2021. وتشمل عضويتها مجموعة متفرغة من قيادات الرأي تحمل رسالة دعم قوية للقضية. وفي هذا الصدد، فإن المستقبل يحمل معه وعوداً كثيرة لهذا القطاع من مجتمعنا.

Traditionally Arab societies have treated mentally ill persons with reverence and respect. Families cared for the mentally ill in accordance with Islamic traditions. The Arabic name for a madman is majnoun meaning he who is inhabited by Jinn, hence the spiritual place of the mental patient in Middle Eastern societies. For centuries patients were cared for in their communities; when there was a need for hospitalization, this was offered in specialized mental health departments within general hospitals.&nbsp;
In Egypt, the concept of isolating mental patients in asylums arrived in the 1880s following the British occupation of 1882. The practice of caring for mental patients in the community was perceived as a sign of backwardness. Dr John Warnock, a British Asylum Superintendent, was invited to Egypt to build an exemplary system of asylums, which began with the Abasseya Hospital in the 1870s and later the Khanka hospital in the 1930s. Initially these institutions had formal internal policies regulating the practice of admissions and discharge of patents (Nour, 2014).&nbsp;
The Mental Health Act of 1944
When the Ministry of Public Health was established in 1936, it became the responsibility of the minister to issue public policies protecting mental patients. The first Egyptian law to protect the mentally ill was ratified in parliament in 1944. Modelled after the English Mental Health Act of 1936, it was a liberal law for its time in that it recognized that individuals may admit themselves voluntarily to the psychiatric hospital. However, it didn&rsquo;t set standards for reviewing and discharging patients, as there were few effective treatments for psychosis at the time, and the assumption was that once an individual is admitted, they are likely to be there for years or for life.
The Mental Health Act of 1944 continued to set the standards of care for psychiatric care in Egypt until 2006, when the Egyptian Ministry of Health started to work on a new draft legislation that would protect the rights of people with mental illness and set guidelines for clinical practitioners. The drafting process lasted three years with much support from the World Health Organization, the Royal College of Psychiatrists and other human rights entities. Funding from the Ministry of Foreign Affairs in Finland helped structure the work and invited international support.
​The Mental Health Act of 2009
On September 23rd, 2009, the Egyptian Parliament ratified Law 71/2009, known as the Mental Health Act. The Code of Practice was completed in 2010. The law helped to evolve the concept of care in Egyptian hospitals; the treatment institutions became less stigmatized and service users had a voice. A mental health awareness campaign to promote the new law helped to encourage Egyptian communities to accept mental disorders as a social reality that should be treated in a humane and respectful manner. The patients had a right to choose their therapy, and when there was a need for involuntary treatment there were checks and balances to ensure patients knew their rights, including the right to appeal against their treatment plan and the right to refuse treatment. A charter of the rights of mental patients was made available, which all hospitals must provide to all service users. An independent supervisory body was established; the National Council for Mental Health provides a third-party arbitrary balance to patients' right to treatment in the least restrictive environment possible by monitoring and giving a second opinion for involuntary admissions.
Post-revolution developments in legislation
In March 2011, the government decided to revisit the rights of mental patients as protected by the law, and passed amendments that removed many of the safeguards of patients&rsquo; rights contained in the law. The Code of Practice was amended by Ministerial Decree 210/2011; changes included replacing signed consent to treatment with verbal consent noted by a written entry in the patient&rsquo;s notes. The Decree further opened doors for the practice of involuntary Electroconvulsive Therapy (ECT). The term &ldquo;brain synchronizing treatment&rdquo; was to replace ECT, a misleading term that denies the individual&rsquo;s right to understand treatment, a unique Egyptian nomenclature with a clear patronizing attitude to patients (Loza &amp; El Nawawi, 2012).
In a rare judicial practice, Egypt&rsquo;s civil society organizations took the matter to court and were able to revert the ministerial decree of March 2011. For many years up until 2021, the service users of Egypt&rsquo;s mental health services enjoyed the protection of the 2009 legislation.
In 2020 the matter was debated again in Egypt&rsquo;s parliament. For a second time the liberal spirit of the 2009 mental health legislation was addressed. New changes were proposed to the law, denying patients&rsquo; right to consent to treatment by making more allowance for involuntary ECT, and reintroducing the deceitful nomenclature of Brain Synchronizing Treatment. The proposed changes addressed the law for psychotherapy, suggesting psychiatrists should screen all psychotherapy clients prior to therapy, a practice unheard of in any other country.
Numerous international organizations concerned with the human rights of mental patients in Egypt interfered. Petitions were sent to the Minister of Health and the parliamentary health committee from the WHO, the World Psychiatric Association, the World Federation for Mental Health, the Royal College of Psychiatrists and other global societies concerned with this regressive step. However, these efforts had little or no impact. In 2021, parliament ratified the changes in defiance of international opinion.&nbsp;
Future of the rights of service users in Egypt
The movement to improve mental health services must be fought on multiple fronts, as legislation alone does not change practices. Cultural attitudes and priorities are more important determinants of health practices globally. Therefore, it should be a priority for civil society organizations, educational institutions and community leaders to lead awareness campaigns advocating for the rights of people with mental illness. An encouraging development is the establishment of the Egyptian Society for the Rights of People with Mental Illness, an NGO advocating for the place of the mentally ill in our communities, which was formally registered in 2021. Its membership includes a dedicated group of opinion leaders with a strong message of support for the cause. In this regard, the future holds many promises for this sector of our society.&nbsp;
