لطالما كان التحرش الجنسي ضد المرأة أحد الأدوات الخفية التي تستخدمها الأنظمة التي تتحكم في المرأة في الحياة الخاصة والعامة. غير أن المرأة التي صمتت في الماضي، بدأت تكافح اليوم من أجل استرجاع زمام السيطرة. والأهم هو أن هذه المقاومة تمكنت من إسقاط بعض من أقوى الرجال في العالم، مما أعطى الأمل والإصرار والشجاعة للنساء في جميع الدول.
شهدت السنوات العشر الأخيرة ظهور أجيال جديدة من الشابات في مصر، على قدر أكبر من الجرأة مقارنةً بأمهاتهن وجداتهن، إن كان من ناحية ترتيب أولويات نضالهن أو من ناحية نظرتهن إلى أنفسهن. وخلال ثورة 2011، واجهت هؤلاء النساء، اللاتي كانت العديد منهن بلا أي توجهات سياسية، التحرش الجنسي الذي كان يمارس ضدهن في الأماكن العامة لإسكاتهن وتخويفهن. واليوم، نشهد مرحلة جديدة في هذه المواجهة؛ حركة لفضح التحرش الجنسي الذي تتم ممارسته داخل المؤسسات والاعتراض عليه.&nbsp;
لقد قامت هؤلاء الشابات، اللاتي لا يتمتعن بالدعم المؤسسي في معظم الأحيان، بالتغلب على عقبة كبيرة للغاية، وهي إسكاتهن عن طريق التشهير، الأمر الذي دفع النساء إلى التزام الصمت لزمن طويل. ويتكرر التشهير والإذلال ضد أولئك اللاتي عارضن التحرش والاعتداء الجنسيين، ولا يزالا ضمن التحديات العديدة الموجودة. وتعتبر الأسر والمجتمعات المحلية من ضمن ممارسي الاضطهاد الرئيسيين على هذا الصعيد، في حين أدى انعدام التشريعات والدعم المؤسسي والدعم العام إلى عرقلة قوى التغيير.
وفي حين أن، بشكل عام، التغيير يحدث على مر الزمن وبشكل تصاعدي، فإن ما يحدث في الوقت الحالي يمثل، وبدون شك، خطوة هامة إلى الأمام، وإن كان لا يزال هناك العديد من التحديات، بما فيها القدرة على التنظيم ووضوح الغاية ومواجهة أشكال التحيز المجتمعي المتجذرة والتأثير في نهاية المطاف على القوانين والسياسات. وبالتالي، فإن نجاح هذه الحركة في إحداث تغيير واسع النطاق يعتمد على معالجة هذه التحديات ومواجهة رد الفعل العنيف الذي سيحاول إسكات الحركة بمجرد انتشارها خارج نطاق قوقعتها النسبية المتمثلة في المؤسسات غير الحكومية والمجموعات المستقلة.
<h3 dir="rtl">مكافحة التحرش والاعتداء الجنسيين: عهد جديد</h3>

وعلى الرغم من اضمحلال النشاط السياسي بشكل عام، شهدت حركة #أنا_أيضًا (#MeToo) عودة النشاط على فيسبوك. حيث تم تجميع ونشر قوائم بأسماء متحرشين مزعومين، وتتضمن أسماء عدد من شخصيات المعارضة. وتم تشكيل لجان مستقلة مكونة بشكل رئيسي من أفراد يحددهم موجهو الاتهام. ولقد كان الأثر إيجابيًا &nbsp;في الكثير من النواحي، حيث إنه سلط الضوء على التحرش وسعى إلى مساءلة الأشخاص، بغض النظر عن موقعهم في الساحة السياسية. غير أنه أثار نقاشًا لم يحسم بعد بشأن ما يصنف بالفعل تحرشًا جنسيًا ومصداقية لجان التحقيق المستقلة.

غير أن هذه الحركة بدأت في إيجاد بيئة أكثر استنارة ضمن المنظمات غير الحكومية فيما يتعلق بالواقع الذي تعيشه الزميلات والصديقات. كما أنها شجعت الجهات المختلفة، وعلى وجه الخصوص الجهات غير الحكومية، على تنظيم جهودها، ونشر معايير واضحة، وتحسين آليات وقواعد التحقيق للحفاظ على مصداقياتها. ولقد دفعت إلحاحية القضية عدد من المنظمات غير الحكومية إلى صياغة ورقات مواقف وسياسات بشأن التحرش الجنسي، ومن ضمنها المعايير والآليات اللازمة وما إلى ذلك. <h3 dir="rtl">الخروج من قوقعة الهيئات غير الحكومية</h3>
وفي مصر، بدأ النشر عبر وسائل التواصل الاجتماعي لحوادث تشمل نساء تم التعرض لهن في مواقع مختلفة وطلبن الحماية من أفراد الأمن أو الجمهور. وجاء الرد بشكل عام أنه ينبغي تركهن لوحدهن. ويعكس التشهير بالنساء على فيسبوك إما حملة منظمة لإسكات النساء أو مجتمعاً يرفض إلى غاية الآن التعامل مع هذه القضية إلا من خلال لوم الضحية.&nbsp;&nbsp;
ومع ذلك، بدأت تتشكل مجموعات بين هؤلاء الشابات، خاصة في أوساط شابات من الطبقة العليا، اللاتي حاولن توثيق الجرائم الخطيرة والتحقيق فيها ونشرها. ومن ضمن هذه المجموعات حساب معروف على إنستغرام باسم "Assault Police"،<a href="#_edn1" name="_ednref1">[i]</a> وهو الحساب الذي نشر قضية طالب جامعي يزعم أنه اعتدى على أكثر من 100 امرأة وتحرش بهن، وذلك وفقاً لأقوالهن. وفي نهاية المطاف تم إلقاء القبض عليه، فيما تم توجيه الاتهام إليه مؤخراً.
وقامت نفس المجموعة أيضاً بنشر قضية الفيرمونت التي يزعم فيها أن عدداً من الشباب قاموا بتخدير شابة واغتصابها بشكل جماعي. ورحب حساب "Assault Police"، الذي من المتصور أنه يُدار بواسطة شابات ينتمين إلى الطبقة المتوسطة والطبقة العليا، بالإعلان الصادر عن المجلس القومي للمرأة الذي شجع مديرات الحساب بالتقدم ببلاغات من خلال استخدام خط ساخن ووعد بأنهن سيحصلن على العدالة. وأفاد الإعلان أن المجلس القومي للمرأة سوف يحمي الشهود في حال تقدموا. وفي نفس الوقت وافق البرلمان على قانون لحماية خصوصية النساء اللاتي يتقدمن بشكاوى عن الاعتداء (Farouk, 2020). وكان يبدو أن السلطات قد تدخلت من أجل المساعدة.
غير أن الجناة المزعومين فروا من البلاد باستثناء واحد منهم. وأصبح العديد من الشهود متهمين وتم حبسهم ووجهت إليهم تهمة الفجور والمشاركة في حفل جنس جماعي، كما تم شن حملة تشهير ضدهم باستخدام صور ومقاطع فيديو شخصية تم تسريبها من هواتفهم المًصادرة. وكان هذا التغير شديداً على أقل تقدير (مدى مصر، 2020).&nbsp;
وخلص مراقبون موضوعيون إلى استنتاج عقلاني على فيسبوك ومواقع الصحافة المستقلة وهو أن الشباب المتهمين ينتمون إلى عائلات ذات نفوذ، ولا تزال هناك العديد من التساؤلات التي تبحث عن إجابة وهي تتعلق بكيفية تأثير ذلك على التحقيق ودرجة النفوذ التي يتمتعون بها. غير إن هذا يشير إلى أن النوع الاجتماعي ليس المتغير الوحيد في قضايا التحرش والاعتداء الجنسيين. حيث تلعب الطبقة الاجتماعية والنفوذ الاقتصادية دورًا أيضًا.
ومن المرجح أن يؤدي الأثر الذي خلفته هذه القضية على الشابات وأسرهن إلى ثني أي أحد عن التقدم ببلاغات في المستقبل. ويشكل هذا تحديًا كبيرًا وعقبة رئيسية أمام مساءلة الرجال النافذين عن الجرائم الخطيرة التي ارتكبوها ضد نساء أقل نفوذًا. كما أنها تلحق ضررًا كبيرًا بنظامنا القضائي وكذلك بالهيئات الحكومية وشبه الحكومية التي لا تقتصر مهامها على حماية النساء اللاتي تعرضن لسوء المعاملة فحسب، حيث إنها تشمل أيضًا حماية الشهود على هذه الجرائم. وأخيرًا، وكما يتضح من القضية، فإن العادات الاجتماعية الضارة التي تعمل من أجل الحفاظ على الوضع القائم تحول دون تقدم مجتمعنا إلى ما هو أبعد من الصمت الذي لطالما أبقى هذا المجتمع خاضعًا.
<h3 dir="rtl">التحديات المتأصلة والمضي قدمًا</h3>
في غياب مؤسسات عامة وقانونية تراعي الاعتبارات الجنسانية، ينبغي أن توجد هيئة و/أو آلية تكون حقاً مستقلة ومنظمة وذات مصداقية ويكون بإمكان الناجين من الاعتداء التواصل معها وتتمتع بسلطة مساءلة الأفراد.
وعلى الصعيد الداخلي، يجب أن يكون لهذه المجموعة معايير واضحة ومتفق عليها بشكل جماعي بشأن تعريف التحرش الجنسي (بما في ذلك تكوين فهم واضح لمفهوم الرضا)، إضافة إلى مدونات وقواعد للتحقيق. وينبغي التوصل إلى هذا بشكل منفتح وتشاركي. وفي حال عدم وجود اختصاصات واضحة وشفافية، ستكون هذه اللجنة عرضة للتلاعب مثل المنظمات غير الحكومية الأخرى حيث إنه من المثير للشك أن تشكل شخصيات من المعارضة السياسية أغلبية المتهمين. وتعتبر حادثة الفيرمونت مثالاً على ذلك.
وعلى الصعيد الخارجي، يجب أن تكون هذه الهيئة قادرة على التنسيق مع الهيئات الوطنية من خلال قنوات مختلفة. ويجب أن تكون قادرة على ربط الناجين بمكتب المدعي العام وتيسير سبل الانتصاف القانونية عند الطلب. كما أنها ستكون بحاجة إلى خطوط ساخنة تراعي الاعتبارات الجنسانية، ويجب أن يتم تعميم هذه الأرقام على نطاق واسع. وبما أن هذه اللجنة لن تتمتع بوضع قانوني، فإنها لن تستطيع إعطاء وعود واهية لئلا تفقد مصداقيتها؛ ويجب أن تنص ولايتها على التحقق من الاتهامات ودعم الناجين/الضحايا.
وتوجد حاجة إلى توافق واسع النطاق من أجل تنسيق وحماية هيئة يكون بمقدورها العمل بمثابة محكمة شعبية معنية بالتحرش الجنسي. ويتطلب هذا الأمر تنسيقاً جاداً بين العديد من الهيئات غير الحكومية، التي يجب أن تضع خلافاتها جانباً من أجل تشكيل جبهة موحدة ضد التحرش الجنسي.
ودون التقليل من شأن الجهود التاريخية التي قدمتها المنظمات النسوية، فإنه من الأهمية بمكان التأكيد مرة أخرى على وجود جهات متعددة ومتنوعة في هذا المجال، بحيث لا تكون مرتبطة بالضرورة بنفس الأساليب أو الخلفية السياسية أو قيود الأجيال الأكبر سناً. فلا يزال أثر هذه الأمور يتكشف.
ولا يزال من غير الواضح ما إذا كان سيتم إسكات هذه الحركة من خلال الإكراه، خاصة وإنها بدأت تقترب كثيراً من أشخاص في السلطة. ومع ذلك، أظهر التاريخ أنه وبينما قد يكون بالإمكان إسكات الأفراد، فإن قمع الحركة وذاكرتها الجماعية هو أمر أصعب. على الأقل لطالما كان هذا هو الأمل.

<h2>Introduction</h2>
Sexual harassment of women is a long-standing, albeit invisible facet of systems that control women in both the private and public spheres. Women, previously silent, have now begun fighting to take some of this control back. Importantly, this pushback has been able to bring down some of the most powerful men in the world, giving hope, drive, and courage to women around the globe.
The last ten years have seen the rise of new generations of young women in Egypt who are not as inhibited as their elders, neither in the way they prioritize their struggles nor in the way they perceive themselves. During the 2011 Revolution, these women, many previously apolitical, confronted sexual harassment in public spaces that was being used to silence and intimidate them. We are today witnessing a new phase in this confrontation: a movement to publicize and contest sexual harassment within institutions.
These young women, who often enjoy no institutional support, have overcome one very significant hurdle: It is increasingly difficult to silence them through shaming, an action that has kept women silent for too long. Shame and humiliation are frequently the lot of those who speak out against sexual assault and harassment, and they continue to be one of the many challenges. Families and communities have been one of the main oppressors in this regard, while the lack of legislation and institutional and public support impedes the forces of change.
While change generally occurs over time in increments, what is occurring at present is doubtlessly an important step forward, though many challenges remain, including the ability to organize, attain clarity of purpose, confront ingrained societal prejudices, and ultimately influence laws and policies. This movement&rsquo;s success in inducing widespread change therefore depends on addressing these challenges and confronting a backlash that will attempt to silence the movement once it spreads beyond the relative bubble of non-governmental institutions and independent groups.
<h3>Combating sexual harassment and assault: A new era</h3>
This new wave of activism has made broad use of new methods of mass communication and diverse social media tools. Young women, both politicized and apolitical, are taking the initiative, focusing exclusively on sexual harassment and assault.
Despite the general tapering off of political activism, the #MeToo movement saw a resurgence of activity on Facebook. Lists of alleged harassers were compiled and posted, containing the names of a number of opposition figures. Independent committees were formed, composed mainly of individuals designated by accusers. The impact was in many ways positive, as it put a spotlight on harassment and sought to hold people accountable, whatever their position in the political opposition. But it triggered an as yet unresolved debate on what constitutes sexual harassment and the credibility of independent investigation committees.
A number of well-known political opposition figures were accused mainly by young women who were acquainted with their attackers. Assault survivors who offered their own accounts, either anonymously through intermediaries or directly, were always believed, thus placing the onus on the alleged perpetrator to prove his innocence and thereby undermining the principle of presumed innocence. Advocates for this approach argued that the gravity of the sexual harassment of women, given the difficult context of the struggle for women&rsquo;s rights, justified this exception. Additionally, not all women were willing to come forward, and friends posted their discussions online without verification. This caused further complications in an already challenging environment, as well as opening the door to character assassinations. Equally problematic were the lack of coordination by the informal investigative committees and the absence of agreement on clear criteria to guide them.
Nevertheless, this movement began to create a more informed environment within NGOs about the reality lived by female colleagues and friends. It also encouraged different actors, especially non-governmental actors, to organize their efforts, make clear criteria public, and improve mechanisms and rules for investigation to maintain their credibility. The urgency of the issue spurred a number of NGOs to formulate position and policy papers on sexual harassment, including criteria, mechanisms needed, etc. &nbsp;
<h3>Stepping outside the bubble of non-governmental bodies</h3>
In Egypt, incidents began to be posted on social media involving women who had been accosted in different locations and had requested protection by security personnel or the public. The response was generally that they should let well enough alone. The shaming of women on Facebook reflected either an orchestrated campaign to silence women or a society which had as yet refused to deal with the issue except through victim blaming.
Nevertheless, groups did begin to form among these young women, especially upper-class young women, who attempted to document, investigate, and publicize serious offenses. Among these groups is the well-known Instagram account Assault Police,<a href="#_edn1" name="_ednref1">[i]</a> which publicized the case of a university student who had allegedly assaulted and harassed over 100 women, according to their statements. He was eventually arrested and more recently indicted.
The same group also publicized the Fairmont case, in which several young men allegedly drugged and gang raped a young woman. The Assault Police account, which is perceived to be administered by middle- and upper middle-class young women, welcomed an announcement from the National Council for Women, which encouraged the account administrators to come forward using a hotline and promised that it would assist them in obtaining justice. If the witnesses came forward, the NCW would protect them, it said. At the same time parliament approved a law to protect the privacy of women filing assault complaints (Farouk, 2020). It seemed the authorities had stepped in to help.
However, with one exception the alleged perpetrators fled the country. Several of the witnesses became the accused and were taken into custody, charged with debauchery and taking part in orgies, and a smear campaign was launched against them using personal pictures and videos leaked from their confiscated phones. The reversal was extreme, to say the least (Mada Masr, 2020).
Objective observers both on Facebook and in the independent press rationally concluded that the accused young men came from powerful families, although how this might influence the investigation and the degree of power they have remain open questions. It does, however, indicate that gender is not the only variable in cases of sexual harassment and assault. Class and economic power play a role as well.
The impact of this case on the young women and their families will likely deter anyone from coming forward in the future. This constitutes a major challenge and obstacle to holding men of power accountable for serious offences against less powerful women. It also inflicts a grievous harm on our justice system as well as governmental and semi-governmental bodies, whose task is to protect not only women who have been subject to abuse, but also witnesses to such crimes. Lastly, as demonstrated by the case, harmful social norms that function to preserve the status quo prevent our society from progressing beyond the silence which has long held it in thrall.
<h3>Inherent challenges and the way forward</h3>
In the absence of gender-sensitive public and legal institutions, there must be a truly independent, organized, and credible body and/or mechanism which could be approached by survivors of assault and also has the power to hold individuals accountable.
Internally, this group must have clear and collectively agreed-upon criteria for what constitutes sexual harassment (including a clear understanding of the concept of consent), as well as codes and rules for investigation. These must be reached in an open and participatory manner. Without concrete terms of reference and transparency, this committee is vulnerable to manipulation like other NGOs &nbsp;. The Fairmont incident is a case in point.
Externally, this body must be able to coordinate with national bodies through different channels. It should be able to connect the survivor with the Public Prosecutor&rsquo;s Office and facilitate legal redress upon request. It will also require gender-sensitive hotlines, whose numbers should be widely circulated. But since this committee would have no legal standing, it cannot provide false promises lest it lose all credibility; its mandate should be to verify accusations and support survivors/victims.
A broad consensus is needed to coordinate and protect a body that can act as a people&rsquo;s tribunal for sexual harassment. This requires serious coordination between various non-governmental bodies, which must put aside their differences to form a united front on sexual harassment.
Without discounting the historical efforts of feminist organizations, it is important to again stress the presence of multiple, diverse actors in this arena, who are not necessarily tied to the same methods, political background, or constraints of older generations. The effect of this continues to unfold.
Whether this movement will be silenced through coercion remains to be seen, especially as it begins to touch people in power. However, history has shown that although individuals can be silenced, a movement and its collective memory are harder to suppress. At least that is always the hope.
