تعول الحكومة المصرية على دور المشروعات الصغيرة ومتناهية الصغر في خلق فرص عمل، ويعد جهاز تنمية المشروعات المتوسطة والصغيرة ومتناهية الصغر هو الجهاز المنوط بذلك وفقا لقرار تأسيسه رقــم 947 لسنـة 2017 والمعـدل بالقــرار رقم 2370 لسنة 2018 (منصة المشروعات الصغيرة، غير مؤرخ).&nbsp;
وعلى الرغم من ذلك، هناك جهات حكومية أخرى معنية بذلك&nbsp; مثل برامح وزارة التضامن الاجتماعي للتمكين الاقتصادي مثل فرصة ومستورة وغيرها. وقد تجاوزت مهمة الجهاز تنمية &nbsp;المشروعات المتوسطة والصغيرة ومتناهية الصغر وريادة الأعمال&nbsp; إلى القيام بتنسيق وتوحيد جهود كافة الجهات المعنية والجمعيات الأهلية والمبادرات العاملة في هذا المجال، مما يجعله المسئول الأخير عن كل الجهات المعنية بإنشاء وتمويل المشروعات الصغيرة ومتناهية الصغر في مصر.
السؤال الأساسي الذي يسعى هذا المقال للإجابة عليه: هل المشروعات الصغيرة ومتناهية الصغر سواء الممولة من قبل الجهاز أو من قبل جهات أخرى سواء حكومية أو جمعيات أهلية خاضعة لهيئة الرقابة المالية توفر فرص عمل ذات جودة ويمكن اعتبارها لائقة؟&nbsp; وهل تتضمن الأطر المؤسسية والقانونية المعنية بتنظيم هذه النوعية من المشروعات الحق في الحماية الاجتماعية وبالتحديد اشتراط ضرورة الانضمام للتأمينات الاجتماعية؟
تتعدد شروط العمل اللائق والذي يتمتع بجودة حيث تشمل الرسمية والانتظام وضمان عائد مادي ملائم والعمل بعقد والحماية الاجتماعية التأمينية والصحية وغيرها من الشروط.&nbsp; من الصعب دراسة هذه القضية بمعزل عن قضية القطاع غير الرسمي في مصر، فالقطاع غير الرسمي هو الإطار الأوسع للإشكالية محل الدراسة، كما أن أكثر من نصف المشروعات الصغيرة والمتوسطة تقع في إطار هذا القطاع.&nbsp;
<h3 style="text-align: justify;">ملامح القطاع غير الرسمي في مصر:&nbsp; تقاطع اللارسمية مع الفقر</h3>
أكدت كثير من المسوح والدراسات أن فرص العمل اللائق تتراجع في مصر بشكل كبير، حيث يتسع القطاع غير الرسمي سواء على مستوى المنشآت أو المشتغلين. يشير التعداد الاقتصادي إلى أن عدد المنشآت العاملة في القطاع غير الرسمي بلغ 2 مليون منشأة من إجمالي 3.7 مليون منشأة، أى&nbsp; بنسبة 54% من إجمالي المنشآت العاملة في مصر عام 2017/2018، وهي في معظمها منشآت صغيرة ومتناهية الصغر؛ حيث تصل نسبة المنشآت التي يبلغ رأس مالها المستثمر أقل من&nbsp; 100 ألف جنيه نحو 81% من الإجمالي، تليها المنشآت الأقل من 200 ألف جنيه، وأكثر من 100 ألف بنسبة %18 . كما أن نسبة المنشآت التي يعمل بها أقل من 5 أشخاص تصل إلى 96%&nbsp; من الإجمالي.&nbsp; وعلى الجانب الآخر، يشير بحث القوى العاملة إلى أن نسبة المشتغلين خارج المنشآت تصل إلى 44%&nbsp; من إجمالي المشتغلين عام 2020، مقابل نحو 35% لدى القطاع الخاص المنظم، ونحو 21% في القطاع الحكومي وقطاع الأعمال العام، وبذلك تكون نسبة المشتغلين في القطاع غير الرسمي هي الأعلى في سوق العمل، وترتفع هذه النسبة بشدة داخل الريف الذي يستحوذ على 60%&nbsp; من المشتغلين (عبد الفتاح الجبالى، 2021).&nbsp;
&nbsp;وجدير بالذكر، تقاطع العمل في القطاع غير الرسمي مع الفقر، حيث&nbsp; يشير بحث الدخل والإنفاق&nbsp; 2019-2020 إلى أن 50.9% من إجمالى الفقراء يشتغلون خارج المنشآت أي في القطاع غير الرسمي، كما أن 38% من الفقراء المشتغلين يعملون عمل غير دائم مقابل 21% لغير الفقراء&nbsp; (الجهاز المركزى للتعبئة العامة والاحصاء، 2020).&nbsp; يوضح ذلك الآثار التوزيعية للعمل في القطاع غير الرسمي من ناحية ومستوى جودة التشغيل من ناحية أخرى من حيث الرسمية والانتظام (Assaad et al., 2019). تشير الاحصاءات أن 1% فقط ممن يعملون بأجر داخل هذا القطاع يعملون بعقود قانونية، ونحو 27.3% منهم يعملون عمل دائم، و11% فقط هم المشتركين في التأمينات الاجتماعية و3.2% في التأمين الصحي (عبد الفتاح الجبالى، 2021). والحقيقة كلما انكمشت فرص التشغيل الرسمي مقابل اتساع الانخراط في القطاع غير الرسمي كلما انخفضت جودة التشغيل بالطبع.
<h3>الأطر القانونية والمؤسسية لتنظيم المشروعات المتوسطة والصغيرة ومتناهية الصغر:&nbsp; الحماية الاجتماعية الغائبة:&nbsp;</h3>
1. الإطار القانوني المنظم
يعتبر&nbsp; القانون 152 لسنة 2020&nbsp; الخاص بتنمية المشروعات المتوسطة والصغيرة ومتناهية الصغر هو القانون الأساسي في هذا الصدد، وقد حل محل القانون السابق 141 لسنة 2004.&nbsp; كان أحد أهداف هذا القانون الأساسية هو كيفية تحويل القطاع غير الرسمي في هذه النوعية من المشروعات إلى قطاع رسمي. بدأ الاهتمام بهذه القضية بداية من التعريفات حيث تم تعريف الاقتصاد غير الرسمي وتوفيق الأوضاع، ثم شمل&nbsp; الباب الثالث من القانون : الفصلين الأول والثاني، الحوافز غير الضريبية والضريبية لتشجيع التحول من القطاع غير الرسمي إلى القطاع الرسمي.&nbsp; كما اعتبر القانون جهاز تنمية المشروعات المتوسطة والصغيرة ومتناهية الصغر هو الجهة الوحيدة المنوطة بهذا الملف، وأنه المسئول عن توفيق أوضاع المشروعات التي لا تتمتع بصفة الرسمية.
وعلى الرغم من أن القانون نص على عدد كبير من الخدمات المقدمة لهذه النوعية من المشروعات كحوافز بدء من التمويل مرورا بالتدريب والتسويق وغيره، فإنه لم يتطرق على الإطلاق إلى&nbsp; قضية الحماية الاجتماعية للعاملين في هذا القطاع سواء أصحاب المشروعات أو العاملين لديهم، بل ولم يعتبر الحماية الاجتماعية من ضمن الحوافز المشجعة على التحول للقطاع الرسمي.&nbsp;&nbsp;
2. الإطار المؤسسي المنظم
يعد جهاز تنمية المشروعات المتوسطة والصغيرة ومتناهية الصغر الإطار المؤسسى الرئيس المعني بهذه القضية. يهدف الجهاز إلى وضع برنامج وطني لتنمية وتطوير المشروعات وتهيئة المناخ اللازم لتشجيعها. يعمل الجهاز من خلال شبكة الفروع الإقليمية المنتشرة على مستوى المحافظات والتي تعد الذراع التنفيذي للجهاز بإجمالــــي 33 فرعا، إضافة إلى الشراكة مع حوالي 600 جمعية أهلية معنية بتنمية المشروعات متناهية الصغر و1800 من أفرع البنوك المنتشرة بجميع محافظات الجمهورية وعدد من شركاء التنمية المحليين.&nbsp;
تتعدد أهداف الجهاز حتى تصل إلى 14 هدفا، ليس من بينهم أى هدف يختص بالحماية الاجتماعية لأصحاب هذه النوعية من المشروعات، لا شروط للانضمام لمظلة التأمينات الاجتماعية، ولا أي حقوق ذات صلة. والحقيقة أن غياب حقوق الحماية الاجتماعية لا يقتصر على&nbsp; أصحاب المشروعات لكن بالتبعية ينسحب على من يعملون في هذه المشروعات حيث لا يوجد أي إشارة لشروط التشغيل وحقوق العمل في هذه المشروعات.&nbsp;&nbsp;&nbsp;
<h3>الاحتياج إلى مظلة تأمينية محفزة ومنصفة&nbsp;</h3>
إن الطبيعة المعقدة للمشروعات الصغيرة، وبالأخص متناهية الصغر تفترض طرحا مختلفا، فكل طرفي العملية الانتاجية: صاحب المشروع والعامل يحتاجان للدعم من قبل الدولة، بمعنى أنه لابد من تقديم جملة من الحوافز لتشجيعهم على الانضمام للتأمينات الاجتماعية.&nbsp; وجدير بالذكر، أن كل من قانون التأمينات الاجتماعية وقانون التأمين الصحي يندرجوا تحت ما يطلق عليه الأنظمة التأمينية التكافلية وليست الادخارية مما يوفر مساحة للتعامل العادل والمنصف مع الفئات الأضعف في المجتمع. وبالفعل&nbsp; اشتمل قانون التأمين الصحي الشامل&nbsp; على مكون&nbsp; تكافلى بنصه على تحمل الدولة اشتراكات الفئات الفقيرة في المجتمع.
&nbsp;وعلى صعيد ثان، اشتمل&nbsp; قانون التأمينات الجديد 148 لـ 2019 نصا لتغطية العمالة غير المنتظمة، كما أن اللائحة التنفيذية للقانون نصت على أن اشتراكات العمالة غير المنتظمة مقسمة بين المؤمن عليهم بواقع 9% من الحد الأدنى لأجر الاشتراك شهريا ومساهمة الخزانة العامة بواقع 12% من الحد الادنى لأجر الاشتراك شهريا (الجريدة الرسمية، 2021).&nbsp;&nbsp;
وبناء على هذا، وفي إطار سعى الحكومة المصرية إلى إضفاء الرسمية على القطاع غير الرسمي، فإنه لابد من استلهام روح القواعد والمواد المنظمة للتأمين الاجتماعي على العمالة غير المنتظمة مع تطويرها كي تتناسب مع طبيعة المشروعات الصغيرة ومتناهية الصغر والتي يتسم طرفاها - صاحب العمل والعامل - بالهشاشة في الأغلب الأعم. فمن الصعب تحميل صاحب العمل في المشروعات متناهية الصغر حصته كاملة تجاه العامل كما في المشروعات الكبيرة،&nbsp; مما يستدعي مساهمة الخزانة العامة في هذا الأمر.&nbsp;
&nbsp;وعلى وجه العموم، فالحلول المطروحة من الممكن أن تكون كثيرة من اجل شمول أصحاب هذه المشروعات ومن يعملون فيها بمظلة التأمينات الاجتماعية، على أن يكون الشمول كاملا بمعنى أنه يشمل الشيخوخة والعجز والوفاة وإصابات العمل وكل المزايا ذات الصلة.&nbsp;
&nbsp;وعلى الرغم من أن تحمل الخزانة العامة لحصة أو نسبة من حصة المؤمن عليهم يمثل عبء ماليا، إلا انه عبء قصير الأمد، سيخلف عوائد طويلة الأمد فيما يتعلق باتساع التغطية، ومن ثم زيادة الموارد المالية المتاحة للتأمينات وتحقيق الاستدامة المالية.&nbsp;
&nbsp;فالسيناريو في النهاية هو سيناريو الكسب للجميع وأن اختلفت الآماد الزمنية لذلك.&nbsp; وأخيرا، إن الرهان على أن المشروعات الصغيرة ومتناهية الصغر هي قاطرة لتوفير فرص عمل&nbsp; يحتاج إلى حزمة متكاملة من الحوافز سواء كانت ضرائبية أو غير ذلك، وكذلك مظلة حماية اجتماعية محفزة على الانضمام والاستمرار في الانضمام. ويظل على جهاز تنمية المشروعات المتوسطة والصغيرة ومتناهية الصغر المسئولية الاساسية في تولى هذا الملف بحكم انه المسئول عنه كاملا سواء كان هو الممول أو غيره.&nbsp;

The Egyptian government relies on small and micro enterprises (SMEs) to create jobs. Although SME development falls within the remit of the Medium, Small, and Micro Enterprise Development Agency (MSMEDA) according to the decree establishing it (no. 947/2017, amended with Decree 2370/2018) (Small Enterprise Platform, n.d.), other government bodies play a role as well, such as the Ministry of Social Solidarity&rsquo;s economic empowerment programs (Fursa, Mastoura, etc.). The mission of the MSMEDA also includes coordinating and harmonizing the efforts of all government bodies, NGOs, and initiatives in the field, making it the main body in charge of the creation and financing of SMEs in Egypt.&nbsp;
This article seeks to answer a basic question: do SMEs, whether financed by the MSMEDA or other bodies (governmental or civic associations subject to the Financial Regulatory Authority) create good quality, decent jobs? Do the institutional and legal frameworks that regulate this type of business guarantee the right to social protection, specifically by requiring enrollment in social insurance?&nbsp;
The standards for what constitute a decent job include formality, regularity, appropriate remuneration, a contract and social and health insurance protection, but it is difficult to examine the question of decent work in Egypt separately from the larger issue of the informal sector, since more than half of all medium and small enterprises operate informally. As such, the informal sector is the broader framework that is the subject of this study.&nbsp;
<h3>Features of the informal sector in Egypt: The intersection of informality and poverty</h3>
Many surveys and studies have found that decent jobs are on the retreat in Egypt as the informal sector &mdash; both informal businesses and workers &mdash; continues to expand. According to the Economic Census, 2 million of the 3.7 million existing establishments, or 54% of all establishments, operated in the informal sector in 2017/18. Most of these are SMEs: 81% of them have less than EGP100,000 in capital, followed by firms with less than EGP200,000 and more than EGP100,000 in capital at 18%. Some 96% of establishments employ less than five people. Research on the labor force shows that 44% of workers worked outside establishments in 2020, compared to 35% in the formal private sector and 21% in the government and public sector. In other words, most of the workforce works in the informal sector. This is much more pronounced in rural areas, where 60% of workers work in the informal sector (al-Gabali, 2021).&nbsp;
Importantly, work in the informal sector intersects with poverty. The Income and Expenditure Survey found that 50.9% of the poor worked outside of establishments in 2019/20, meaning in the informal sector. Some 38% of poor workers are irregularly employed, compared to 21% of the non-poor (Central Agency for Public Mobilization and Statistics, 2020). The link is clearly evident in the distributional impacts of work in the informal sector and the quality of employment in terms of formality and regularity (Assaad et al., 2019). Data shows that only 1% of wage workers in the informal sector have an employment contract and 27.3% work permanent jobs; only 11% are enrolled in social insurance and a mere 3.2% in health insurance (al-Gabali, 2021). The fact is that the more formal jobs shrink and the informal sector expands, the lower the quality of jobs.&nbsp;&nbsp;
<h3>Legal and institutional frameworks regulating SMEs: Lacking social protection&nbsp;</h3>
1. Legal regulatory framework
Law 152/2020 on the development of medium, small and micro enterprises is the main relevant law, replacing Law 141/2004. One of the objectives of the law was to formalize SMEs in the informal sector. The interest in this issue is first evident in the law&rsquo;s definitions, which define the informal sector and the regularization of legal status. Chapter Three of the law includes two sections: non-tax and tax incentives to encourage formalization. The law also makes the MSMEDA the sole body responsible for legalizing the status of informal enterprises.&nbsp;
Although the law explicitly provides for numerous services for this type of business &mdash; from funding to training to marketing and more &mdash; it does not address the issue of social protection for workers in the informal sector, whether business owners or their employees. Indeed, it does not consider social protection an incentive for formalization.&nbsp;&nbsp;
2. Institutional regulatory framework
The MSMEDA is the main institutional framework for SMEs. The agency&rsquo;s mission is to establish a national program for the development of SMEs and foster a suitable climate for their operation. The agency works through a network of 33 regional branches on the governorate level, which are the agency&rsquo;s executive arm, as well as through partnerships with some 600 civic associations working on SME development, 1,800 bank branches around the country, and numerous local development partners.&nbsp;&nbsp;
The agency has 14 specific objectives, but none of them concern social protection for SME owners, conditions for enrollment in social insurance, or related rights. The lack of social protection rights is not limited to SME owners, but naturally extends to those who work in these enterprises, as the agency&rsquo;s mandate contains no provision or mention of conditions of employment or labor rights in SMEs.&nbsp;
<h3>The need for an incentivizing and fair insurance umbrella</h3>
The complex nature of small businesses, particularly micro enterprises, demands a new approach. Both parties to the productive process &mdash; the entrepreneur/enterprise owner and the worker &mdash; need the support of the state, which should offer a set of incentives to encourage them to enroll in social insurance schemes. It should be noted that both the social insurance law and the health insurance law provide for solidarity-based insurance systems rather than savings-based systems. This allows for the fair treatment of more vulnerable groups in society. And indeed, the comprehensive health insurance law contains a mutual aid component in that it provides for the state to cover the insurance contributions of poor groups.&nbsp;&nbsp;
The new insurance law (Law 148/2019) also contains provisions for coverage for informal workers. The law&rsquo;s implementing regulations state that insurance contributions will be split between the worker, who will pay 9% of his wages monthly as premiums, and the state treasury, which will contribute 12% (Official Gazette, 2021).&nbsp;&nbsp;
Given this, as the Egyptian government seeks to formalize the informal sector, it should draw inspiration from the rules regulating social insurance for informal workers while adapting them to the nature of SMEs, where typically both entrepreneurs and their employees are vulnerable. It would be difficult to require the owner of a micro enterprise to cover his employees&rsquo; entire insurance contribution as if they headed a major firm. This requires the state to step in and contribute.&nbsp;&nbsp;
Generally speaking, there are multiple solutions for bringing owners of SMEs and their employees into social insurance systems, provided that the coverage offered is comprehensive, including insurance for old age, incapacity, death, and work injury, and all related benefits. Although the state assuming the responsibility to pay all or a percentage of insurance contributions for these workers does represent a financial burden, it is a short-term one that will have long-term benefits. By expanding coverage, it will increase the financial resources available for insurance and achieve fiscal sustainability.&nbsp;&nbsp;
The outcome is one in which everyone wins, though the time frame may differ. Finally, betting on SMEs to be an engine for job creation requires an integrated set of incentives, both tax and non-tax, and a social insurance umbrella that encourages and sustains enrollment. The MSMEDA remains the main body responsible for overseeing this issue regardless of whether it is the primary funder of any individual SME.&nbsp;
