الإطار التنظيمي القديم لقطاع الدواء كان يعاني من التفتت نتيجة إنقسام مهمة تنظيم قطاع الدواء إلى ثلاث هيئات هي الادارة المركزية للشؤون الصيدلية، والهيئة القومية للرقابة والبحوث الدوائية والهيئة القومية للبحوث والرقابة على المستحضرات الحيوية. وننتج عن تقسيم المسؤوليات الإدارية الخاصة بتنظيم قطاع الدواء بين أكثر من جهة، في ظل عدم وجود جهة قيادة مسؤولة عن التنسيق بين الكيانات القائمة، ضعف القدرة على الضبط والسيطرة على سوق الدواء، فأصبحت مهمة التحكم في قطاع الدواء صعبة، وقد أدى ذلك أيضا الى تقويض الفعالية الشاملة للتنظيم.
يقدم هذا المقال عرضا للإطار التنظيمي القديم الذي كان يحكم عمل قطاع الدواء في مصر، وإعادة هيكلته التي تمت العام الماضي، وبعض المشاكل التي كانت تواجه الإطار التنظيمي السابق، والتحديات التي مازالت مستمرة مع القانون الجديد رقم 151 لسنة 2019 للتنظيم الجديد. ويقترح بعض التدخلات للتوسع في الإنفاق الحكومي على تصنيع الأدوية، وتعزيز التصنيع المحلي العام للدواء، مع توجيه القطاع الخاص، بشكل تدريجي، لتصنيع المواد الخام والأدوية التي يتم استيرادها بالكامل، فقد تحمي هذه التدخلات حق إتاحة الدواء.

بالرغم من تحديث الإطار التنظيمي لعمل قطاع الدواء، والذي من المتوقع أن يحل بعض المشاكل مثل مزايا الشراء الموحد وتنظيم جهات الرقابة إداريا في جهة واحدة، ظلت بعض التحديات الأخرى متواجدة في القطاع مثل غياب تصنيع المواد الخام، والنسبة العالية للأدوية المغشوشة ورفع كفاءة الجهات الرقابية.
يساهم القطاع العام في صناعة الأدوية في مصر بنسبة تصل إلى 6% من حصة السوق، بينما تصل نسبة القطاع الخاص إلى 94%. علي حسب بعض التقديرات يعتمد قطاع الدواء على استيراد المواد الأساسية والمواد الفعالة المصنعة والخامات اللازمة من الخارج بنسبة أكثر من 90%.
&nbsp;يعد ذلك أحد نقاط الضعف في صناعة الدواء في مصر، فهي تقوم على استيراد المواد الخام الدوائية من الخارج ثم تصنيعها وتوفيرها للسوق في الشكل الدوائي النهائي. وتعد مشاكل&nbsp; استيراد المواد الخام الدوائية من الخارج &ndash; سواء بسبب نقص في توافر العملة الصعبة او مشاكل عند الموردين &ndash; أحد أهم أسباب حدوث الأزمات المتكررة لنقص الدواء وارتفاع أسعاره، علاوة على أن الهيكل الإداري القديم والبيروقراطية الشديدة يزيد الأمر تعقيدا بسبب طول فترة التسجيل والتراخيص والمدة التي يستغرقها استخراج موافقة وزارة الصحة على استيراد المواد الخام والإفراج عن شحنات الأدوية والمواد الخام.
يعد ضعف الرقابة أيضا أحد التحديات التي يواجهها قطاع الدواء، حيث وصل حجم مبيعات الأدوية المهربة والمغشوشة في مصر إلى مرحلة تمثل خطورة على حجم تجارة الدواء حيث في مصر، بنحو 15% (Central Agency for Public Mobilization and Statistics [CAPMAS], 2015)<a href="#_ftn1" name="_ftnref1">[1]</a> من حجم تجارة الدواء. كما أن معظم الأدوية المغشوشة والمهربة يتم بيعها عن طريق العيادات الطبية أو مواقع التواصل الاجتماعي وأحيانا في بعض الصيدليات نظراً لضعف الرقابة عليها.
ضعف الإطار التنظيمي والمشاكل السابقة دفع في اتجاه إعادة هيكلة قطاع الدواء وفصله عن وزارة الصحة والسكان، بحيث يكون مستقلا عن وزارة الصحة.
<h3>الإطار التنظيمي الحالي لقطاع الدواء</h3>
أنشأ قانون رقم 151 لسنة 2019 هيئتين جديدتين هما (هيئة الدواء المصرية) و (الهيئة المصرية للشراء الموحد والإمداد والتموين الطبي) (Manshurat, 2019 , 2020). القانون بشكل عام يعتبر خطوة جيدة لتنظيم قطاع الدواء وتحديد المسؤوليات بشكل واضح، بدلا من التفتت الذي كان يسود خلال الوضع السابق. فقد حلت هيئة الدواء المصرية محل كل من الإدارة المركزية للشؤون الصيدلية، والهيئة القومية للرقابة والبحوث الدوائية، والهيئة القومية للبحوث والرقابة على المستحضرات الحيوية، وغيرها من الجهات والكيانات الإدارية ذات الاختصاص بمجال الرقابة على المستحضرات والمستلزمات الطبية. كما حلت هيئة الدواء المصرية محل قطاع الدواء بوزارة الصحة والسكان، وذلك في الاختصاصات المنصوص عليها في القانون رقم 127 لسنة 1955 في شأن مزاولة مهنة الصيدلة.
وبالإضافة إلى ذلك، أعطى القانون هيئة الشراء الموحد اختصاصات واسعة لشراء احتياجات القطاع العام الصحي، حيث تتولى دون غيرها، إجراء عمليات الشراء للمستحضرات والمستلزمات الطبية البشرية لجميع الجهات والهيئات الحكومية، وإعداد خطط وبرامج وقواعد التدبير والشراء الموحد من الداخل أو الخارج. الهدف من إنشاء هيئة الدواء المصرية هو تنظيم جهات الرقابة في كيان واحد، وذلك بدلا من وجود أكثر من جهة رقابية. والهدف من إنشاء هيئة للشراء الموحد تقوية وتعزيز فرص الوصول لأسعار أقل والاستفادة من المزايا التي تنتج عن عملية الشراء الموحد (خفض تكلفة شراء الأدوية والمستلزمات الطبية من خلال شراء كميات أكبر بأسعار أقل، وبالتالي تحقيق التوفير المادي).
وأشارت اللائحة التنفيذية للقانون بتشكيل (لجنة عليا للدواء) برئاسة رئيس مجلس الوزراء وعضوية كل من وزير الصحة والسكان والتخطيط والتعليم العالي والبحث العلمي والمالية ورئيسي مجلس إدارة الهيئة المصرية للشراء الموحد وهيئة الدواء المصرية وممثل لهيئة الرقابة الإدارية. دورها يختص بالتنسيق بين الهيئتين ومتابعة أعمالهما.
&nbsp;ما زال من المبكر تقييم عمل وأداء الهيئتين الجديدتين، فاللائحة التنفيذية للقانون نشرت في 29 مارس 2020، وما يزال في المرحلة الانتقالية من النظام القديم للجديد. ولكن تظل بعض التحديات كما هي مثل سلوكيات القطاع الخاص في تفضيل استيراد المواد الخام المصنعة من الخارج، وعدم القيام بمحاولات لتصنيع المواد الخام محليا. وتشمل التحديات والعقبات الأخرى معاناة القطاع العام من ضعف الإدارة وتوقف الاستثمار الحكومي. وبالتالي يخضع&nbsp; سعر الدواء دائما لتقلبات العملة الصعبة.
<h3>قطاع &nbsp;الدواء المصري: المضي قدما</h3>
&nbsp;بشكل عام يعتبر الإطار الحالي لقطاع الدواء جيد، ولكن هناك حاجة لإرادة سياسية لتعزيز القطاع من خلال:
<ul>
<li style="text-align: justify;">تعزيز مصانع الأدوية التابعة للدولة، والاستثمار وضخ الأموال فيها، وضبط السوق.</li>
<li style="text-align: justify;">ولا يزال من المهم أيضا رفع كفاءة هيئة الدواء، الجهة الرقابية الحالية على سوق الدواء من خلال توفير قواعد بيانات ومعلومات تتسم بالشفافية والتحديث حول جميع عناصر تسجيل وتسعير ورقابة الدواء وخطط اﻻستيراد والتصدير، حيث ما زالت بعض الصيدليات تعمل بالنظام الورقي إلى الآن، وأن تكون لهيئة الدواء القدرة على الوصول إلى قواعد بيانات عن الأدوية والمستلزمات الطبية في مستشفيات القطاع الخاص والمخازن والمصانع.</li>
<li style="text-align: justify;">تشجيع انتاج بدائل للأدوية المستوردة، كذلك نشر التوعية بين المواطنين بخصوص موضوع الدواء المثيل/الجنيس حيث يوجد قصور واضح في تعريف المريض المصري بأن الدواء المثيل هو دواء مطابق تماما للدواء الأصلي من حيث التركيب والمفعول وإنما الاختلاف فقط في الشركة المنتجة والمسمى مما يخف الضغط على أدوية بعينها ويؤدى لنقصانها رغم وجود عدد من البدائل لها.</li>
<li style="text-align: justify;">زيادة الإنفاق الحكومي الكافي على الصحة بشكل عام، والاستثمار الحكومي في تصنيع المواد الخام والأدوية التي لا يتم الاستثمار فيها من قبل شركات الدواء الخاصة فيها لضخامة تكلفتها أو مخاطرها، مثل أدوية الأورام.</li>
<li style="text-align: justify;">تحسين الهياكل الأساسية للقطاع من حيث البيروقراطية واتاحة المعلومات من خلال تطبيق ميكنة جميع الصيدليات (ومخازن التوزيع وغيرها من المنشآت الصحية) ، سيضع في البداية عبئًا إضافيًا على الموظفين أو أصحاب الصيدليات. ولكن فور تشغيل النظام، سيواجه الموظفون أعمالًا روتينية وكتابية أقل. ستسهل عملية الميكنة تبادل المعلومات، عن طريق ربط جميع الصيدليات والمستشفيات بنظام إلكتروني مركزي تشرف عليه الجهة الحاكمة على قطاع الدواء (هيئة الدواء المصرية) مما يوفر قدرة أكبر على معرفة نواقص الأدوية أول بأول وتوقع الأزمات.</li>
<li style="text-align: justify;">وضع قائمة للأدوية الأساسية، بعد دراسة الوضع الصحي في البلاد وتحديد الاحتياجات.<a href="#_ftn2" name="_ftnref2">[2]</a>&nbsp;ويُفترض أن تكون الأدوية الأساسية متوافرة في النُظم الصحية بجودة مضمونة وبأسعار يمكن للأفراد والمجتمع تحمّلها.</li>
<li style="text-align: justify;">استخدام التنظيم الذي يوفره القانون الجديد 151/ 2019 بحيث يتم اتخاذ بعض تدابير لضبط استخدام الأدوية وترشيدها في القطاع الخاص. فبحسب منظمة الصحة العالمية يمثل الاستخدام غير الرشيد للأدوية مشكلة كبيرة في جميع أنحاء العالم. وتشير تقديرات المنظمة ا إلى أنه يتم وصف أو صرف أو بيع ما يزيد عن نصف الأدوية على نحو غير ملائم، وأن نصف المرضى لا يتناولون الأدوية على نحو صحيح، ولكن لا تتوافر بيانات كافية لقياس حجم الاستخدام غير الرشيد للدواء في مصر.</li>
<li style="text-align: justify;">تدريب الموظفين في المؤسسات المشرفة على قطاع الدواء، وأن تلتزم هذه المؤسسات بالشفافية والإفصاح عن المعلومات، إعمالا لحق المواطنين في اتاحة المعلومات، وأن تضم هذه المؤسسات أعضاء من المجتمع المدني، حتى يكون هناك مشاركة ورقابة مجتمعية على وضع سياسات واستراتيجيات دوائية تضمن اتاحة الدواء للجميع.</li>

The old regulatory pharmaceutical regulatory framework was fragmented, with regulation of the sector shared by three different agencies: the Central Directorate for Pharmacy Affairs, the National Agency for Pharmaceutical Oversight and Research, and the National Agency for Research and Oversight of Biological Preparations. The absence of a single leading agency responsible for coordination among these three separate bodies resulted in poor regulation and control of the drug market. This made it difficult to control the pharmaceutical sector and also eroded the overall effectiveness of regulation. This article reviews the old regulatory framework of the pharmaceutical sector in Egypt and last year&rsquo;s restructuring of the sector, examining particularly problematic issues with the old framework and the challenges that persist under the new regulating law (Law 151/2019). It proposes interventions to expand government spending on drug manufacturing and shore up the domestic pharmaceutical industry while also encouraging the private sector to gradually begin manufacturing raw materials and drugs that are currently imported. Such interventions could protect access to vital drugs.&nbsp;

Although the upgrade to the regulatory framework is expected to resolve some problems given the advantages of a standardized procurement process and the reorganization of regulatory agencies into one administrative body, challenges persist. Raw materials are still not manufactured locally, for example; there is also a high level of counterfeit drugs on the market, and capacities should be raised at regulatory agencies. The public-sector pharmaceutical industry has a 6% market share, while the private sector accounts for the remaining 94%. According to some estimates, the sector as a whole imports more than 90% of raw and manufactured active ingredients and materials. This is a weakness in the Egyptian drug industry, for it is based on importing raw pharmaceutical products then manufacturing drugs to be sold on the market. Impediments to the importation of raw materials&mdash;a shortage of hard currency or issues with suppliers&mdash;are a major cause of the recurring drug shortages in Egypt and high prices. The old administrative structure and dense bureaucracy complicates matters further, prolonging the process of registration and licensing, as well as securing approval from the Health Ministry to import raw materials and release shipments of raw materials and medications.&nbsp;
Weak regulation is also a challenge for the sector. The level of black-market and counterfeit drugs sold in Egypt constitutes a threat to the legitimate pharmaceutical trade, accounting for approximately 15% of all sales (CAPMAS, 2015).<a href="#_ftn1">[1]</a> Most counterfeit and black-market drugs are sold through medical clinics, via social media, or occasionally in pharmacies given lax regulatory oversight. These problems and the unsatisfactory regulatory framework spurred a restructuring of the drug sector, which was separated from the Ministry of Health and Population to become an independent entity.&nbsp;
<h3>Current Framework of the Sector</h3>
Law 151/2019 established two new agencies: the Egyptian Pharmaceutical Agency and the Egyptian Agency for Standard Medical Procurement and Supply (Manshurat 2019, 2020). A positive step toward regulating the sector, the law clearly identifies the responsibilities of the relevant agencies, ending the previous state of fragmentation. The Egyptian Pharmaceutical Agency supplanted the Central Directorate for Pharmacy Affairs, the National Agency for Pharmaceutical Oversight, and Research, the National Agency for Research and Oversight of Biological Preparations, and other specialized regulatory agencies for medical equipment and preparations. It also took over the function of the Ministry of Health&rsquo;s Pharmaceutical Sector, which was responsible for pharmacy practice under Law 127/1955.
The law gave the Egyptian Agency for Standard Medical Procurement and Supply broad authorities in procurement for the needs of the public health sector. The agency now has exclusive authority over the purchase of medical preparations and supplies for all government bodies and agencies and the development of plans, programs, and rules for standardized domestic and foreign procurement. The goal of creating the Egyptian Pharmaceutical Agency was to reorganize multiple regulatory agencies into a single entity, while the goal of creating a standard procurement agency was to strengthen and enhance opportunities to lower drug prices and take advantage of the benefits of a uniform purchasing process (namely, reducing the cost of pharmaceuticals and medical supplies by purchasing in bulk at lower prices, thereby generating material savings).&nbsp;
The law&rsquo;s implementing regulations create a Supreme Pharmaceutical Committee to be chaired by the prime minister and include the ministers of health and population, planning, higher education and scientific research, and finance, as well as chairs of the boards of the Egyptian Pharmaceutical Agency and the Egyptian Agency for Standard Medical Procurement and Supply and a representative of the Administrative Control Authority. The committee&rsquo;s mandate is to coordinate and monitor the operations of the two new pharmaceutical regulatory agencies.&nbsp;
It is still too early to evaluate the performance of the new agencies. The law&rsquo;s implementing regulations were released on 29 March 2020, and the transition away from the old system is still underway. Certain challenges, however, remain, such as the private sector&rsquo;s continued preference for importing raw materials rather than manufacturing them locally. In addition, the public sector continues to suffer from poor management and lack of government investment. As a result of these obstacles, the price of medicines continue to be subject to fluctuations in hard currency.&nbsp;
<h3>The Egyptian Pharmaceutical Sector: Moving Forward</h3>
Although the current framework for the drug sector is generally good, political will is required to strengthen the sector by:&nbsp;
<ul style="text-align: justify;">
<li aria-level="1">Supporting state-owned drug factories, investing in them, and regulating the market.</li>
<li aria-level="1">Improving the effectiveness of the Egyptian Pharmaceutical Agency, the current regulatory agency for the drug market, by making available databases and up-to-date, transparent information about all aspects of registration, pricing, pharmaceutical oversight, and import and export plans. Some pharmacies continue to be paper-based operations and are not computerized. The drug agency must have the capacity to access databases of pharmaceuticals and medical supplies at private-sector hospitals, warehouses, and factories.&nbsp;</li>
<li aria-level="1">Encouraging the production of alternatives to imported drugs. Public awareness of generics should be increased as well, as patients do not have a clear understanding that generic drugs are identical to their branded peers in composition and effect and differ only in name brand and producer. This would relieve the demand for specific, branded medicines, which leads to shortages despite the availability of generic alternatives.&nbsp;</li>
<li aria-level="1">Increasing government spending on health overall and specifically government investment in the manufacture of certain raw materials and drugs, such as oncology drugs, in which private firms do not invest because of the high cost or risks.&nbsp;</li>
<li aria-level="1">Upgrading basic infrastructure in the sector by eliminating red tape and making information more accessible through the computerization of all pharmacies (as well as distribution warehouses and other health facilities). This would initially place an additional burden on pharmacy owners and employees, but once the shift is made, employees&rsquo; work will be more routine and involve less paperwork. Computerization will also facilitate the exchange of information by linking all pharmacies and hospitals to a central electronic system overseen by the Egyptian Pharmaceutical Agency. In turn, the agency would be better able to identify drug shortages and anticipate emerging crises.&nbsp;</li>
<li aria-level="1">Establishing an Essential Medicines List after a review of the country&rsquo;s health status and needs.<a href="#_ftn2">[2]</a> High quality essential medicines should be available at affordable prices for individuals and society.&nbsp;</li>
<li aria-level="1">Using the regulatory mechanisms offered by Law 151/2019 to take measures to control and rationalize the use of drugs in the private sector. According to the World Health Organization, the irrational use of drugs is a major problem throughout the world. It estimates that more than half of all medications are inappropriately prescribed, administered, or sold and that half of all patients do not take medications as directed. There is not enough data to measure irrational pharmaceutical use in Egypt.</li>
<li aria-level="1">Training staff at the institutions overseeing the drug sector and requiring these institutions to transparently disclose information, thus fulfilling citizens&rsquo; right to information. These institutions should include members of civil society to ensure community participation and oversight in the drafting of drug policies and strategies designed to guarantee everyone&rsquo;s access to medication.&nbsp;</li>
