مع تعاقب أحداث عالمية مختلفة (كوفيد-19 وأزمة مالية والحرب الروسية-الأوكرانية)، يظل واضحا أن الطاقة تلعب دورا رئيسيا في اقتصادات اليوم. وإذ يداهمنا اقتراب مؤتمر الأطراف السابع والعشرين، فإن تغير المناخ بحاجة إلى أن يبقى في صدارة سياسات الطاقة والاقتصاد بالرغم من هذه الأحداث. وأحد الأسباب الداعية إلى ذلك، على وجه الخصوص، هو أن الاستمرار في نهج "العمل كالمعتاد" سيبقى معطلا لتحقيق العدالة في قطاعات الطاقة في المجتمع وفي اقتصاداته. لم تكن العدالة في صدارة سياسات الطاقة والاقتصاد طيلة عقود. وهذه القطاعات بحاجة إلى تجاوز مرحلة التركيز على التنمية الاقتصادية بوصفها الغاية والدافع الرئيسي. وهناك اعتبارات أخرى كثيرة اليوم - مثل أمن الطاقة، وتيسُّر تكلفة الطاقة، والاستثمار في الطاقة، والأثر البيئي، والصحة العامة، والتخفيف من تغير المناخ والتكيف معه - ومن شأن أخذها كلها في الاعتبار تحقيق المزيد من العدالة داخل المجتمع. يستكشف هذا التعليق رحلة المجتمع الاجتماعية-الاقتصادية التي يخوضها مفتقرا التوجيه المطلوب لتحقيق عالم عادل، ومستدام، وصديق للبيئة في مواجهة تغير المناخ. وفي الخاتمة نقدم سياسات رئيسية موصى بها تهدف إلى ضمان تحقيق العدالة في هذه القطاعات والقضايا الحيوية في اقتصاداتنا.
<h3>مقدمة</h3>
مع اندفاع العالم من أزمة إلى أخرى، سوف تتراجع أهمية بعض القضايا لتتلاشى في الخلفية. ويبدو أن هذا هو حال تغير المناخ وإعادة هيكلة نظام الطاقة العالمي. دعت الحكومات والشركات إلى التركيز على إعادة الحيوية إلى النمو الاقتصادي واضعة إياه فوق كل القضايا الأخرى، بل وفوق التخفيف من تغير المناخ والتصدي له. وبعد جائحة كوفيد-١٩، والأزمة الاقتصادية الناجمة عنه، ثم الحرب الروسية-الأوكرانية الحالية، فإن كل هذا صار يهدد بزعزعة الاقتصاد العالمي والاقتصادات الوطنية. وبلغت التحديات الاقتصادية التي تواجه بلدانًا كثيرة درجة خانقة.&nbsp;
وبالرغم من ذلك، فإن لغة التركيز على النمو الاقتصادي فوق كل شيء آخر والتي يرددها خطاب الحكومات والشركات (في أغلبيتها، أي أكثر من 51% منها) هي لغة تخلو من المنطق ويجب ألا نعيرها أسماعنا. فهم يريدون أن تعود حوكمة الاقتصاد إلى طريقة تشغيله التقليدية (أو ما يشار إليه بنهج "العمل كالمعتاد"). غير أن هذا يعني تناسي أن نهج "العمل كالمعتاد" هو ما وضعنا في هذا الموقف.

(Heffron, 2022).
<h3>1. تحسين قطاع الطاقة</h3>
قطاع الطاقة بحاجة إلى إصلاح. والإصلاح، بطريقة وأكثر، يجري بالفعل، مع قدوم الانتقال في الطاقة وهي مرحلة يتحول فيها من الاعتماد على مصادر الطاقة التقليدية إلى مصادر الطاقة منخفضة الكربون. والحجة التي يقدمها صانعو السياسات هي أن المجتمع من أجل أن يحافظ على التنافسية الاقتصادية، في ضوء ما لا أول له ولا آخر من الأزمات التي أخذ العالم يواجهها، يحتاج إلى إبطاء هذا الانتقال في مجال الطاقة لأن تكاليفه آخذة في تجاوز حدود المحتمل. وهم يريدون العودة إلى الاعتماد على النفط والغاز والفحم لتمكيننا من الحصول على طاقة رخيصة لدفع عجلة الاقتصاد.
هذه الحكمة القديمة عن الطاقة عفا عليها الزمن لشتى الأسباب. فقد كان هذا الاعتماد المفرط على مصادر الطاقة التقليدية هو ما أسفر عن المأزق الحالي. والمجتمع حين يستثمر عليه أن ينوع استثماراته. والمجتمعات في أنحاء العالم لم تفعل ذلك منذ زمن طويل، وأمام قضية التنويع في قطاع الطاقة التزمت بموقف "دعه يعمل" (أو "حرية" العمل). واليوم، فإن الخيارات موجودة، وهي تصبح أرخص بكثير بمرور الوقت (وهذا ينطبق بشكل أساسي على طاقة الرياح والطاقة الشمسية).

إحدى الفوائد الكبيرة للاستثمار في تكنولوجيا الطاقة منخفضة الكربون واستعمالها تتمثل في تحسُّن يطرأ على الأداء الاجتماعي-الاقتصادي. ويكون هذا في الجانب الأكبر من خلال العدد المتزايد من أشكال تحقُّق العدالة في المجتمع نتيجة لذلك. تتعلق بعض الأمثلة الواضحة على هذا بزيادة الوظائف. فالاستثمار في تكنولوجيا جديدة يخلق فرص عمل على الأخص عندما تتجه مصادر الطاقة التقليدية نحو أتمتة عملياتها ما يؤدي إلى انخفاض التشغيل.&nbsp;

</ul>
<h3>3.الخلاصة وضمان انتقال عادل إلى اقتصاد منخفض الكربون</h3>
في المجمل، يتمثل هدف رئيسي لضمان اقتصاد منخفض الكربون في أن تكون العدالة حجر الزاوية لهذا الانتقال. وهناك مبادرات سياسة لتحقيق انتقال عادل في المجتمع تتطور وتنمو عبر بلدان مختلفة في أنحاء العالم. ومن الواضح أن الانتقال العادل قد تجاوز حدوده الأصلية الخاصة باستكشاف القضايا المتعلقة بالعمالة، وصارت له الآن غايات أوسع بكثير تتمثل في ضمان أن ينتقل المجتمع بأسره عبر طريق عادل نحو اقتصاد منخفض الكربون. الطاقة في صميم هذه العملية ولهذا السبب نحتاج إلى تحقيق العدالة في قطاع الطاقة وفي الاقتصاد الأوسع.
أحد الأسباب الرئيسية الداعية للتركيز على العدالة هو تعيُّن تأسيس قانون جديد لتحقيق تلك العدالة. القانون جوهري في عملية الانتقال العادل إلى اقتصاد منخفض الكربون. يضع القانون قواعد "اللعبة" التي يسير وفقا لها المجتمع. وإذا كان للبلدان أن تحل مسألة الطوارئ المناخية وتضمن تلبيتها لأهداف 2030 المتعلقة بالطاقة والمناخ في اتفاقية باريس لعام 2015، فمما له أهمية حيوية استحداث أو تحديث المؤسسات والأطراف المعنية والخطط والسياسات. يلعب القانون دوره هنا لضمان أن تكون الأدوار الجديدة للمؤسسات والأطراف المعنية معرَّفة (أو يعيد تعريفها). ثم يتعين التشريع لجميع الخطط والسياسات وإدخالها في التشريعات العامة.&nbsp;
أحد الأدوار الحيوية للقانون في الانتقال العادل هو قدرته على حفز الاستثمار المطلوب لضمان انتقال عادل إلى اقتصاد منخفض الكربون. يحتاج المستثمرون إلى ثقة قانونية في استثمارهم، أي يحتاجون إلى التأكد من حصولهم على الوقت الكافي لاسترداد عائد لاستثمارهم. سوف يعاين المستثمر البلد ليرى كيف تتهيأ لتحقيق انتقال عادل إلى اقتصاد منخفض الكربون. وسوف يستكشف كيف تتناغم المؤسسات والسياسات ومن ثم إذا ما كان البلد يمثل استثمارا جيدا من منظور انتقالي عادل؛ هذا النوع من التحليل قدمه بنك كبير متعدد الجنسيات لمستثمريه في أواخر 2018 مشيرا عليهم بكيف ينبغي عليهم النظر في حالات البلدان النامية وتحركاتها نحو انتقال عادل (HSBC, 2018). يجب أيضًا أن يستهدف الاستثمار التعليم ، حيث لا يزال التحول في التركيز من الوقود الأحفوري إلى انتقال الطاقة العادل بحاجة إلى أن يحدث على مستوى الجامعات (Heffron &amp; Foley ، 2022).

<h3>Introduction</h3>
With different world events (COVID-19, a financial crisis and the Russia-Ukraine war) happening in quick succession it continues to be clear that energy plays a key role in economies today. With COP27 looming, climate change action needs to remain at the forefront of energy and economic policy despite these events. One particular reason why is that continuing a business-as-usual approach will continue to be detrimental to restoring justice in society&rsquo;s energy sectors and economies. Justice has not been at the forefront of energy and economic policy for decades. These sectors need to move on from a focus on economic development as a key purpose and motivation. There are many other considerations today - such as energy security, energy affordability, energy investment, environmental impact, public health and climate change mitigation and adaptation &ndash; all of which will increase justice within society. This commentary explores the socio-economic journey that society is on and how currently it lacks the direction needed to deliver a just, sustainable and climate friendly world. Key policy recommendations are then advanced that aim to ensure that justice is restored to these key sectors and issues in our economies.
<h3>1. Introduction</h3>
As the world careers from one crisis to the next the importance of some issues will fade into the background. It seems this is the case with climate change and the restructuring of the global energy system. Governments and companies have called for a focus on rejuvenating economic growth over all other issues, notably on addressing climate change mitigation. COVID-19, the resulting economic crisis and now the Russia-Ukraine war, all threaten to destabilise the global economy and national economies. The economic challenges facing many countries are stifling.&nbsp;
Nevertheless, this rhetoric of focusing on economic growth over all else that is heard by governments and companies (in the majority, i.e., greater than 51% of them) should be ignored. There is no logic to it. They want the governance and the management of the economy to return to its traditional mode-of-operation (or what is referred to as the business-as-usual approach). However, this is forgetting that it is this business-as-usual approach which has placed us in this situation.
For too long economies have been encouraged to operate in a particular way. Alongside this, oil, gas and coal have become established as the engine of the economy. Economically, society has become more unequal than ever with income disparity reaching new levels of inequality (Piketty, 2015; Chancel and Piketty, 2015). In terms of energy, these traditional energy sources are the main cause of the rise in greenhouse gas emissions (and specifically carbon dioxide) which are causing visible climate change impacts across the world. Governance even within the energy sector is in need of a revolution (Heffron, 2022).&nbsp;
<h3>2. Improving the Energy Sector</h3>
The energy sector needs reform. In many ways, this reform is underway already with the advent of the energy transition from relying on traditional energy sources to low-carbon energy sources. In light of the myriad of crises that the world has faced, in order to remain economically competitive, the argument advanced by many national policymakers post the breakout of the Russia-Ukraine war is that society needs to slow down on this energy transition as it is costing too much money. They want a maintenance of the status quo in relying on oil, gas and coal to enable us to have cheap energy to fuel the economy.
This traditional &lsquo;energy mantra&rsquo; is outdated for a variety of reasons. It overlooks how the over-reliance on traditional energy sources has resulted in our current predicament in terms of climate change. When society makes investments it should diversify them. For too long societies worldwide did not, and had a laissez-faire attitude to diversification in the energy sector. Today, the options are available and becoming significantly cheaper over time (this applies primarily to wind and solar energy).
This is not only about supporting these increasingly cheaper energy sources, but also about economic diversification and the spread of new technology across countries and societies. In essence, this is about a technology race too. Further and very importantly this new technology does not come with the massive un-costed externality of carbon dioxide and its impacts. Indeed, it brings many positives and paramount to those is justice. This low-carbon energy brings more justice throughout the economy and society (Heffron and McCauley, 2017).
<h3>3.Improving Socio-Economic Performance through the Energy Sector</h3>
One of the significant benefits of investing in and utilising low-carbon energy technology is an improvement in socio-economic performance. This is primarily through the increased number of justice outcomes in society as a result. Some clear examples of this are in relation to the increase in jobs. Investing in a new low-carbon energy technology creates employment especially when the traditional energy sources move towards automation of their processes and resulting reduction in employment.&nbsp;
&nbsp;Secondly, there are major savings to the health of a nation due to the using these low-carbon energy sources. The negative effect of carbon dioxide on populations is well documented in research (Figueres et al., 2017). Further, what is clear is the massive increase in evidence related to the cost on public health systems in relation to carbon dioxide (Bressler, 2021). This can all be avoided with the transition to a low-carbon economy. Further health benefits resulting from the use of low-carbon energy include clean water, more sustainable cities and healthy children.
A final and most important issue in delivering improved socio-economic performance itself is the justice impacts of low-carbon energy. This new, cleaner and more mobile technology (i.e., rooftop solar, batteries etc.) ensures a fairer society. There are improvements in different forms of justice, such as distributive, procedural, restorative, recognition and cosmopolitan (Heffron, 2021b). Below is a brief elaboration on two of these forms:

<li style="text-align: justify;" aria-level="1">Distributive Justice &ndash; low-carbon energy sources and in particular solar energy can result in a fairer distribution of resources in the energy sector. This has a related effect on socio-economic issues as energy becomes more affordable and accessible.&nbsp;</li>
<li style="text-align: justify;" aria-level="1">Cosmopolitan Justice &ndash; low-carbon energy production can reduce carbon dioxide emissions, and generally low-income and/or small-island developing states will suffer less from the negative consequences of such emissions, such as coastal erosion. Hence, developing low-carbon energy resources is of benefit globally and not just to one nation.&nbsp;&nbsp;</li>
</ul>
<h3>4.Conclusion &amp; Ensuring a Just Transition to a Low-Carbon Economy</h3>
Overall, a key aim of ensuring a low-carbon economy is that the transitional process should have justice at its cornerstone. Policy initiatives developed to achieve a just transition in society are growing across different countries worldwide. It is clear that the just transition movement has progressed beyond its origins in exploring labour issues, and now has the far broader goal of ensuring that all of society moves towards a just and low-carbon economy. Energy is at the core of this, and that is why we need to restore justice to the energy sector and the wider economy.
One of the key reasons to focus on justice is because this means we must establish new laws to achieve justice. Law is fundamental to the process of a just transition to a low-carbon economy, as it establishes the rules of the &lsquo;game&rsquo; by which society operates. If countries are to solve the climate emergency issue and ensure that they meet the 2015 Paris Agreement energy and climate targets of 2030, it is vital that institutions, stakeholders, plans and policies are all well-established and updated. Law plays its role here to ensure that the new roles of institutions and stakeholders are defined (or redefined).
A vital role of law in the just transition is that it can stimulate the investment needed to ensure a just transition to a low-carbon economy. Investors need legal certainty in their investment, i.e., they need to be assured that they will have sufficient time to recoup a return on their investment. An investor will look at a country through how they set out to achieve a just transition to a low-carbon economy. They will explore how institutions and policies are aligned and therefore whether a country represents a good investment from a just transition perspective. This type of analysis was provided in late 2018 by one major multinational bank for its investors and how they should consider developing countries and their moves towards a just transition (HSBC, 2018). Investment also needs to be targeted at education, where a shift in focus from fossil fuels to energy transition still needs to happen at university levels (Heffron &amp; Foley, 2022).
Legislating for the just transition is vital to secure this investment. In considering the climate emergency &ndash; consider the flash floods in 2021 in Germany, China and the UK being attributed to climate change and the 2022 heat waves across the world - coupled with the economic crisis and pandemic there is a need for the just transition evolution to become more revolutionary.&nbsp;
