يُنظر إلى عمل الرعاية على مر التاريخ على أنه "عمل بدافع الحب"، لا سيما عندما يتم إجراؤه في المساحة الشخصية الخاصة داخل المنزل، ومن ثم لا يظهر هذا العمل على المستوى المرئي. وعلى الرغم من أنه لا يُعترَف بقيمة هذا العمل الإنتاجية ومساهمته في الاقتصاد (Bunting, 2021) فإنه، كما تصفه "آي-جين-بو"، "العمل الذي يجعل جميع الأعمال الأخرى ممكنة" (Poo, 2018).
وبدلًا مِن أن يتمّ التعامل معها على أنها مسؤولية مشتركة في سبيل الاعتراف بدورها في أداء الاقتصاد فإن أعمال الرعاية المنزلية إمّا أن تتحمّلها النساء بشكلٍ غير متناسبٍ على هيئة عمل غير مدفوع الأجر أو يتم إسنادها إلى نساء من ذوات الدخل المنخفض والفئات المهمّشة الأخرى التي تؤدّي العمل في الخدمة المنزلية مقابل أجر، ويحدث ذلك في كثيرٍ من الأحيان في ظروف قاسية. يُقدّر عدد عمال الخدمة المنزلية، الذين يمثلون محور مناقشة هذه الورقة، بـ75.6 ملايين على مستوى العالم (International Labour Organization [ILO], 2020). يعمل هؤلاء العمال في عزلةٍ خلف أبواب مغلقة، ومن ثم فهم معرّضون بشكل خاص للاستغلال وغالبًا لا تشملهم قوانين العمل. ففي مصر، على سبيل المثال، تستبعد المادة 4 من قانون العمل (القانون رقم 12 لسنة 2013) صراحةً عمال الخدمة المنزلية من نطاقها التنظيمي، وتُفرِدهم باعتبارهم "استثناءً" بسبب "العلاقات القوية التي تنمو بين الخادم وصاحب العمل. وسعيًا لوضع إطارٍ لهذه العلاقة على أنها رابط شخصي وخاص بدلًا من علاقة عمل تقليدية، يلمح القانون إلى أن العمل في الخدمة المنزلية ليس "عملًا لائقًا" (Jureidini, 2009). كما لا يغطي مشروع قانون العمل الجديد قيد المناقشة حاليًّا في البرلمان عمال الخدمة المنزلية، لكن تم تقديم مشروع قانون منفصل ينظم العمل في الخدمة المنزلية إلى البرلمان في مارس 2021 (Youm7, 2021). وفي حالة الموافقة عليه، ستكون هذه هي المرة الأولى التي يتم فيها الاعتراف بالعمل في الخدمة المنزلية بوصفه عملًا خاضعًا للوائح وقوانين الدولة، بعد عقد من اتفاقية منظمة العمل الدولية رقم C189 التي وضعت العمل في الخدمة المنزلية على قدم المساواة مع جميع أشكال العمل بأجر الأخرى ومنحت عمال الخدمة المنزلية نفس الحقوق التي يحصل عليها جميع العمال بأجر الآخرين. وقد صادقت خمسٌ وثلاثون دولة على الاتفاقية حتى الآن، معظمها في أمريكا اللاتينية، غير أنه لم تصدق عليها مصر ولا أي دولةٍ أخرى في الشرق الأوسط (ILO, 2021b).

Introduction
Historically seen as a &ldquo;labor of love,&rdquo; care work &mdash; especially when carried out within the private space of a household &mdash; is invisible. Although its productive value and contribution to the economy is unrecognized (Bunting, 2021), it is, as Ai-Jen-Poo puts it, &ldquo;the work that makes all other work possible&rdquo; (Poo, 2018).
Rather than being treated as a shared responsibility in recognition of its role in the functioning of the economy, domestic care work is either disproportionately shouldered by women in the form of unpaid work or handed off to lower-income women and other marginalized groups who perform paid domestic labor, often in dire conditions. Domestic workers (DWs), the focus of this paper, are estimated to number 75.6 million globally (International Labour Organization [ILO], 2020). Working in isolation behind closed doors, they are particularly vulnerable to exploitation and often are not covered by labor laws. In Egypt, for example, Article 4 of the labor law (Law 12/2013) explicitly excludes domestic workers from its scope of regulation, singling them out as an &ldquo;exception&rdquo; because of &ldquo;the strong relations that grow between the servant and the employer.&rdquo; In framing this relationship as a personal and private bond rather than a conventional labor relationship, the law insinuates that domestic work is not &ldquo;proper work&rdquo; (Jureidini, 2009). The new draft labor law currently under discussion in parliament similarly does not cover domestic workers, but a separate bill regulating domestic work was submitted to parliament in March 2021 (Youm7, 2021). If passed, this will be the first time domestic work is recognized as work subject to&nbsp; state regulation, a decade after ILO Convention 189 placed domestic work on par with all other paid labor and granted domestic workers the same rights as all other paid workers. Thirty-five countries have ratified the convention so far, most of them in Latin America. Neither Egypt nor any other state in the Middle East has ratified it (ILO, 2021b).
This paper examines the international protection framework supporting domestic work with the aim of highlighting the policy reforms necessary to improve the conditions of domestic workers in Egypt. It also aims to add to a very small pool of research on the topic in Egypt, putting a long overdue spotlight on the issue and taking the opportunity presented by the bill to address the rights of domestic workers. It further sets out to place the issues faced by domestic workers within the larger context of the devaluation of care work. By exploring what it could mean to rethink care altogether, the paper will necessarily address related topics such as improving women&rsquo;s participation in the labor force, women&rsquo;s economic empowerment, women&rsquo;s informal work, and vulnerability. Using the standards set forth by C189 as a guide for legislation and building on the experiences of countries that have ratified the convention or have exerted considerable efforts to improve the conditions of domestic workers over the past decade, this paper will outline the main challenges to better conditions and the best global practices, adapting them to Egypt&rsquo;s current situation and utilizing the proposed bill as a base to build on.
