<a href="https://www.elwatannews.com/news/details/6728992">وافق </a>مجلس الوزراء، على مشروع قانون الرقم القومي الموحد للعقارات شهر أغسطس الماضي. ويهدف مشروع القانون المتوقع إلى أن تتم مناقشته <a href="https://www.gomhuriaonline.com/Gomhuria/1316907.html">في الدورة البرلمانية الحالية</a> لإنشاء قاعدة بيانات قومية إلكترونية للعقارات تتكون من رقم موحد لكل عقار، وذلك في إطار حصر الثروة العقارية لزيادة حصيلة الضريبة عليها. تصل قيمة الثروة العقارية في مصر إلى <a href="https://masrafeyoun.ebi.gov.eg/2023/07/29/%D8%A7%D9%84%D8%AB%D8%B1%D9%88%D8%A9-%D8%A7%D9%84%D8%B9%D9%82%D8%A7%D8%B1%D9%8A%D8%A9-%D8%A7%D9%84%D9%85%D8%B5%D8%B1%D9%8A%D8%A9-%D9%88%D8%B3%D8%A8%D9%84-%D8%A7%D9%84%D8%AA%D8%B7%D9%88%D9%8A%D8%B1/">10</a> تريليونات <a href="https://www.parlmany.com/News/13/519269/%D8%A3%D8%AD%D9%85%D8%AF-%D8%B9%D8%A8%D8%AF-%D8%A7%D9%84%D9%84%D9%87-%D8%AD%D8%AC%D9%85-%D8%A7%D9%84%D8%AB%D8%B1%D9%88%D8%A9-%D8%A7%D9%84%D8%B9%D9%82%D8%A7%D8%B1%D9%8A%D8%A9-%D9%81%D9%8A-%D9%85%D8%B5%D8%B1-10-%D8%AA%D8%B1%D9%8A%D9%84%D9%8A%D9%88%D9%86">جنيه</a> على أقل تقدير لها، في حين بلغ المتوسط السنوي من حصيلة الضريبة العقارية في العشر سنوات الأخيرة 3 مليارات جنيه فقط - وفقًا لحسابات "عدسة". وتعد الضريبة العقارية أحد أشكال <a href="https://aps.aucegypt.edu/ar/articles/495/policy-paper-towards-a-wealth-tax-in-egypt">&nbsp;الضرائب على الثروة</a> ومؤشرًا على <a href="https://aps.aucegypt.edu/ar/articles/484/video-x-and-y-story-with-taxes">عدالة&nbsp; توزيع&nbsp; العبء الضريبي</a>، لو تناسبت حصيلتها وحجم الثروة العقارية.

<h3 dir="rtl">لماذا نهتم بالضريبة العقارية؟</h3>
تمثل الضرائب نحو <a href="https://www.mubasher.info/news/4150514/%D8%A7%D9%84%D9%85%D8%A7%D9%84%D9%8A%D8%A9-%D8%A7%D9%84%D9%85%D8%B5%D8%B1%D9%8A%D8%A9-%D8%A7%D9%84%D8%B6%D8%B1%D8%A7%D8%A6%D8%A8-%D8%A3%D8%B5%D8%A8%D8%AD%D8%AA-%D8%AA%D9%85%D8%AB%D9%84-71-%D9%81%D9%82%D8%B7-%D9%85%D9%86-%D8%A5%D9%8A%D8%B1%D8%A7%D8%AF%D8%A7%D8%AA-%D8%A7%D9%84%D8%AF%D9%88%D9%84%D8%A9/">71% من إجمالي</a> الإيرادات العامة للدولة. تعد حصيلة الضريبة العقارية من أضعف البنود، وبالتالي فإنها تحرم الموازنة من إيرادات للإنفاق العام، وتخلق عبئًا على مصادر تمويل أخرى، كما تمثل خللًا في عدالة توزيع الأعباء الضريبية.&nbsp;
وتُفرَض الضريبة العقارية على ملكية العقار بشكل مباشر وليس لها علاقة بأية حركات بيع أو تأجير تتم عليه، إذ تخضع الأخيرة لأنواع أخرى من ضرائب الدخل، ولذا فهي بشكل عام من الضروري أن تتناسب مع حجم الثروة. وتزيد أهميتها في مصر حيث يسعى أصحاب الثروات إلى تجميدها في صورة عقارات للحفاظ على قيمتها، خاصة في ظل ارتفاع معدلات التضخم وانخفاض قيمة العملة.
تخضع الثروة العقارية لثلاثة أنواع رئيسية من الضرائب: "الضريبة العقارية" و"ضريبة التصرفات العقارية" و"ضريبة الإيرادات من الثروة العقارية".

مقارنة حصيلة الضريبة العقارية بحصيلة الضرائب على الدخول من التوظيف والتي تُخصم مباشرة من المنبع، تكشف عن مدى غياب عدالة توزيع العبء الضريبي.&nbsp;

ورغم أنّ الضرائب على الدخول تشمل صغار الموظفين وأصحاب الدخول الضعيفة، إلا أن المبلغ المعفى كان&nbsp;<a href="https://beta.sis.gov.eg/ar/%D8%A7%D9%84%D9%85%D8%B1%D9%83%D8%B2-%D8%A7%D9%84%D8%A5%D8%B9%D9%84%D8%A7%D9%85%D9%8A/%D8%A7%D9%84%D8%A3%D8%AE%D8%A8%D8%A7%D8%B1/%D8%A7%D9%84%D8%B1%D8%A6%D9%8A%D8%B3-%D8%A7%D9%84%D8%B3%D9%8A%D8%B3%D9%8A-%D9%8A%D9%88%D8%AC%D9%87-%D8%A7%D9%84%D8%AD%D9%83%D9%88%D9%85%D8%A9-%D8%A8%D8%B2%D9%8A%D8%A7%D8%AF%D8%A9-%D8%AD%D8%AF-%D8%A7%D9%84%D8%A5%D8%B9%D9%81%D8%A7%D8%A1-%D8%A7%D9%84%D8%B6%D8%B1%D9%8A%D8%A8%D9%8A-%D8%B9%D9%84%D9%89-%D8%A7%D9%84%D8%AF%D8%AE%D9%84/">24 ألفًا، وتمت زيادته إلى</a> <a href="https://akhbarelyom.com/news/newdetails/4193778/1/%D8%A8%D9%82%D8%B1%D8%A7%D8%B1-%D8%A7%D9%84%D8%B1%D8%A6%D9%8A%D8%B3-%D8%A8%D8%B1%D9%81%D8%B9-%D8%AD%D8%AF-%D8%A7%D9%84%D8%A5%D8%B9%D9%81%D8%A7%D8%A1-%D8%A7%D9%84%D8%B6%D8%B1%D9%8A%D8%A8%D9%8A-%D9%84%D9%804">36 ألفًا</a> في مايو 2023، ثم <a href="https://akhbarelyom.com/news/newdetails/4193778/1/%D8%A8%D9%82%D8%B1%D8%A7%D8%B1-%D8%A7%D9%84%D8%B1%D8%A6%D9%8A%D8%B3-%D8%A8%D8%B1%D9%81%D8%B9-%D8%AD%D8%AF-%D8%A7%D9%84%D8%A5%D8%B9%D9%81%D8%A7%D8%A1-%D8%A7%D9%84%D8%B6%D8%B1%D9%8A%D8%A8%D9%8A-%D9%84%D9%804">45 ألفًا في</a> سبتمبر من نفس العام، في حين أن حد الإعفاء على المسكن الخاص الأول يبلغ 2 مليون جنيه.

<h3 dir="rtl">ثروة كبيرة في مقابل ضرائب قليلة</h3>
بالرغم من النمو في حصيلة الضريبة العقارية منذ تطبيق القانون في منتصف 2013 فإنه مقارنة بحجم زيادة الثروة العقارية سواء من حيث القيمة السوقية أو عدد العقارات - يكشف بعدًا آخر لغياب عدالة توزيع العبء الضريبي على أصحاب الثروات. حيث شهدت الثروة العقارية زيادة بلغت 107% في عدد الوحدات (سكني/إداري) خلال الفترة من 2006 إلى 2021 بحسب <a href="https://censusinfo.capmas.gov.eg/Metadata-ar-v4.2/index.php/catalog/1723">بيانات الجهاز المركزي للتعبئة العامة والإحصاء</a> وتصريحات أنور فراج، مستشار رئيس مصلحة الضرائب العقارية لـ"عدسة" حيث بلغ عدد الوحدات 58 مليون وحدة في 2021 مقارنة بـ 27.9 مليون وحدة&nbsp; في 2006.&nbsp;

كما كشفت بيانات مشروع حصر الثروة العقارية المميكن 2008- 2018 (غير منشورة)، التي حصلت "عدسة" على نسخة منها، عن نمو التوسعات في 13 منطقة من مناطق الإسكان الفاخر والسياحي، مثل: برج العرب والشيخ زايد، ساحل العين السخنة، الجونة، القاهرة الجديدة، مدينة شرم الشيخ، وقرى الساحل الشمالي بمتوسط %239.5.&nbsp;
<h3 dir="rtl">أسباب غياب العدالة في توزيع العبء الضريبي على أصحاب الثروة العقارية&nbsp;</h3>
هناك أسباب متعددة لضعف الحصيلة الضريبية بشكل عام، من ضمنها: عدم ثقة وقناعة المواطن بفائدة الضرائب وأوجه إنفاقها، وغياب الشفافية والعدالة في تطبيقها. وفي حالة الضرائب العقارية هناك ثلاثة أسباب رئيسية وراء عدم تناسبها مع حجم الثروة الموجودة:

1. عدم حصر الثروة العقارية حصرًا كاملًا
أكد مصدر سابق بمصلحة الضرائب العقارية على أنه بالرغم من أن عملية حصر الثروة العقارية بدأت بشكل تمهيدي عام 2008 وتم حتى 2021 حصر 58 مليون عقار، فإنه لا تزال هناك مناطق غير محصورة، لافتًا إلى أن أغلب التوسعات التي تمت في الخمس سنوات الأخيرة لم يتم حصرها، وهو الأمر الذي أكده أنور فراج مستشار رئيس المصلحة، قائلًا: "الثروة العقارية غير محصورة بنسبة 100%".
وأرجع المصدر السابق بالمصلحة عدم شمولية الحصر لكامل الثروة العقارية إلى عدم كفاية الموارد البشرية، ولأن العملية غير مميكنة، بالإضافة إلى البيروقراطية وعدم تكامل الجهود المؤسسية. ففي الوقت الذي كلفت به إحدى الجهات السيادية مجموعة عمل للقيام بحصر مميكن عام 2008، بدأت مصلحة الضرائب العقارية في عمل حصر ميداني موازٍ. وبحسب خالد دربالة استشاري التحول الرقمي الذي شارك في مجموعة العمل، فإن النتائج والدراسات التي انتهى إليها مشروع الحصر المميكن لم تتم الاستعانة بها وتم وقفه بعد 10 سنوات عمل، بينما استكملت المصلحة حصرها الميداني الذي يفتقر إلى الشمولية بحسب "دربالة".
2. عدم عدالة تقديرات القيم السوقية/القيم الإيجارية للثروة العقارية&nbsp;
تقوم لجان الحصر والتقييم بتقدير القيم السوقية للعقارات بشكل جزافي (أعلى أو أقل) وهو ما يُحدِث خللًا في الوعاء الضريبي وبالتالي الحصيلة. ومشكلات التقدير الجزافي تنتج من تفكيك وحدة قياس أسعار السوق -بحسب المصدر السابق- وتجميد مهمتها والتي تركزت في عمل قائمة استرشادية بأسعار العقارات للجان الحصر والتقدير. بالإضافة إلى ذلك تم تأجيل التقدير الخَمسي وهو إعادة تقدير القيم السوقية للعقارات المحصورة كل 5 سنوات لمراعاة أثر التضخم في زيادة قيمتها، بما لا يتجاوز 30% من التقديرات السابقة بالنسبة إلى العقارات السكنية.
3. عدم تفعيل المواد العقابية لجريمة التهرب الضريبي المنصوص عليها في القانون
ينص قانون الضرائب على العقارات المبنية رقم 196 لسنة 2008، على تغريم المتهربين من أداء الضريبة، ولكن مستشار مصلحة الضرائب العقارية يقول إن: العُرف جرى على عدم تفعيل المواد العقابية في القانون نظرًا إلى كثرة عدد الممولين المتهربين. ومن المفهوم ازدياد معدلات التهرب في ظل عدم وجود منظومة متكاملة تقوم على العدالة والثقة بين المواطنين والجهاز الضريبي ككل.
<h3 dir="rtl">ما العمل؟</h3>
<a href="https://almalnews.com/%d9%8a%d8%b3%d8%a7%d8%b9%d8%af-%d8%b9%d9%84%d9%89-%d8%ad%d8%b5%d8%b1-%d8%a7%d9%84%d8%ab%d8%b1%d9%88%d8%a9-%d8%a7%d9%84%d8%b9%d9%82%d8%a7%d8%b1%d9%8a%d8%a9-%d8%a8%d8%b1%d9%84%d9%85%d8%a7%d9%86%d9%8a/">يتفق</a> خبراء الضرائب على أن قانون الرقم القومي الموحد للعقارات إذا تم تفعيله، فسيحل مشكلات حصر وتسجيل العقارات في السجل العيني عن طريق إنشاء قاعدة بيانات حقيقية للثروة العقارية يتم علي أساسها تحديد الوعاء الضريبي والمطالبة به.
فإن كان الرقم القومي الموحد قد ينجح في حصر الثروة العقارية، فإنه غير كافٍ لحل مشكلة ضعف الحصيلة، حيث أنه من الضروري أن يتبعه تقييم عادل للقيم السوقية للثروة العقارية، وهو ما يتطلب ميكنة عمليات التقييم من خلال استخدام البرامج التقنية المختلفة لتسجيل القيم السوقية للعقارات وقت الحصر واستخدامها في إعادة التقييم الخَمسي (كل 5 سنوات)، وحساب معدل الزيادة وفقًا لمعدلات التضخم، وبالتالي يتم حساب الزيادة في قيمة الضريبة بناءً علي هذا التقييم، وهو ما يمنع التقديرات الجزافية والتلاعب في القيم السوقية للعقارات.
كما سيتطلب استكمال المنظومة الضريبية توفير خرائط مُحدَّثة لتسهيل حصر التوسعات وتأهيل القوى البشرية القائمة على استخدام التكنولوجيا في عمليات الحصر والتقييم وكذلك التحصيل. وأخيرًا، تفعيل المواد العقابية بالقانون لمنع التهرب.

The Cabinet <a href="https://www.elwatannews.com/news/details/6728992">approved</a> the draft law on a national real estate number last August, which is slated to be discussed in the <a href="https://www.gomhuriaonline.com/Gomhuria/1316907.html">coming parliamentary session</a>. The law would establish a national electronic real estate database that assigns a unique number to each property, creating an inventory of&nbsp; the country&rsquo;s real estate stock to increase tax revenues. Property tax is one form of <a href="https://aps.aucegypt.edu/en/articles/495/policy-paper-towards-a-wealth-tax-in-egypt">wealth tax</a> and an indicator of <a href="https://aps.aucegypt.edu/en/articles/484/video-x-and-y-story-with-taxes">how fairly the tax burden is distributed</a>.

<h3 dir="ltr">Why do we care about property taxes?</h3>
Taxes account for about <a href="https://www.mubasher.info/news/4150514/%D8%A7%D9%84%D9%85%D8%A7%D9%84%D9%8A%D8%A9-%D8%A7%D9%84%D9%85%D8%B5%D8%B1%D9%8A%D8%A9-%D8%A7%D9%84%D8%B6%D8%B1%D8%A7%D8%A6%D8%A8-%D8%A3%D8%B5%D8%A8%D8%AD%D8%AA-%D8%AA%D9%85%D8%AB%D9%84-71-%D9%81%D9%82%D8%B7-%D9%85%D9%86-%D8%A5%D9%8A%D8%B1%D8%A7%D8%AF%D8%A7%D8%AA-%D8%A7%D9%84%D8%AF%D9%88%D9%84%D8%A9/">71%</a> of total budget revenues. Poor tax proceeds from property owners deprives the budget of much needed funds for public spending while displacing the burden on to other taxpayers, giving rise to inequitable taxation. The real estate tax is levied directly on property owners and has nothing to do with sale or rental transactions, which are subject to other types of taxes and are therefore generally proportional to the taxpayers&rsquo; wealth. Property tax is particularly important in Egypt, where wealth holders typically seek to invest their wealth in real estate to preserve its value, especially given high inflation and the devaluation of the Egyptian pound.
Real estate wealth is subject to three main kinds of taxes: property tax, a real estate transaction tax, and a tax on revenues earned from real estate.

A comparison of revenues from property taxes with revenues from taxes on employment income, which are deducted directly from workers&rsquo; pay, demonstrates how unfairly the tax burden is distributed.&nbsp;

Moreover, every worker at all wage levels is subject to income tax. <h3 dir="ltr">Great wealth, meager tax revenue</h3>
Although property tax revenues have increased since the real estate tax law was enacted in mid-2013, an examination of the increase in real estate wealth, whether in terms of market value or the number of properties, reveals another dimension of the disproportionately low taxation of wealth holders. Measured by the number of units (residential and administrative), total property wealth increased by 207% from 2006 to 2021, according to <a href="https://censusinfo.capmas.gov.eg/Metadata-ar-v4.2/index.php/catalog/1723">data</a> from the Central Agency for Public Mobilization and Statistics (CAPMAS) and statements made to Adasa by Anwar Farag, advisor to the head of the Real Estate Tax Authority, from 27.9 million units in 2006 to 58 million units in 2021.

<h3 dir="ltr">Reasons for unfair distribution of the tax burden on property owners</h3>
Tax revenues in general are low for several reasons, including citizens&rsquo; lack of confidence in the benefit of taxes and the expenditure they fund, and the lack of transparency and fairness in their application. In the case of property taxes, revenues are disproportionately low for three main reasons.
1. Incomplete inventory of real estate stock
A source formerly with the Real Estate Tax Authority said that although the process of cataloguing Egypt&rsquo;s property stock began in 2008 and 58 million properties were mapped as of 2021, there are still areas that have not been inventoried. For example, most new real estate developments in the last five years have not been counted, which was confirmed by Anwar Farag, who said, &ldquo;Real estate wealth has not been inventoried 100%.&rdquo;
The source formerly with the authority said that the inventory of all the country&rsquo;s property stock had not been completed due to insufficient human resources and because the process is not automated, in addition to bureaucracy and the lack of integrated institutional efforts. While one sovereign body tasked a working group to conduct an automated inventory in 2008, the Real Estate Tax Authority began to carry out a parallel field inventory. According to Khaled Derbala, a digitization consultant who participated in the working group, the results and research of the automated inventory project were not used and the project was discontinued after ten years of work, while the authority continued its field inventory, which Derbala says is not comprehensive.
2. Unfair assessment of the market/rental value of real estate
Inventory and valuation committees estimate the market value of property arbitrarily (either too high or too low), which distorts the tax base and thus tax proceeds. The root of the problem, according to the source formerly with the authority, is that the unit in charge of market price estimation, which compiled price guidelines for the inventory and valuation committees, was dismantled and its mandate frozen. In addition, the five-year estimate, which is a recalculation of the market value of inventoried properties every five years to take into account increases due to inflation, was postponed (for residential properties, the recalculated value cannot exceed the previous estimate by more than 30%).
3. Lack of accountability for tax evaders
Law 196/2008 on real estate taxes provides for fines for tax evaders, but the advisor to the Real Estate Tax Authority says that customarily this provision has not been applied due to the large number of tax evaders. Tax evasion has naturally increased in the absence of an integrated system based on justice and trust between citizens and the tax system as a whole.

Tax experts <a href="https://almalnews.com/%d9%8a%d8%b3%d8%a7%d8%b9%d8%af-%d8%b9%d9%84%d9%89-%d8%ad%d8%b5%d8%b1-%d8%a7%d9%84%d8%ab%d8%b1%d9%88%d8%a9-%d8%a7%d9%84%d8%b9%d9%82%d8%a7%d8%b1%d9%8a%d8%a9-%d8%a8%d8%b1%d9%84%d9%85%d8%a7%d9%86%d9%8a/">agree</a> that the law on a national number for real estate properties, if enacted, would solve the problems of cataloguing and registering real estate by creating a database that could be used to determine the actual tax base and amount due. But this will not solve the problem of low tax proceeds. For this, a fair assessment of property market values is needed. The valuation process should be automated using various technical programs to record the market value of a property at the time it is catalogued, and this value should be the baseline for the five-year reassessment that takes inflation into account. This would prevent arbitrary valuations and the manipulation of the market value of properties. A well-oil, integrated tax system also requires updated maps to facilitate the inventory of the country&rsquo;s growing property stock and training for the staff in the technology used for inventory and evaluation, as well as tax collection. Finally, the punitive measures in the law should be applied to deter tax evasion.
